Lodge general purpose financial statements in approved form by the income tax return due date and publish required data within 12 months, correcting material errors within 28 days (ss 3CA(2), 3D(3), 3DB(1)). Nominate an approved Australian financial institution account promptly to avoid refund retention (s 8AAZLH). Keep accurate accounts and records, make statements that are not false or misleading, and correct PAYG or superannuation reporting within safe-harbour periods (ss 8K(2A)-(2B), 8L). Lodge objections within the exact periods in s 14ZW(1), providing full reasons for any late request (s 14ZW(3)), and respond to information requests during retention or review. Ensure compliance with electronic payment requirements for GST/PAYG (s 8AAZMA) and business-day due date shifts (s 8AAZMB). For whistleblower disclosures, use authorised channels to maintain confidentiality protections (ss 14ZZT-14ZZW). Nominate an approved-form Australian financial institution account meeting the holder requirements in s 8AAZLGC(1)(a)-(b) or s 8AAZLH(2)-(2A) as soon as a refund entitlement arises. Maintain accurate accounts, accounting records and other records that correctly record and explain all matters, transactions, acts and operations (ss 8L(1), 8L(1A)), and correct any errors promptly. Use the approved correction mechanisms for PAYG notifications under s 389-5 Sch 1 or s 390-5 Sch 1 statements within the prescribed periods to avoid offences under ss 8K and 8N. When making disclosures, direct them to the Commissioner, Tax Practitioners Board, eligible recipients (auditors, registered agents, authorised persons, directors or trustees) or legal practitioners for advice, ensuring reasonable grounds to suspect misconduct in tax affairs. Nominate a compliant financial institution account to receive refunds (s 8AAZLH). If facing GIC, provide evidence of non-fault circumstances and reasonable mitigation to support remission requests under s 8AAG(3) or (4). In recovery or penalty proceedings, rely on RBA statements and certificates as prima facie evidence while ensuring all allocations and applications follow the mandatory methods in ss 8AAZLA or 8AAZLB. Register for PAYG withholding under s 16-140 and, where applicable, as an employer of working holiday makers under s 16-147, providing the required declarations and information. Withhold using Commissioner withholding schedules or regulations under ss 15-10, 15-25 and 15-35, taking account of TFN declarations and declarations under s 15-50. Pay amounts to the Commissioner by the due dates for large, medium or small withholders or deferred BAS payers. Give payment summaries in approved form within 14 days after the financial year end or on request (ss 16-155 to 16-170), excluding amounts notified under Division 389. Lodge annual reports under s 16-153 by the specified dates in approved form. For objections, lodge within the applicable period under s 14ZW(1), including 60 days after notice or 2 or 4 years for specified assessments, and request an extension in writing with full reasons if out of time (s 14ZW(2)-(3)). Apply for clearance certificates or make declarations under ss 14-220 and 14-225 before relevant transactions to avoid payment obligations. Notify the Commissioner of natural resource payments under s 12-330 and obtain certificates where available under s 12-335. Ensure notices or website details are provided under ss 12-395 and 12A-15 where no withholding applies. Maintain records to support calculations of fund payments, AMIT DIR payments and reportable employer superannuation contributions. Apply for registration in the approved form by the first withholding or payment day or within a longer period allowed by the Commissioner (s 16-140(1)-(2)), with separate application for PAYG withholding branches where the branch maintains an independent accounting system and the entity carries on or intends to carry on an enterprise through the branch from a specified date (s 16-142(1)). Employers of working holiday makers must apply in the approved form by the first withholding day and make the required declaration of genuine business requirement, agreement to comply with the Fair Work Act 2009 and to check visa status, and provide required employment information (ss 16-146(2)-(3), 16-147(1)-(2)). Notify the Commissioner in the approved form on or before the due date whether or not amounts are paid (s 16-150(1)), with specific timing for Subdivision 14-E amounts and build-to-rent amounts (s 16-150(2)-(5)). Trustees must give approved-form reports on withholding payments covered by ss 12-175 or 12-180 within three months after income year end or longer period allowed (s 16-152(1)-(2)) and on trust distributions even where TFN quoting prevented withholding, lodged with the trust's income tax return or longer period allowed (s 16-152(3)-(4)). Give annual reports by 31 October after a financial year on payments from which amounts were required to be withheld under s 12-190, Subdivisions 12-F (except specified sections), 12-FA, 12-FC or 12-G, or related non-cash benefits, and on receipts of such payments (s 16-153(1)), or by 14 August on Subdivision 12-B, 12-C or 12-D payments, alienated personal services payments, related non-cash benefits, reportable fringe benefits amounts and reportable employer superannuation contributions (s 16-153(2)). Give payment summaries to recipients within 14 days after financial year end for most withholding payments, reportable fringe benefits amounts and reportable employer superannuation contributions (s 16-155(1)), covering the relevant payments except those in prior part-year summaries (s 16-155(2)). Give part-year payment summaries within 14 days of a written request made not later than 21 days before year end, unless reportable fringe benefits or reportable employer superannuation contributions apply (s 16-160(1)-(2)). Give payment summaries for superannuation lump sums and employment termination payments within 14 days (s 16-165), for departing Australia superannuation payments within 14 days (s 16-166) and for s 12-190 payments when making the payment or as soon as practicable (s 16-167). Trustees must give payment summaries for ss 12-175 or 12-180 payments within 14 days after the report due date or longer period allowed (s 16-156) and for Subdivision 12-H fund payments within 14 days after six months after the MIT income year end or longer period allowed (s 16-157). Withhold from payments covered by Division 12 when making the payment (s 16-5), using Commissioner withholding schedules or regulations (s 15-10), and pay the amount to the Commissioner by the dates in s 16-75, with electronic payment for large withholders (s 16-85(1)). For AMITs, calculate deemed payments under s 12A-205 on issue of the AMMA statement, give notices or make details available under s 12A-15 for DIR and fund payments relating to deemed or pre-AMMA actual payments, and pay amounts to the Commissioner under ss 12A-215 or 12A-220 for payments to offshore entities or non-residents. For Division 13, calculate the amount under the method statement in s 13-5(2) and pay by the end of the 21st day after PAYG period end, with deferred BAS payer extensions (s 13-5(3)-(5)). For Division 14, pay before providing non-cash benefits (s 14-5), pay TFN withholding tax on accruing gains (s 14-55) and on ESS interests (s 14-155), pay 15 per cent of the first element of the cost base on acquiring CGT assets from foreign residents (s 14-200(3)) and additional amounts for look-through earnout rights (s 14-205(3)), and pay 1/11 of the price (or margin scheme percentage) as recipient of taxable supplies of new residential premises or potential residential land (s 14-250(6)). Suppliers must give the required written notice before the supply (s 14-255(1)). Apply for clearance certificates under s 14-220 or make declarations under s 14-225 to avoid payment obligations under Subdivision 14-D. Apply for variations of amounts under s 15-15 or s 14-235 where special circumstances apply. For MITs, determine whether amounts are MIT cross staple arrangement income (s 12-437), MIT trading trust income (s 12-446), MIT agricultural income (s 12-448) or MIT residential housing income (s 12-450), applying de minimis, approved economic infrastructure facility, transitional and concessional cross staple rent cap rules (ss 12-438 to 12-445, 12-447, 12-449, 12-451) and allocating deductions first against excepted MIT CSA income up to the cap (s 12-445(2)). Give TFN declarations or voluntary agreements where required to avoid withholding (ss 12-140, 12-175, 12-190). Keep copies of voluntary agreements for five years (s 12-55(2A)). Individuals expecting withholding payments may give declarations under s 15-50 to affect the amount to withhold. Monitor Commissioner determinations of withholder status (ss 16-95 to 16-105) and apply for re-determination where appropriate. Check whether the whole payment is exempt income or non-assessable non-exempt income before withholding under ss 12-35 to 12-190 (ss 12-1(1) and (1A)). Apply the priority table in s 12-5(2) to determine the single applicable provision. Disregard living-away-from-home allowance benefits and expense payment benefits when calculating amounts under listed sections (ss 12-1(2) and (3)). Ensure voluntary agreements are in approved form, state that s 12-55 covers the payments, include the individual's ABN, and retain copies for 5 years (ss 12-55(1) and (2)). For investment payments, confirm TFN or ABN quotation before the relevant time or apply exceptions in ss 12-150 to 12-170 (s 12-140(1)). For supplies, confirm ABN quotation on the invoice or document or apply exceptions in ss 12-190(2) to (6). Directors must ensure the company pays amounts withheld under s 16-70(1) by the required day to avoid liability under s 18-125. Associates should document steps taken to influence the director to notify under Subdivision 18-C, cause payment or insolvency events, or report non-payment to the Commissioner or relevant authority (s 18-135(3)). Apply promptly for payer refunds before the end of the financial year (s 18-65) or Commissioner refunds with supporting TFN, evidence or ABN details (ss 18-70 and 18-80). Respond to any notice under s 18-140 by considering objection rights under Part IVC within applicable time limits. Maintain records of all withholding, payments to the Commissioner and any later discharges to support credit claims under ss 18-170 and 18-175.
