Tattooing Industry Control Act 2015

The Act’s central legal concepts are defined and deployed to translate policy objectives into enforceable obligations and powers. Key concepts, and their statutory mechanics, include the following.

• Provider of tattooing services (s 4). The definition is expansive. A natural person provides tattooing services by actually tattooing another person, by carrying on a business involving tattooing, by being a director of a corporate that carries on that business, by supplying prescribed tattooing equipment, or by providing other services prescribed by regulation. Bodies corporate are treated similarly, and a supply by a courier or postal service of prescribed equipment is expressly excluded from the meaning of supply (s 4(2)). This structure captures not just artists but business owners, directors, suppliers and others the regulations may later prescribe.
• Prescribed organisation and close associate (s 3). A "prescribed organisation" includes declared organisations under the Serious and Organised Crime (Control) Act 2008 and criminal organisations under the Criminal Law Consolidation Act 1935, plus any other organisations the regulations may prescribe. The "close associate" concept is broad, including familial relationships, household co-membership, partnerships, related bodies corporate, profit participation and control or significant influence (s 3(3)). Those two definitions are central to the automatic disqualifications under s 7 and to administrative disqualifications under s 8.
• Disqualification (ss 7-10). Section 7 imposes automatic and permanent disqualifications (for example, members of prescribed organisations and close associates). Section 8 gives the Commissioner power to issue disqualification notices for specified reasons, including conduct within the previous 5 or 10 years, or where the Commissioner reasonably believes disqualification is appropriate to avert a safety risk or in the public interest. Disqualification notices are written, may be indefinite, must state grounds unless those grounds are criminal intelligence as classified by the Commissioner of Police (s 8(5)-(6)), and can be varied or revoked (s 10). Service requirements and the consequences of non-service are addressed at s 9.
• Criminal intelligence confidentiality and procedure (s 5). Where disqualification (or refusal to revoke) is based on Commissioner-of-Police-classified "criminal intelligence", disclosure of the underlying information is restricted to listed recipients; the Commissioner for Consumer Affairs need not provide further grounds beyond a public-interest statement (s 5(1)-(2)). Courts and tribunals are required to maintain confidentiality where the Commissioner of Police applies for it, and may receive evidence by affidavit from senior police officers (s 5(3)).
• Authorised officers and directions (ss 12, 18-19). "Authorised officers" is a class that includes the Commissioner, police, Fair Trading authorised officers, and persons or classes the Commissioner authorises. Authorised officers may direct providers to take actions reasonably required to avert, eliminate or minimise public-safety risks, and those directions are written notices that may require discontinuance of activities, specific actions, or control measures (s 12). Authorised officers also have wide entry, inspection, seizure and record-access powers (s 19).
• Police operational powers (ss 20, 22). Police may deploy drug-detection powers under the Controlled Substances Act 1984 on premises used for tattooing (s 20) and may undertake random weapons and explosives searches on such premises, with scope to use detection dogs, metal detectors and approved electronic detection systems (s 22).
• Information and record-keeping obligations (ss 13-16). New businesses must notify at least 90 days before commencing, other persons must notify within 28 days of commencing or of the commencement of the section, and employees must notify within 28 days of beginning employment that includes tattooing services (s 13(3), s 14). Notices must be in the form and manner determined by the Commissioner (s 13(3)(a), s 14(2)). Records required by regulation must be kept for at least two years (s 16).
• Delegation and regulation (ss 18(1)(d), 30). The Commissioner may authorise persons as authorised officers subject to conditions (s 18). The regulations power is broad and may prescribe exemptions, codes of conduct, periodic returns, fees, penalties for regulation breaches, incorporation of standards by reference, and transitional savings (s 30).

These concepts interact to create an administrative regime that uses definitional breadth to capture multiple participants in the tattoo supply chain; a disqualification system that blends automatic exclusion with administrative notices; confidentiality protections for police-classified material; and compliance obligations backed by search, seizure and criminal penalties. The Act provides multiple avenues for regulation by subordinate instruments (regulations, Ministerial Gazettes), and indicates that much operational detail will be supplied by delegated instruments (s 30).

The Act has been drafted to catch a wide range of persons and entities involved in the tattooing sector and related supply chains. Who pays and who decides follow directly from the statutory definitions and enforcement architecture.

• Tattooists and studio operators. Natural persons who tattoo others or who run tattooing businesses are primary targets. They must notify the Commissioner under s 13 (90 days prior for prospective businesses; 28 days for those already operating when the section commences or who commence later), keep records as required by regulation and comply with directions issued by authorised officers (s 13, s 16, s 12). They may be subject to inspection and seizure powers (s 19).
• Employees and contractors who perform tattooing. Any person who, paid or unpaid, provides tattooing services in employment must notify the Commissioner within 28 days of commencing employment (s 14), and is otherwise captured by the provider definition if they tattoo others or supply prescribed equipment (s 4).
• Business owners and directors. Bodies corporate carrying on tattooing are within the scope (s 4). Directors are specifically captured by the definition of provider (s 4(1)(a)(iii)) and are exposed to liability: corporate offences attract director liability unless the director proves due diligence to prevent the offence (s 27). Directors must be named in notifications required by s 13(3)(c)(i)(C).
• Suppliers of equipment. The Act covers those who sell or supply prescribed tattooing equipment (s 4(1)(a)(iv), s 4(1)(b)(iii)). The regulations have further reach to prescribe additional equipment (s 4(3)).
• Close associates and related bodies corporate. The Act disqualifies not only direct participants but also close associates of members of "prescribed organisations", extending reach to family members, household members, partners, related corporations, persons with profit participation rights, and those exercising control or significant influence (s 3(3)). This makes persons connected by business or personal relationships susceptible to automatic disqualification under s 7.
• Persons and organisations designated as "prescribed organisations". Members of organisations declared in other Acts (for example, declared organisations under the Serious and Organised Crime (Control) Act 2008 or criminal organisations under specified divisions of the Criminal Law Consolidation Act 1935), and any other organisations prescribed by regulations, are automatically disqualified (s 3, s 7).
• Wider businesses that host tattooing. Owners, occupiers or managers of premises in which tattooing services are provided may receive directions under s 12 if the direction relates to premises condition; they may be required to discontinue or change activities to minimise public-safety risks. They will also be subject to authorised-officer entry powers and police search powers where premises are reasonably suspected of being used for tattooing (s 12, s 19, s 20, s 22).
• Law enforcement and regulatory personnel. Police are central enforcement actors; the Commissioner of Police is given power to classify "criminal intelligence", disclose relevant information to the Commissioner for Consumer Affairs, and approve detection equipment and dog training standards (s 5, s 25, s 22(4)-(6)). The Commissioner for Consumer Affairs has broad administrative authority and may authorise additional authorised officers (s 6, s 18).
• Persons in possession of prescribed items at tattoo premises. The Act creates an offence to possess a "prescribed item" (such as firearms, explosives or dangerous articles as defined or later prescribed) on premises used to carry on tattooing (s 21). This targets those who bring or store such items at tattoo premises.
• Exempted classes. The Minister may exempt persons or classes of persons, or classes of tattooing services, by Gazette notice on conditions (s 23). The regulations may also create exemptions (s 30).

Who decides: the Commissioner for Consumer Affairs administers the Act subject to Ministerial control (s 6). Administrative disqualifications, directions, authorised-officer authorisations, forms and the particulars of notification are determined by the Commissioner, while the Commissioner of Police controls classification of criminal intelligence (s 5, s 6, s 18).

Who pays: regulated parties bear the direct costs of compliance , notification, record-keeping, potential licence-like pre-notification lead times, possible operational changes imposed by directions, and penalties for non-compliance. Corporations face large statutory fines and natural persons may face imprisonment for certain offences (s 7(1), s 11(1), s 13-16). The regulations also permit fees to be fixed for matters under the Act (s 30(2)(e)).

The Act creates specific duties imposed on providers, employees, directors and others, and sets out review rights and procedural safeguards. The duties and rights are concrete and linked to sections in the statute.

Key statutory duties

• Notification obligations (s 13). Persons proposing to carry on a tattooing business must give written notice in a form determined by the Commissioner. Prospective operators must provide notice at least 90 days before commencing. Persons already operating when the section commences, and those who start after commencement, must notify within 28 days. Notices must include specified identity and premises details (s 13(3)(c)). A duty to inform the Commissioner within 14 days of any change to that information is also imposed (s 13(4)).
• Employee notification (s 14). Employees (paid or unpaid) who provide tattooing services must notify the Commissioner within 28 days of starting employment. The form and content are determined by the Commissioner and regulations (s 14(1)-(2)).
• Record keeping (s 16). Businesses must keep records required by regulation and retain them for at least two years (s 16(1)-(2)). Records must be provided in the manner required by the Commissioner when requested.
• Compliance with directions (s 12). Authorised officers can direct persons to cease activities, take specific actions, or implement measures to eliminate or minimise public-safety risks. Directions must be written and served, specify the purpose and may be joint, and recipients must comply unless they have a reasonable excuse (s 12).
• Response to information notices (s 15). The Commissioner can require persons suspected of having relevant knowledge to provide information by written notice; the recipient must comply unless they have a reasonable excuse, and must do so in the prescribed form and time (s 15).
• Avoid employing disqualified persons (s 11). Persons who carry on a business involving tattooing must not allow disqualified persons to provide tattooing services in their business. There is a statutory defence of reasonable belief on reasonable grounds (s 11(2)).
• Avoid possession of prescribed items on tattoo premises (s 21). Possession of firearms, explosives, dangerous or prohibited weapons, or other regulated items at premises used for tattooing is a criminal offence, subject to the defence that the defendant did not know and could not reasonably have been expected to have known that the premises were used for tattooing (s 21(1)-(2)).

Key statutory rights and protections

• Right to written reasons and review (s 17). Persons dissatisfied with Commissioner decisions or authorised-officer directions may seek review from the South Australian Civil and Administrative Tribunal under s 34 of the SACAT Act. The Commissioner or authorised officer must provide written reasons if requested; where reasons are provided later, the review period runs from the date the person receives the reasons (s 17(1)-(3)).
• Procedural protections for criminal-intelligence-based decisions (s 5). Where the Commissioner of Police classifies information as criminal intelligence, disclosure is restricted (s 5(1)). If disqualification is based on such information, the Commissioner for Consumer Affairs need only state that it would be contrary to the public interest for the person to provide services (s 5(2)). Courts and tribunals must take steps to maintain confidentiality and may hear classified material in private or receive evidence via affidavit from a senior police officer (s 5(3)).
• Service protections (s 9). Disqualification notices must be personally served to be binding, subject to substituted service orders if reasonable efforts fail and a court so orders (s 9(1)-(3)). Police may detain an individual for up to 2 hours to effect service where necessary (s 9(2)).
• Limitations on entry to residential premises (s 19(2)). Authorised officers may not use entry powers against residential premises except with occupier consent, magistrate-issued warrant, or where there are reasonable grounds to suspect regular use of the residential premises for tattooing.
• Evidentiary presumptions (s 29). In prosecutions under the Act, allegations about disqualification status or authorised officer status are accepted as proved in the absence of proof to the contrary; documents certified by the Commissioner are accepted as genuine in the absence of contrary proof (s 29). These presumptions shift evidential burdens and are positive rights for prosecutors, which regulated parties should plan for.

Delegated powers and administrative discretion

• The Commissioner has multiple administrative discretions: to determine the form and manner of notices, to authorise officers (s 18), to issue, vary and revoke disqualification notices (s 8, s 10), and to administer exemptions in consultation with the Commissioner of Police (s 23). Regulations can materially shape compliance obligations by prescribing equipment, codes of conduct, periodic returns, fees and other matters (s 30).

Penalties and criminal exposure

• The Act ties certain duties to severe penalties, including imprisonment for natural persons and high monetary penalties for corporations. For example, providing tattooing services while disqualified attracts maximum imprisonment for 4 years for natural persons and a $250,000 fine for corporations (s 7(1)). Failure to notify or record-keep attracts fines or imprisonment (s 13-16). Offences for false or misleading information may also attract up to $100,000 or one year imprisonment for natural persons and $250,000 for bodies corporate (s 24).

In sum, the Act imposes affirmative administrative duties (notifications, record-keeping, responses to information notices), negative duties (do not employ disqualified persons; do not possess prescribed items on premises), grants wide investigatory powers to authorised officers and police, and attaches significant criminal and civil penalties. Procedural rights exist, notably Tribunal review and confidentiality protections where police-classified criminal intelligence is used.

The Act combines criminal sanctions, pecuniary penalties, regulatory expiation fees, seizure powers and administrative enforcement tools. The statutory design centralises enforcement through authorised officers and police while providing for evidentiary presumptions that facilitate prosecutions. Key enforcement and penalty mechanics follow.

Criminal penalties and fines

• Disqualification offences. It is an offence to provide tattooing services if disqualified under s 7; the maximum penalty for natural persons is imprisonment for 4 years and for bodies corporate a fine of $250,000 (s 7(1)). Similarly, knowingly contravening a disqualification notice issued under s 8 is punishable by the same maximum penalties (s 8(3)). Allowing a disqualified person to provide tattooing services in a business is an offence: natural persons face up to 4 years imprisonment, corporations $250,000 (s 11(1)).
• Notification and record-keeping breaches. Failure to give required notice about commencing a tattooing business attracts a maximum penalty of $100,000 or imprisonment for 1 year for natural persons, and $250,000 for bodies corporate (s 13(1)-(2)). Failure to notify changes within 14 days attracts the same maximum penalties (s 13(4)). Employees who fail to notify within 28 days face a maximum penalty of $100,000 or 1 year imprisonment (s 14(1)). Failure to comply with a Commissioner’s information requirement under s 15 is punishable by $100,000 or 1 year imprisonment (s 15(3)).
• False or misleading information. Making a statement that is false or misleading in a material particular in any information provided or record kept under the Act carries the maximum penalty stated at s 24: $100,000 or 1 year imprisonment for natural persons; $250,000 for bodies corporate.
• Possession of prescribed items. Possession of a prescribed item (firearm, explosive, dangerous article, offensive or prohibited weapon, or other prescribed item) in premises used for tattooing is an offence with maximum penalty imprisonment for 2 years (s 21(1)). There is a defence that the defendant did not know, and could not reasonably be expected to have known, that the premises were used for tattooing (s 21(2)).
• Obstruction and hindrance. Hindering an authorised officer or failing to comply with requirements under s 19 attracts a maximum penalty of $5,000 (s 19(5)).

Expiation fees and regulatory penalties

• Expiation and regulation-linked penalties. Record-keeping offences carry a specified expiation fee of $10,000 (s 16(1)-(2)). The regulations may impose penalties up to $10,000 for contravention of regulations and fix expiation fees not exceeding $1,000 for alleged regulatory offences (s 30(2)(f)-(g)). The Governor may therefore create lower-level regulatory offences and expiation schemes.

Enforcement powers

• Entry, search and seizure. Authorised officers may enter and remain on premises reasonably suspected of being used for tattooing services; if entry is refused, authorised officers may employ reasonable force to gain entry (s 19(1)(a)). They may inspect or search premises, equipment, and records, copy and remove records temporarily to make extracts, and seize anything that constitutes evidence of an offence under the Act (s 19(1)(b)-(f)). The Act limits residential entry to consent, authority of a warrant issued by a magistrate under s 19, or where there are reasonable grounds to suspect continuing or regular use of residential premises for tattooing (s 19(2)). A magistrate may issue a warrant where satisfied by information on oath that the warrant is reasonably required (s 19(3)).
• Police operational powers. Under s 20, police may conduct general drug detection under the Controlled Substances Act 1984 for premises reasonably suspected of being used for tattooing. Under s 22, police may conduct random weapon and explosive searches with powers to search persons and premises, take samples and photographs, carry out tests and seize suspected evidence. Use of detection dogs, metal detectors and authorised electronic detection systems is expressly permitted (s 22(4)). The section clarifies that it does not authorise intimate or intrusive searches (s 22(3)).
• Directions and compliance. Authorised officers can issue written directions to providers to avert, eliminate or minimise safety risks; such directions can require discontinuance of activities, specified actions, or risk-control measures and must state that the recipient has review rights (s 12(1)-(3)). Non-compliance with a direction without reasonable excuse is an offence with maximum pecuniary and imprisonment penalties: up to $100,000 or 1 year imprisonment for natural persons, and $250,000 for bodies corporate (s 12(3)).

Evidentiary facilitators

• Presumptions and certified documents. The Act eases prosecution evidence-gathering via s 29: allegations that a person is (or was) disqualified or that a specified person is (or was) an authorised officer are accepted as proved absent proof to the contrary. Documents certified by the Commissioner as a notice issued under the Act will be accepted as such absent proof to the contrary (s 29(1)-(2)). Courts and tribunals are directed to maintain confidentiality of police-classified criminal intelligence and may receive senior police evidence by affidavit (s 5(3)).

Director liability

• Directors of bodies corporate are placed at risk by s 27: if a body corporate commits an offence under the Act, each director is guilty and liable to the same penalty unless they prove they could not by due diligence have prevented the offence. The regulations may also make further provision about director criminal liability (s 27(1)-(2)).

Administrative remedies and review

• Review is available to aggrieved persons via the South Australian Civil and Administrative Tribunal under s 17. The Tribunal can review Commissioner and authorised-officer decisions and directions. Time limits apply (28 days), although the review period runs from receipt of written reasons if reasons are requested and supplied later (s 17).

Taken together, enforcement under the Act is multi-modal: criminal prosecutions with substantial penalties, administrative sanctions and directions backed by criminal penalties for non-compliance, strong investigatory powers for authorised officers and police, low-threshold evidentiary presumptions for prosecutions, and director-level exposure. The regulations power allows the executive to supplement enforcement with fees, codes and additional offences, shaping day-to-day compliance and enforcement practices.

The Act expressly cross-references and draws content, actors and authority from other South Australian statutes and creates dependencies on delegated instruments. The principal areas of interaction are with other criminal-organisational provisions, policing legislation, the Fair Trading Act 1987 and the South Australian Civil and Administrative Tribunal Act 2013, among others.

Statutory cross-references and definitional dependences

• Prescribed organisations (s 3). The definition pulls in declared organisations under the Serious and Organised Crime (Control) Act 2008 and criminal organisations under Divisions 1 and 2 of Part 3B of the Criminal Law Consolidation Act 1935. Those other Acts therefore supply substantive criteria and lists that determine who is automatically disqualified under s 7. The regulations may add further organisations by reference (s 3).
• Commissioner for Consumer Affairs and Fair Trading Act 1987 (s 3, s 6). The Commissioner for Consumer Affairs is the Commissioner under the Fair Trading Act 1987; authorised officers under s 76 of the Fair Trading Act 1987 are also authorised officers here (s 18(1)(c)). That creates operational overlap: Fair Trading powers and personnel flow into tattooing enforcement. Forms, authorisations and interaction with Fair Trading inspectors should be expected.
• Criminal intelligence and police powers (s 5, s 25). The Commissioner of Police classifies "criminal intelligence" and controls its disclosure; the Commissioner of Police may disclose any information relevant to enforcement of this Act to the Commissioner for Consumer Affairs (s 5, s 25). Where criminal intelligence is used in disqualification decisions, the Act allows restricted disclosure and special in-camera procedures in judicial or Tribunal proceedings, and evidence by affidavit from senior police officers (s 5(1)-(3)). This creates an interface between administrative decision-making and police intelligence frameworks.
• Controlled Substances Act 1984 (s 20). Police may carry out general drug detection under that Act in relation to premises reasonably suspected of being used for tattooing services. The Controlled Substances Act's procedural and evidentiary rules will therefore apply when police act under s 20.
• Firearms Act 1977 and Explosives Act 1936 / Explosives Act 2024 (s 21, legislative history). Section 21 defines "prescribed item" to include firearms and explosives within the meaning of the Firearms Act 1977 and the Explosives Act 1936; the legislative history records an Explosives Act 2024 amendment with uncommenced schedule items that may interact with s 21 if proclaimed. Police powers under s 22 expressly preserve and do not limit powers under the Firearms Act, the Explosives Act, the Summary Offences Act 1953 and other laws (s 22(5)).
• Summary Offences Act 1953 (s 21). "Dangerous article, offensive weapon or prohibited weapon" are terms with statutory meaning in Part 3A of the Summary Offences Act 1953 and are imported into the definition of "prescribed item" for s 21(3).
• South Australian Civil and Administrative Tribunal Act 2013 (s 3, s 17). The Act defines "Tribunal" as the SACAT established under that Act and routes review rights to it under s 17; the 2019 Statutes Amendment (SACAT) Act amended the review provision to move rights of appeal from the District Court to SACAT (legislative history and s 17 amendments).
• Corporations Act 2001 (Cth) (s 3, s 28). The Act imports the corporate law concept of related bodies corporate and service rules for companies, including service under the Corporations Act (s 3(3)(d), s 28(2)).

Delegation, regulation and incorporation by reference

• Regulations can incorporate codes and standards by reference (s 30(2)(d)), require compliance with specified codes of conduct, fix fees, create periodic returns and expand definitions (s 30(2)(a)-(e)). This permits regulatory instruments to bring in external standards and obligations, and to create new lower-tier offences and expiation schemes (s 30(2)(f)-(g)). The Act therefore anticipates significant delegated regulation that will sit alongside, and interlock with, other statutory regimes.

Conflict and primacy considerations

• The Act contains no express override clause displacing other Acts, but it ties into other regimes via definitions and cross-reference. For example, disqualification under other jurisdictional laws (Commonwealth or other States and Territories) is an automatic disqualification under s 7(2)(c)-(3)(a)(ii). That means foreign or out-of-State disqualifications can have direct domestic effect in South Australia.
• Enforcement overlap and joint action. Police powers under this Act are framed as additional to powers in other Acts; s 22(5) expressly states nothing in s 22 limits powers under the Firearms Act, Explosives Act, Summary Offences Act or other laws. Where police act under multiple statutes, practical coordination and evidence-handling rules from those statutes will apply.

Administrative interaction and consultation

• Ministerial exemptions (s 23) must be granted after consultation with the Commissioner for Consumer Affairs and the Commissioner of Police. This creates an administrative mechanism requiring consultation across responsible agencies. Exemptions, conditions, variations and revocations are Gazette notices, which can create sector-specific carve-outs or transitional arrangements.

Evidentiary and procedural crossover

• Where criminal intelligence is used and a court or Tribunal is seized, the Act gives the court power to receive evidence in private or via police affidavit (s 5(3)). This imports procedural techniques otherwise used in national security or serious organised crime contexts into administrative decisions about business participation.

In summary, the Tattooing Industry Control Act is designed to operate in an environment of pre-existing policing, firearms and explosives regimes, corporate law, and administrative-review architecture. It borrows definitions and enforcement mechanisms from those statutes and gives regulatory instruments latitude to import external standards, making implementation an inter-legislative exercise. Practitioners must therefore consider the Act alongside the Fair Trading Act 1987, policing statutes, firearms and explosives laws, the Corporations Act and SACAT procedures when advising clients or designing compliance systems.

The Act’s legislative history and the schedule at the end of the text record a compact amendment record and points of possible future interaction.

Commencement and principal Act

• The Tattooing Industry Control Act 2015 (No 44 of 2015) received assent on 10 December 2015 and commenced on 1 July 2016 (Gazette 2.6.2016 p2000). That is the principal Act and the base text for subsequent amendments.

Notable subsequent amendments

• Statutes Amendment (SACAT) Act 2019 (No 14 of 2019). Assented 11 July 2019, with significant provisions commencing 2 December 2019 (Gazette 21.11.2019 p3928). The 2019 Act amended provisions across the Tattooing Industry Control Act to transition review rights and references from the Administrative and Disciplinary Division of the District Court to the South Australian Civil and Administrative Tribunal (SACAT). Specific amendments recorded in the legislative history table include:
  • Inserting "Tribunal" definition (s 3) and related edits (commenced 2.12.2019).
  • Amendments to s 5(1) and s 5(3) (s 176(1)-(2) of the 2019 Act) which affect handling of criminal intelligence and confidentiality procedures (commenced 2.12.2019).
  • Substitution of s 17(1)-(3) to route reviews to the Tribunal and set the 28-day time-limit mechanics (s 180(1)-(2)) (commenced 2.12.2019).
  • Amendments to s 8(5) and s 12(2) to reflect administrative and procedural updates (s 177, s 178) (commenced 2.12.2019).
  • Pt 5 heading substituted (s 179) (commenced 2.12.2019).
  • Transitional provisions (Statutes Amendment (SACAT) Act 2019 Pt 29) preserved existing rights of appeal exercised before the relevant day, and preserved proceedings already before the District Court (see legislative history, Pt 29, s 181).
• Explosives Act 2024 (No 38 of 2024). Assented 19 September 2024. The legislative history shows amendments linked to the Explosives Act 2024, with Schedule 1 clauses 1 & 2 uncommenced at the time of the text. Those uncommenced provisions may affect definitions or cross-references related to explosives in s 21 should they commence.

Other technical amendments and Legislation Revision

• Omission of s 2 under the Legislation Revision and Publication Act 2002 (commenced 2.12.2019) and removal of Schedule 1 are recorded in the notes. These are technical revisions and do not appear to alter substantive enforcement or regulatory design.
• The legislative history table lists each provision varied and the instrument effecting the variation. For example, s 8(5) was amended by the 2019 SACAT Act (s 177) and s 12(2) was amended by the same instrument (s 178), both commencing 2.12.2019. The notes record that new entries appear in bold and deletions appear in italics, and that uncommenced amendments are not incorporated into the text.

Transitional provisions associated with the 2019 amendments

• Part 29 of the Statutes Amendment (SACAT) Act 2019 included transitional provisions (s 181). They specify that a right of appeal under s 17 existing before the relevant day, but not exercised, will be exercised as if the SACAT-based Part had been in operation when the right arose, thereby preserving the procedural route to review in SACAT for pending appeals and moving away from the District Court’s Administrative and Disciplinary Division. The transitional provisions also preserve proceedings before the District Court that commenced before the relevant day.

Implications of amendment history

• The core structural changes effected by the 2019 Act moved review jurisdiction to SACAT and adjusted confidentiality procedures for criminal intelligence. The legislative history shows continuity of the Act’s enforcement aims while shifting procedural review forums. The 2024 Explosives Act changes remain uncommenced and therefore do not yet alter s 21’s current scope, but practitioners should monitor proclamation of those schedule items.

Record-keeping note

• The Act’s legislative history page includes the usual legislative housekeeping notes: uncommenced amendments are not incorporated into the text and further information on subordinate legislation is available via South Australian legislation indexes. For compliance planning, the episodic nature of amendments (notably 2019 SACAT realignment) suggests the statutory framework can be updated by general statutes and by delegated regulations, both of which materially change administrative procedure and operational detail.

The Act’s text, as provided, does not identify any decided cases or specific litigation arising under it. The legislative history sets out changes to review processes (principally the 2019 transfer of review jurisdiction to SACAT) and transitional provisions but does not report judicial interpretations or reported litigation.

From the statute alone the following procedural points are relevant for litigation practitioners preparing for challenge or defence work:

• Tribunal review and time limits. Appeals from Commissioner decisions and authorised-officer directions go to the South Australian Civil and Administrative Tribunal (s 17) with an initial 28-day time limit for applications. The Act provides that if written reasons are requested and supplied later, the 28-day period runs from the date the applicant receives the reasons (s 17(2)-(3)). Practitioners should be attentive to the timing rules and to the interaction between s 5 confidentiality procedures and review timelines: s 5 restricts disclosure of criminal intelligence and allows courts and tribunals to take steps to maintain confidentiality, including in-camera hearings and receipt of police affidavits (s 5(3)).
• Evidentiary presumptions. Section 29 shifts evidentiary burdens in prosecutions by treating allegations about disqualification status and authorised-officer status as proved absent proof to the contrary, and by making certified documents prima facie authentic in the absence of contrary proof (s 29). Litigation strategies must account for this evidentiary facilitation in prosecution cases.
• Confidential evidence and criminal intelligence. s 5 authorises special procedural steps where evidence comprises Commissioner-of-Police-classified criminal intelligence, potentially restricting public disclosure and ordinary cross-examination rights by enabling affidavit evidence from senior police or private hearings. This device is likely to be pivotal in litigation that hinges on disqualification decisions based on intelligence.
• Director liability. Section 27 creates potential personal criminal exposure for directors of offending corporations unless due diligence is proven. Litigation may therefore extend to cross-examination on corporate governance and director conduct.

Because the Act itself provides review routes and procedural devices for handling classified police intelligence, litigation arising under the Act would likely involve administrative law principles, evidence rules adapted for confidential material, and criminal procedure where prosecutions arise. However, absent statutes naming cases or decisions, this section records only procedural and evidentiary settings that would frame any litigation rather than a catalogue of decided matters.

Practitioners should search South Australian reporting services, SACAT decisions, and criminal and administrative law databases for any decisions since the Act’s commencement for a current litigation map. The Act’s legislative history indicates the procedural frame for review has changed (2019), so earlier challenges may have been in a different forum.

The Act contains several features that create practical compliance traps or operational uncertainties. These "gotchas" are mechanistic: they describe how the Act’s text creates obligations, burdens or enforcement leverage that may be non-obvious. Each is grounded in a statutory provision.

• Broad provider definition and supply liability (s 4). The Act treats suppliers of "prescribed tattooing equipment" as providers of tattooing services. That means parties that supply machines, needles, inks, or anything later prescribed in regulation can be subject to the notice, record-keeping and disqualification rules. The only explicit exception is delivery by Australia Post, couriers or similar carriage services (s 4(2)); distributors, retailers, online suppliers and platform intermediaries may be captured unless the regulations say otherwise.
• Close-associate disqualifications reach familial, household and corporate connections (s 3(3); s 7). The close-associate test includes people in household relationships, partners, related bodies corporate, those with profit participation rights, and those who can exercise control or significant influence (s 3(3)(a)-(f)). This makes it possible for a person to be automatically disqualified because of relationship or indirect commercial links, without any individual wrongdoing. The effects can be permanent and retrospective (s 7(4)).
• Criminal-intelligence-based secrecy limits reasons and complicates review (s 5). If the Commissioner of Police classifies information as criminal intelligence and that classification is used by the Commissioner for Consumer Affairs to disqualify or refuse to revoke a disqualification, the Commissioner for Consumer Affairs is not required to provide reasons other than stating that it would be contrary to the public interest for the person to provide tattooing services (s 5(2)). Courts and tribunals must maintain confidentiality and may receive evidence by affidavit from senior police (s 5(3)). This limits transparency and may complicate an applicant’s ability to challenge a disqualification on factual grounds.
• Disqualification notices can be indefinite and may be applied retrospectively (s 8(2), s 7(4)). A disqualification notice may last indefinitely unless the Commissioner specifies otherwise or the notice is revoked (s 8(2)). Additionally, disqualification applies whether relevant events occurred before or after the commencement of the section or before or after the person commenced providing tattooing services (s 7(4)). This produces potential permanence and retroactivity of effect within the statutory design.
• Personal service requirement for disqualification notices; police detentions to effect service (s 9). Disqualification notices must be personally served to be binding, and police may detain a person without warrant for up to 2 hours or for as long as necessary to effect service (s 9(1)-(2)). If personal service cannot be effected after reasonable efforts, a court may order substituted service and make the notice binding (s 9(3)). The interplay of service mechanics and detention powers can create operational and human-rights sensitivities in practice.
• Authorised officer use of force to enter non-consenting premises (s 19(1)(a)). Authorised officers may use reasonable force to enter premises they suspect are used for tattooing if entry is refused, subject to residential premises protections (s 19(2)). Businesses should expect unannounced inspections and be prepared to verify authorised-officer identity and authority (s 18(3)-(5)).
• Regulations and delegated discretion are wide-ranging (s 30). The regulations may prescribe equipment, codes, periodic returns, fees, penalties up to $10,000, expiation fees up to $1,000, and may incorporate external codes and standards by reference (s 30(2)(b)-(d), (f)-(g)). Much of the day-to-day compliance detail can therefore be made by regulation, so regulated parties must watch subordinate instruments closely.
• Evidentiary presumptions reduce prosecution thresholds (s 29). The Act provides that allegations about disqualification status and authorised-officer status will be accepted as proved in the absence of proof to the contrary, and certified documents by the Commissioner will be accepted in the absence of contrary proof (s 29). Defence preparation must therefore anticipate prosecutorial reliance on these presumptions and be ready with documentary or factual evidence to rebut them.
• Director liability unless due diligence proved (s 27). If a corporate commits an offence under the Act, each director is guilty unless they can prove they could not have prevented the offence by due diligence. That places an onus on directors to maintain governance, oversight and compliance systems to rebut liability.
• Expansion of "prescribed item" and equipment definitions by regulation (s 21(3), s 4(3)). The Act identifies firearms, explosives and weapons but expressly allows regulations to add items. That means the scope of s 21 offending and the set of items treated as tattooing equipment may change without primary-legislative amendments. Businesses should monitor regulations for expanded lists that may change criminal exposure or compliance burdens.
• Interaction with police powers and other Acts (s 20, s 22, s 22(5)). Police may deploy drug detection and weapons/explosives-search powers. Section 22 expressly preserves other statutory powers (Firearms Act, Explosives Act, Summary Offences Act), meaning enforcement could draw on multiple statutory authorities concurrently.
• Ministerial exemptions are discretionary and conditional (s 23). While the Minister may grant exemptions, the power is broad and to be exercised "on any grounds he or she thinks fit" but after consultation with the Commissioner for Consumer Affairs and Commissioner of Police (s 23(1), s 23(4)). Exemptions may be varied or revoked at any time, and may carry conditions.

These features create legal uncertainty in some cases (notably confidentiality around criminal intelligence and indefinite disqualification), administrative burdens (notifications, records, staff notifications), and potential criminal exposure for general business and corporate directors in ways that non-specialist operators may not expect. The Act creates a high-compliance regime where delegated regulation and police intelligence play decisive roles.

Compliance under the Act requires a structured approach combining pre-entry checks, administrative notifications, record-keeping, personnel vetting, premises readiness, and procedures for authorised-officer interactions and Tribunal review. The steps below are grounded in the Act’s provisions and highlight the minimum practical measures an operator or adviser should implement.

1. Establish entity and personnel due-diligence procedures

   • Check whether any owner, director, proposed employee, or close associate falls within automatic disqualification categories (s 7(2)-(3)). The "prescribed organisation" definition references declared organisations under the Serious and Organised Crime (Control) Act 2008 and criminal organisations under the Criminal Law Consolidation Act 1935 (s 3). Document checks on organisational membership, criminal convictions prescribed by regulation, and close-associate status (s 3(3)) prior to engagement.
   • For directors, maintain board-level records evidencing due diligence and oversight to guard against s 27 exposure. If a corporate commits an offence, directors must be able to show they could not by due diligence have prevented it (s 27).

2. Notify the Commissioner as required

   • If proposing to commence a tattooing business, lodge written notice in the Commissioner-determined form at least 90 days before starting (s 13(1), s 13(3)(b)(i)). If already operating when the section commenced, provide notice within 28 days (s 13(2)(a), s 13(3)(b)(ii)). If starting after commencement, notify within 28 days of commencing (s 13(2)(b), s 13(3)(b)(iii)).
   • Ensure notices include the particulars required by s 13(3)(c): for companies the body corporate name, trading names, registered address and each director’s full name, residential address and date of birth; for natural persons their full name, residential address and date of birth; and the address of premises and full details of other employees providing tattooing services.
   • Implement processes to give the Commissioner written notice within 14 days of any change to required information (s 13(4)).

3. Employee notification and vetting

   • Require new employees who will provide tattooing services to notify the Commissioner within 28 days of commencing, and obtain from employees any information the regulations require (s 14(1)-(2)). Consider integrating this with your onboarding checklist.
   • Retain records of the employee notifications and any statutory declarations if the Commissioner later requires verification (s 26).

4. Record-keeping policies

   • Keep records as required by the regulations and by any Commissioner determinations (s 16(1)). Ensure retention for at least two years (s 16(2)). Establish secure storage, retrieval and copying procedures so authorised officers can inspect, copy or be provided with extracts (s 19(1)(c)-(e)).
   • Be mindful of false or misleading information prohibitions: statements in notices or records that are false or misleading in a material particular are offence conduct (s 24).

5. Premises compliance and risk control

   • Prepare premises to meet likely authorised-officer directions designed to avert or minimise public-safety risks (s 12). Directions may require discontinuance of activities, physical changes to premises, or specified operational controls (s 12(2)(f)(i)-(iii)).
   • Prohibit possession or storage of firearms, explosives or other prescribed items on premises used for tattooing (s 21). If any such item is present, ensure documentary proof that staff or visitors could not reasonably have known the premises were used for tattooing to rely on the statutory defence if needed (s 21(2)).
   • Recognise that authorised officers and police may enter and inspect premises; have processes to verify identity cards (s 18(3)-(5)) and to handle lawful searches and seizures under s 19.

6. Responding to authorised officers and police

   • Train staff on the legislative powers: authorised officers may enter, inspect, copy, seize and remove material; police have further drug-detection and weapons/explosives search powers (s 19-22). Require staff to request production of identity cards from authorised officers other than uniformed police (s 18(5)).
   • Adopt protocols for cooperating with lawful directions and notices to provide information (s 12, s 15). Non-compliance without reasonable excuse attracts severe penalties (s 12(3), s 15(3)).

7. Prepare for potential disqualification events and service mechanics

   • If you receive or suspect a disqualification notice, note that a disqualification is only binding after personal service except where substituted service is ordered (s 9(1), s 9(3)). Police may detain a person for up to 2 hours to effect service (s 9(2)).
   • If disqualified, seek early legal advice about review options to the Tribunal under s 17. The Commissioner must state reasons in writing if requested and provided later, the review period runs from receipt of those reasons (s 17(3)).

8. Manage information requests and statutory declarations

   • Implement procedures to respond promptly to information notices under s 15. The Commissioner determines the manner, form and period for responses (s 15(2)). A failure to comply is a serious offence (s 15(3)).
   • Be prepared to verify information by statutory declaration if required under s 26.

9. Monitor delegated instruments and exemptions

   • Regularly review regulations, Gazette notices and codes of practice that may prescribe equipment, expand definitions, set fees, enforce codes of conduct, or create further offences (s 30). Because the regulations may incorporate external standards by reference (s 30(2)(d)), capture of standards can occur without amending the principal Act.
   • If a legitimate business function is encumbered by the Act, consider applying for a Ministerial exemption under s 23, recognising that exemptions are conditional and the Minister must consult with the Commissioner for Consumer Affairs and Commissioner of Police (s 23(4)).

10. Governance and documentation for directors and owners

• Directors should document governance controls, compliance audits and supervision of staff to prepare a contemporaneous record demonstrating due diligence (s 27). Regular internal audits of notification compliance, record-keeping, and personnel vetting will help rebut director liability in the event of corporate offences.
• Keep copies of all notices, communications with the Commissioner, forms provided to employees and any statutory declarations.

11. Dispute and review management

• If facing a direction or disqualification, note the right to Tribunal review under s 17 and the procedural detail for reasons and timing. Where criminal intelligence is implicated, be prepared for in-camera hearings or affidavit evidence and plan strategies accordingly (s 5).
• Preserve documentary evidence to rebut s 29 presumptions (proof that a person was not disqualified, or that an authorised officer does not meet s 18 criteria).

By mapping statutory obligations to internal controls, operators and advisers can reduce the risk of criminal or administrative sanctions. The Act places emphasis on pre-commencement transparency, ongoing reporting and record-keeping, and on police-classified intelligence in disqualification decisions; practical compliance therefore requires both procedural systems and sensible personnel vetting and governance documentation tied to the explicit sections cited above.
