What it does
This Act dissolves the Tasmanian Early Years Foundation (the Foundation) and effects a statutory vesting of its assets and liabilities in the Crown on the day the Act commences by proclamation (s1, s2, s4, s5(1)). Mechanically, on commencement day the Foundation ceases to exist (s4) and its assets “vest in the Crown” while its liabilities “become the liabilities of the Crown” (s5(1)(a)-(b)). The Act treats instruments and transactions done to give effect to that vesting as not subject to State tax (s5(2)). It also provides a broader tax exemption: instruments to which the Crown is party by virtue of the Act, and the Crown itself, are not liable to any State tax in so far as the Crown would, but for the Act, be liable in relation to a matter to which the Act relates (s8). Documents that mention the Tasmanian Early Years Foundation and relate to its assets or liabilities are to be read, unless the context otherwise requires, as referring to the Crown after commencement day (s6(1)-(2)). Existing legal or other proceedings brought by or against the Foundation may be continued by or against the Crown; proceedings that could have been brought to enforce pre-commencement obligations or accrued rights may be instituted by or against the Crown; pre-commencement judgments or orders not satisfied may be enforced by or against the Crown; and documents served on or by the Foundation are taken, where appropriate, to have been served on or by the Crown (s7(a)-(d)). Reporting obligations require the Department’s financial and State Service annual reports for the financial year in which the Act commences to include the relevant Foundation information under the Financial Management and Audit Act 1990 and the State Service Act 2000 (s9). Administration of the Act is temporarily assigned to the Premier and the Department of Premier and Cabinet until an Administrative Arrangements order provides otherwise (s10). The Act repeals the Tasmanian Early Years Foundation Act 2005 via Schedule 1 and s11.
