### 45 Requirement for secrecy > > (1)  *\[Section 45 Subsection (1) amended by No. 76 of 1995, s. 28 and Sched. 1 \]*A director, administrator, or officer of TDR who, in the course of the administration of this Act, obtains any information as to a process, technique, practice, plan, invention, specification, prototype, or design shall maintain and aid in maintaining the secrecy of that information except for the purposes of the administration of this Act. > > > (2)  *\[Section 45 Subsection (2) amended by No. 36 of 1988, s. 7 and Sched. 1 \]**\[Section 45 Subsection (2) amended by No. 76 of 1995, s. 28 and Sched. 1 \]*A director, administrator, or officer of TDR who contravenes [subsection (1)](#GS45@Gs1@EN) is guilty of an offence and is liable on summary conviction to a penalty not exceeding 10 penalty units or imprisonment for a period not exceeding 3 months, or both.
