What it does
This proclamation, made under section 52A of the Roads and Jetties Act 1935, alters the statutory designation of part of the Bass Highway and the status of specified access points that were previously set out in a 1980 proclamation recorded as Statutory Rules 1980, No. 156. The instrument performs four discrete mechanical tasks.
First, paragraph (a) "declare[s] that the area of the Bass Highway specified in item 2 of Schedule 1 to the proclamation notified in the Gazette as Statutory Rules 1980, No. 156 ceases to be a limited access road." In short, the instrument rescinds the limited access road status previously applied to the item 2 portion of that earlier proclamation.
Second, paragraph (b) "declare[s] that the places of access specified in item 2 of Schedule 2 to the proclamation notified in the Gazette as Statutory Rules 1980, No. 156 cease to be places of access." The proclamation therefore removes the prior "place of access" designations that were attached to item 2 of Schedule 2 in the 1980 instrument.
Third, paragraph (c) amends the 1980 proclamation by omitting item 2 from Schedule 1 and substituting a new item 2, and by omitting item 2 from Schedule 2 and substituting a lengthy new item 2. The new Schedule 1 item 2 redefines the relevant limited access road segment, stating the segment as "Westbury to Penguin | 85.00" and describing it as "That part of the Bass Highway from the centre of the Beresford Lane overpass near Westbury to the centre of the Ironcliffe Road overpass at Penguin." The new Schedule 2 item 2 lists, in measured kilometres and with side-of-road qualifiers (for example "south side", "north-east side", "both sides"), a series of named connecting roads, ramps and access roads along the defined Westbury-Penguin stretch of the Bass Highway, with distances measured either "in kms west from Porters Bridge Road overpass" or from other anchor points such as "Distance in kms west from Mole Creek Interchange underpass", "Distance in kms north from Railton Road" and so on.
