What it does
This instrument is a Tariff Concession Revocation Order made under section 269SD(2) of the Customs Act 1901. It performs two consecutive legal acts that take effect from 1 January 2007. First, it revokes a prior Tariff Concession Order (TCO) numbered 0606714, which was made on 30 June 2006 and had its last date of effect as 31 December 2006. Second, it makes in place of that revoked order a new TCO numbered 0614745, which covers an identical range of goods but under a different tariff classification. The goods are described as “PARTS, PICKLE LINE TANK” and are listed exhaustively across two pages of the instrument through a series of itemised components from (a) to (au). The earlier order classified the goods under Customs Tariff subheading 8419.90.90, while the replacement order classifies them under 8419.90.00. Both orders invoke Schedule 4 Item Number 50 under Part III of the Customs Tariff Act 1995, meaning the goods are entitled to the concessional tariff treatment set out in that item. The effect of the revocation is that the old TCO ceases to apply from 1 January 2007, and the new TCO applies to the same goods from that same date. The instrument is signed by Robert Crawford, described as a delegate of the Chief Executive Officer of the agency then responsible for customs administration, and is dated 20 June 2007. Because the revocation and replacement both operate from 1 January 2007, the instrument has retrospective effect for the period between that date and the date of signing, which has practical consequences for importers who entered goods under the earlier TCO during that window.
