What it does
This instrument, titled Tariff Concession Revocation Order HS2007/654A, revokes an earlier Tariff Concession Order and replaces it with a new Tariff Concession Order for a specified class of goods. The textual mechanics in the instrument are:
- It records the exercise of power under Section 269SD(2) of the Customs Act 1901: the delegate of the Chief Executive Officer, Robert Crawford, “revoke[s] Tariff Concession Order Number 9706418 made on 16.10.97” with respect to the goods described in TABLE A and “make[s] in its place the Tariff Concession Orders described in TABLE B” (instrument opening paragraph, quoting s 269SD(2)).
- The revocation is given effect from 01.01.07 (the instrument states the revocation “has effect from 01.01.07”), and the replacement Order in TABLE B is declared to have effect from that same date (the Order “shall have effect from the date notified in paragraph (a) above as the date of effect for the Revocation”).
- TABLE A reproduces the goods description that had been covered by TCO 9706418 (operative from Op. 11.07.97). TABLE B reproduces a new TCO (TC 0614651) with substantially the same descriptive scope but a different tariff classification and Schedule 4 item entry. The instrument is identified as Revocation Instrument HS2007/654A and signed/dated by the delegate on 20 June 2007.
Functionally, the instrument removes the old administrative concession instrument (TCO 9706418) and institutes a new concession instrument (TC 0614651) applying to the goods listed in the tables, effective 1 January 2007. The instrument expressly links the goods listed in TABLE B to the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in TABLE B Column 2, so the new Order determines that those goods “are goods to which the item in Part III of Schedule 4 … specified in Column 2 of TABLE B applies.” The operative change therefore is administrative: revocation of one tariff concession order and creation of another, with a stated effective date that is earlier than the instrument’s signature date.
