What it does
This instrument is a Tariff Concession Revocation Order made under section 269SD(2) of the Customs Act 1901. It performs two mechanical actions. First, it revokes Tariff Concession Order Number 0001832, which was originally made on 23 May 2000, in respect of the goods described in Table A of the instrument. The instrument states, in express terms, "This Revocation has effect from 01.01.07" (text at head of instrument). Second, it replaces the revoked order by making the Tariff Concession Orders described in Table B of the instrument. The instrument declares that the goods specified in Column 1 of Table B "are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies." The instrument further states that "The Order shall have effect from the date notified in paragraph (a) above as the date of effect for the Revocation."
Concretely, the instrument changes the tariff classification applied to a narrowly-described set of construction toy/model sets made of ABS and/or HVPC plastic, and it changes the Schedule 4 item number that applies to those goods. Table A records the former classification as 9503.30.90 and lists the Schedule 4 item number and last date of effect as "5031.12.06" alongside the original Tariff Concession Order citation "Op. 18.02.00 - TC 0001832." Table B records the replacement classification as 9503.00.70 with the same descriptive wording of the goods, an operation date "Op. 01.01.07 - TC 0614614" and a Schedule 4 item number of "50." The instrument is dated 20 June 2007 and signed by Robert Crawford as a delegate of the Chief Executive Officer.
The statutory basis for the revocation is expressly s 269SD(2) of the Customs Act 1901, which is cited in the instrument. The substantive legal effect therefore is administrative: the previously-issued Tariff Concession Order is withdrawn from the stated effective date and replaced by a newly-made Tariff Concession Order recorded in Table B, with corresponding changes to tariff classification and Schedule 4 item application.
