What it does
This instrument, titled Tariff Concession Revocation Order HS2007/598A, revokes an earlier Tariff Concession Order and replaces it with a new Tariff Concession Order for a narrowly defined class of dolls. The instrument is made under the authority expressly stated in the instrument, namely "Under Section 269SD(2) of the Customs Act 1901" (opening line). The operative mechanics are:
- It revokes Tariff Concession Order Number 9709120, which was made on 05.11.97, in respect of the goods described in TABLE A of the instrument. The revocation takes effect from 01.01.07 (paragraph (a) of the instrument).
- It makes, in place of the revoked order, the Tariff Concession Order described in TABLE B. The instrument states that "The goods specified in Column 1 of TABLE B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies." The instrument directs that the Order shall have effect from the date notified in paragraph (a) as the date of effect for the revocation, i.e. 01.01.07.
- The instrument is identified as Revocation Instrument HS2007/598A and is dated 20 June 2007, signed by Robert Crawford as a delegate of the Chief Executive Officer (signature block on both pages).
Mechanically, therefore, from 1 January 2007 the earlier concession captured by TCO 9709120 is removed and a new TCO (TC 0614596) with the goods listed in TABLE B is declared to be subject to the relevant Schedule 4 item shown in TABLE B. The instrument contains two table entries that describe the same detailed product specification but assign different Customs Tariff classification numbers: TABLE A lists the goods under tariff classification "9502.10.00" (the revoked order), while TABLE B lists the goods under classification "9503.00.20" (the replacement order). Each table repeats the same descriptive criteria for the goods. TABLE A also shows an "Op." line with "Op. 25.09.96 - TC 9709120"; TABLE B shows "Op. 01.01.07 - TC 0614596". The instrument does not itself state tariff rates, exemptions, or the substantive content of Part III of Schedule 4; it records that the listed goods are to which the item in Part III of Schedule 4 specified in Column 2 applies.
