What it does
This instrument, titled Tariff Concession Revocation Order HS2007/581A, is an administrative revocation and re‑issue of tariff concession orders under the authority of s 269SD(2) of the Customs Act 1901. The operative actions recorded in the instrument are twofold and are set out in the opening paragraph. First, the delegate of the Chief Executive Officer, Robert Crawford, revokes Tariff Concession Order Number 0312679, which was originally made on 02.01.04, in respect of the goods listed in TABLE A. The revocation is stated to have effect from 01.01.07. Second, the instrument makes in its place new Tariff Concession Orders described in TABLE B. The instrument expressly states that the goods specified in Column 1 of TABLE B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies. The Order is dated 20 June 2007 and is signed by Robert Crawford as a delegate of the Chief Executive Officer.
Mechanically, the instrument revokes one existing TCO (TC 0312679) that applied to items described in TABLE A and replaces it with multiple new TCOs (identified by TC numbers found in TABLE B: TC 0614576, TC 0614577, TC 0614578, TC 0614579 and TC 0614580). TABLE B lists tariff classifications at the 8708 series (8708.99.99, 8708.40.59, 8708.50.59, 8708.80.99 and 8708.91.49) with identical or substantially similar product descriptions: parts for off‑highway rear dump trucks with gross vehicle weight greater than 3.5 tonnes and not being body parts, enumerating a defined list of components (arms, covers, dampers, deflectors, differentials, discs, gears, guides, heat shields, housings, hubs, levers, links, manifolds, mounts, pinions (differential), pipes, radiator tanks, radiator cores, radiator after coolers, radiator net mesh covers, radiator shrouds or condensers, reservoirs, shafts, air tanks, hydraulic tanks, fuel tanks, water tanks, universal joints). Each of the TABLE B entries bears an operative notation "Op. 01.01.07" and is cross referenced to the respective TC number.
