What it does
This instrument is a Tariff Concession Revocation Order made under section 269SD(2) of the Customs Act 1901. It does two things. First, it revokes Tariff Concession Order number 0101515, which had applied to certain truck and bus steering box parts since 27 April 2001. Second, it makes a new Tariff Concession Order (number 0614568) in its place, covering goods described in identical terms. The revocation and the new order both take effect from 1 January 2007, even though the instrument was signed on 20 June 2007. That means the change operates retrospectively by nearly six months.
The goods covered are parts for truck or bus steering boxes with a front axle rating of 1818 kg or greater. The description is exhaustive: it lists specific components (cylinder heads, piston rings, output shafts, covers, housings, gears, selector shafts, pitman arms) and a set of defined kits comprising combinations of those components. The old Order classified the goods under tariff heading 8708.99.99; the new Order classifies them under heading 8708.94.59. In both cases the goods are eligible under Schedule 4 item 50 of the Customs Tariff Act 1995. Item 50 provides for free rate of duty (i.e., a tariff concession) for goods that meet the description and that are not produced in Australia in the ordinary course of business.
The net effect is that the substantive concession (free duty) remains unchanged for the same goods. What changes is the tariff classification code under which the concession is claimed. That reclassification may affect statistical reporting, administration, and potentially the application of other tariff measures that depend on the classification code (such as anti dumping duties, rules of origin, or other concessional items). Because the revocation and new order are backdated, importers who paid duty at the general rate on these goods between 1 January 2007 and the date of the instrument might be entitled to claim a refund, but only if they can demonstrate that the goods met the description and were classified under the new heading.
