What it does
This instrument (Tariff Concession Revocation Order HS2007/550A) revokes an existing Tariff Concession Order (TCO) and substitutes a new TCO for the same described goods. The revocation is made under s 269SD(2) of the Customs Act 1901 (as recorded in the instrument) and is executed by a delegate of the Chief Executive Officer named Robert Crawford (Dated 20 June 2007). The instrument records two discrete actions in its opening paragraph: (a) revocation of Tariff Concession Order Number 9612594 "made on 28.02.97" in respect of the goods described in Table A, with effect from 01.01.07; and (b) the making in its place of the Tariff Concession Orders described in Table B. The instrument further states that the goods specified in Column 1 of Table B are goods to which "the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of Table B applies", and that the Order takes effect from the date notified in paragraph (a) above as the date of effect for the revocation.
Mechanically, the instrument therefore removes an earlier concession entry (Table A/TCO 9612594) and inserts a new concession entry (Table B/TCO TC 0614533) with an operative date of 01.01.07. The Tables reproduce the technical description of the goods (gearboxes, automatic or manual, with specific numeric ranges for weight, torque, RPM and gear counts, and with a qualification that the gearboxes are "imported WITHOUT ANY of the following: (a) transfer gear boxes; (b) other ancillary gear boxes; (c) other ancillary transmission units"). Table A lists the goods under customs classification 8708.40.99; Table B lists materially the same descriptive text but under customs classification 8708.40.49 and with a different Schedule 4 item entry in Column 2. The instrument records operational (Op.) or TC reference annotations adjacent to the entries: Table A records "Op. 26.11.96 - TC 9612594" and a last-date figure shown in the Column 2 field; Table B records "Op. 01.01.07 - TC 0614533" and Column 2 content as "50". The instrument itself does not set tariff rates, penalties, or other regulatory conditions beyond establishing the revocation and replacement of the TCO entries and quoting the statutory head of power used for the action.
