What it does
This instrument, styled "Tariff Concession Revocation Order HS2007/398A - Tariff Concession Order 0614380", effects a targeted administrative change to tariff concession orders for a specified class of goods. It does two things, as stated in the instrument text. First, it revokes an existing Tariff Concession Order (TCO Number 9703699, Op. 01.07.97) covering a specified list of components for an electric arc tilting furnace. The revocation has effect from 01.01.07, the instrument states: "This Revocation has effect from 01.01.07" (opening paragraph). The revocation is made pursuant to section 269SD(2) of the Customs Act 1901 and is executed by a delegate of the Chief Executive Officer, identified by name as Robert Crawford and dated 20 June 2007.
Second, the instrument replaces the revoked TCO by making in its place a new Tariff Concession Order described in TABLE B. The instrument records that "The goods specified in Column 1 of TABLE B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies." The replacement order is itself given an operative date matching the revocation: "The Order shall have effect from the date notified in paragraph (a) above as the date of effect for the Revocation." TABLE B records the new operative details: tariff classification 8514.90.00, the same descriptive list of components, an operation date Op. 01.01.07 and TCO number TC 0614380, and Column 2 showing "50" as the Schedule 4 Item Number.
Mechanically, therefore, the instrument removes the previously-issued TCO (TC 9703699) effective 1 January 2007 and substitutes a new TCO (TC 0614380) covering substantially identical descriptive goods but recorded under a different tariff classification code and a different Schedule 4 item number. The instrument is limited to these administrative actions; it does not itself set tariff rates, specify enforcement penalties, or amend primary legislation. The delegate identifies the affected goods by catalogue-style description (a finite list of component types (a) to (m)), and ties the new entry to Part III of Schedule 4 to the Customs Tariff Act 1995 via the item number recorded in Column 2 of TABLE B.
