What it does
This instrument, titled Tariff Concession Revocation Order HS2007/386A, revokes an earlier Tariff Concession Order and simultaneously creates replacement Tariff Concession Orders for the same goods but under different tariff classifications. The instrument is issued pursuant to section 269SD(2) of the Customs Act 1901, and is signed by Robert Crawford as a delegate of the Chief Executive Officer. The operative mechanics in the text are twofold.
First, the instrument expressly revokes Tariff Concession Order Number 9407637, originally made on 23 February 1995, "in respect of the goods described in TABLE A below" and states that the revocation "has effect from 01.01.07" (the instrument text, paragraph (a)). TABLE A contains the goods description and the tariff classification previously used (8509.10.00). The last date of effect shown in TABLE A is recorded as "5031.12.06" (as printed in the instrument).
Second, the instrument "make[s] in its place the Tariff Concession Orders described in TABLE B" (paragraph (b)). TABLE B re-lists the same product description but under two different tariff classifications: 8508.11.00 and 8508.19.00. Both TABLE B entries share the same descriptive text for the goods, are marked "Op. 01.01.07" and bear the new Tariff Concession Order numbers TC 0614416 and TC 0614417 respectively. The instrument also states that "The goods specified in Column 1 of TABLE B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies." Column 2 in TABLE B contains the numeral "50", indicating the Schedule 4 Item number said to apply to those goods.
The instrument is dated 20 June 2007 and is signed by the delegate. It states that the Order "shall have effect from the date notified in paragraph (a) above as the date of effect for the Revocation", tying the effective date of the newly made TCOs to the revocation date (01.01.07). In short, the text revokes the earlier TCO effective 1 January 2007 and replaces it with two new TCO entries that are said to apply from the same effective date, under Schedule 4 item 50.
