What it does
This instrument, styled Tariff Concession Revocation Order HS2007/361A, revokes one existing Tariff Concession Order and substitutes a new one for the same described goods. The first operative paragraph records that Robert Crawford, a delegate of the Chief Executive Officer, acts under Section 269SD(2) of the Customs Act 1901 to revoke Tariff Concession Order Number 0201840, originally made on 31.05.02. The instrument states the revocation "has effect from 01.01.07" and then records that a replacement Tariff Concession Order is made in its place, in the form set out in TABLE B. The instrument expressly says the replacement Order "shall have effect from the date notified in paragraph (a) above as the date of effect for the Revocation" (the instrument, opening paragraph).
Mechanically, the instrument performs four concrete changes that are recorded in the text. First, it rescinds TCO No. 0201840 by reference to the goods as described in TABLE A (the goods description and prior tariff line are set out in TABLE A). Second, it creates a new Tariff Concession Order described in TABLE B, which lists the same descriptive goods but with different tariff classification particulars. Third, it records an effective date for the revocation and the replacement of 01.01.07. Fourth, it identifies the Schedule 4 item in the Customs Tariff Act 1995 that is to apply to the goods listed in TABLE B, by specifying the item number in Column 2 of TABLE B. The instrument is signed and dated by the delegate, Robert Crawford, on 20 June 2007.
The tangible textual moves are: the tariff classification figure in Column 1 is adjusted from 8479.90.90 (TABLE A) to 8479.90.00 (TABLE B). The Schedule 4 Item Number in Column 2 changes from the figure shown in TABLE A to "50" in TABLE B. The descriptive list of parts for "DIAPER MAKING MACHINE" appears verbatim in both tables; the operational or opening dates shown alongside the entries, "Op. 04.03.02 - TC 0201840" in TABLE A and "Op. 01.01.07 - TC 0614339" in TABLE B, are recorded under the description lines. In short, the instrument substitutes a new Tariff Concession Order number and associated tariff classification and Schedule 4 reference for the set of goods described, with an explicit effective date of 1 January 2007.
