What it does
This instrument, titled Tariff Concession Revocation Order HS2007/309A, revokes an earlier Tariff Concession Order (TCO) and substitutes a new TCO for a defined set of goods described in the tables attached to the instrument. The instrument is expressed as a two-step administrative action by a delegate of the Chief Executive Officer under the statutory authority cited at the head of the instrument. Paragraph (a) revokes Tariff Concession Order Number 9703290, originally made on 01.07.97, in respect of the goods set out in TABLE A, and states the revocation has effect from 01.01.07. Paragraph (b) then makes in its place the Tariff Concession Orders described in TABLE B, and declares that the goods in Column 1 of TABLE B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies. The instrument records that the Order takes effect from the date of effect for the revocation already identified (01.01.07). The instrument is dated 20 June 2007 and signed by Robert Crawford as a delegate of the Chief Executive Officer.
Mechanically, the instrument does three concrete things in the statutory framing it uses: it (1) terminates an existing TCO (TC 9703290), (2) introduces a replacement TCO (TC 0614266) that covers what is described in TABLE B, and (3) fixes an operative effective date for those changes (01.01.07). The two tables show the goods descriptions and tariff classifications that are the subject of the revocation and substitution: TABLE A records the prior entry under tariff subheading 8421.91.90 and a Schedule 4 item number recorded as "5031.12.06" with an operational note "Op. 01.07.97 - TC 9703290"; TABLE B records the replacement entry under tariff subheading 8421.91.00 with Schedule 4 item number "50" and an operational note "Op. 01.01.07 - TC 0614266". The instrument therefore effects a change in the tariff classification line and the Schedule 4 item that applies to the described centrifuge rotors, and it sets an effective date for that change earlier than the instrument signing date.
