What it does
This instrument, identified as Tariff Concession Revocation Order HS2007/304A, revokes an earlier Tariff Concession Order and replaces it with a new one for a specific set of goods. The instrument states, under the authority of Section 269SD(2) of the Customs Act 1901, that Robert Crawford, a delegate of the Chief Executive Officer, does two operative things: (a) revoke Tariff Concession Order Number 9703287 made on 01.07.97 in respect of the goods described in TABLE A; and (b) make in its place the Tariff Concession Orders described in TABLE B (text at head of instrument). The revocation is given effect from 01.01.07.
Mechanically, the instrument removes the TCO identified in Table A (Op. 01.07.97 - TC 9703287) and substitutes the TCO recorded in Table B (Op. 01.01.07 - TC 0614257) for the same described goods. Table A records the goods under customs tariff classification 8421.19.90 with a descriptive specification of bench-top centrifuges meeting a list of nine technical features. Table B records the goods under classification 8421.19.00, with the same descriptive specification, and lists the Schedule 4 item number in Column 2 as "50". The instrument declares that the goods specified in Column 1 of Table B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of Table B applies. The instrument is dated 20 June 2007 and is signed by the delegate.
Two temporal points stand out. First, the revocation is expressed to have effect from 01.01.07. Second, the instrument itself is dated 20 June 2007. The operative entries in the Tables show the original TCO operative from 01.07.97 (Table A: Op. 01.07.97 - TC 9703287) and the replacement TCO operative from 01.01.07 (Table B: Op. 01.01.07 - TC 0614257). The change therefore is expressed as retrospective to 01.01.07 for the revocation and substitution recorded.
