What it does
This instrument, titled Tariff Concession Revocation Order HS2007/300A, revokes one tariff concession order and substitutes another for the same described goods. The instrument expressly revokes Tariff Concession Order Number 9703277, which was made on 01.07.97, and states that the revocation has effect from 01.01.07. It then makes in its place the Tariff Concession Order described in TABLE B, identified by Op. 01.01.07 - TC 0614253. The instrument is dated 20 June 2007 and is signed by Robert Crawford, a delegate of the Chief Executive Officer. The document records the enabling reference "Under Section 269SD(2) of the Customs Act 1901" as the statutory authority for putting the revocation into effect.
Mechanically, the instrument performs two linked acts: (1) it annuls an earlier TCO (9703277) that covered a particular set of goods described in TABLE A, and (2) it inserts a new TCO entry (TC 0614253, TABLE B) for goods with substantially the same descriptive specification. Both TABLE A and TABLE B contain the full technical description of the goods, including a list of required features and precise external dimensions. The tables show a change in tariff classification notation between the revoked entry and the replacement: TABLE A uses the classification 8421.19.90 for the revoked entry, while TABLE B records 8421.19.00 for the replacement entry. TABLE B also states that the goods specified in Column 1 of TABLE B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies.
The dates recorded in the instrument delimit the period of effect for the old and new entries. The revoked TCO was originally dated 01.07.97; TABLE A lists an entry in Column 2 that reads "5031.12.06" (as printed in the instrument). The replacement entry in TABLE B is shown with Column 2 containing "50" (as printed). The instrument is explicit that the Order "shall have effect from the date notified in paragraph (a) above as the date of effect for the Revocation," meaning the replacement order takes effect from 01.01.07, the same date from which the old order is revoked. The instrument does not itself state any tariff rates or detailed procedural rules beyond the revocation and substitution; it establishes the classification and the linkage to an item in Part III of Schedule 4 to the Customs Tariff Act 1995 for the goods so described.
