What it does
This instrument, titled Tariff Concession Revocation Order HS2007/274A, revokes an earlier Tariff Concession Order (TCO) and replaces it with a new TCO that applies to the same described goods but with different tariff classification and Schedule 4 item application. The delegate of the Chief Executive Officer, Robert Crawford, exercises power under the instrument to: (a) revoke Tariff Concession Order Number 8735578 made on 01.01.88, in respect of the goods described in TABLE A; and (b) make in its place the Tariff Concession Orders described in TABLE B. The instrument states explicitly that "This Revocation has effect from 01.01.07" and that "The Order shall have effect from the date notified in paragraph (a) above as the date of effect for the Revocation."
Mechanically, the revocation substitutes the entry in TABLE A (which records the formerly applicable tariff classification and Schedule 4 item) with the entry in TABLE B. TABLE A records the former Customs Tariff classification as 7306.10 and associates Column 2 with the numeral string "5031.12.06". TABLE B records the replacement Customs Tariff classification as 7306.19.00 and associates Column 2 with "50". Both tables describe the same physical goods in detail: "TUBES OR HOLLOW BARS (NOT being honed tubes), in straight lengths, ends plain, bevelled or threaded" meeting specified material standards (AS, ASME, ASTM, BS, DIN), with no further rework and with length not less than four times outside diameter, and with precise outside diameter and wall thickness ranges set out in the embedded table.
The instrument is dated 20 June 2007 and identifies the new TCO as "Op. 01.01.07 - TC 0614214" and the revoked TCO as "Op. 01.01.88 - TC 8735578". The legal authority for making the revocation is recorded at the top of the instrument: "Under Section 269SD(2) of the Customs Act 1901, I Robert Crawford a delegate of the Chief Executive Officer… revoke Tariff Concession Order Number 8735578 … and make in its place the Tariff Concession Orders described in TABLE B." The instrument thus operates by removing the old concession entry from the customs tariff treatment regimen and substituting a new entry, with an effective date that is earlier than the instrument's signing date.
