What it does
This instrument, titled Tariff Concession Revocation Order HS2007/271A (Tariff Concession Order 0614209), performs two discrete mechanical changes under the authority it cites. First, it revokes an earlier Tariff Concession Order (TCO) identified as number 8734785, which was originally made on 23 December 1987, insofar as that earlier order covered the goods listed in Table A of the instrument. The revocation is declared to have effect from 01.01.07, as specified in paragraph (a) of the opening recitals. Second, the instrument makes in place of the revoked order the Tariff Concession Orders described in Table B. That is, the instrument replaces the earlier TCO entry for the described goods with a new TCO entry, with the particulars set out in Table B.
The instrument expressly states the legal basis for the exercise: it is made under section 269SD(2) of the Customs Act 1901, by Robert Crawford, a delegate of the Chief Executive Officer (signature block dated 20 June 2007). The instrument identifies the goods to which the new order applies by listing the customs tariff classification (Column 1 of Table B) and by specifying the Schedule 4 item number to which those goods are to be treated as goods “to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of Table B applies.” In the concrete text provided, Table B lists the classification 7304.19.00 for the described tubes or hollow bars, and places “50” in Column 2 (labelled Schedule 4 Item Number). Table A, which the instrument revokes, refers to the earlier classification 7304.10 for materially the same description of goods under the prior TCO (TC 8734785).
Mechanically therefore, the instrument (a) removes the legal recognition of the prior concession entry for the goods in Table A with effect from the date stated, and (b) institutes a replacement TCO entry as described in Table B, so that from the stated effective date the goods described in Column 1 of Table B are the goods to which the Schedule 4 Part III item specified in Column 2 applies. The instrument includes operative annotations such as the original opening dates of the TCOs (Op. 03.07.87 for the revoked order, Op. 01.01.07 for the new order) and TC reference numbers (TC 8734785 and TC 0614209). The pages of the instrument are signed and dated by the delegate (20 June 2007).
