What it does
This instrument revokes one Tariff Concession Order and replaces it with another, changing the tariff classification and the Schedule 4 linkage recorded on the face of the concession for a defined set of aluminium kitchen utensils. The instrument opens by stating the legal authority used: "Under Section 269SD(2) of the Customs Act 1901, I Robert Crawford a delegate of the Chief Executive Officer" (opening paragraph). It then does two discrete things, in the delegate’s words: (a) it revokes Tariff Concession Order Number 0708943 made on 09.11.07 "in respect of the goods described in TABLE A below" and declares that the revocation "has effect from 01.01.12"; and (b) it "make[s] in its place the Tariff Concession Orders described in TABLE B" (opening paragraph).
Mechanically, the revocation and replacement operate by removing the entry listed in TABLE A from the concessions register and inserting the entry listed in TABLE B with an effective date aligned to the revocation. The instrument states that "The goods specified in Column 1 of TABLE B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies" (opening paragraph). The replacement order is recorded as "Op. 01.01.12 - TC 1132501" in TABLE B; the revoked order is recorded as "Op. 13.06.07 - TC 0708943" in TABLE A.
The practical change on paper is a reclassification of the listed aluminium kitchen utensils from the Customs Tariff Classification shown in TABLE A to the classification shown in TABLE B, and a change in the Schedule 4 item reference recorded on the TCO (the instrument sets out a Schedule 4 item number in Column 2 for each table). The instrument is dated 30 November 2011 and signed by the delegate, Robert Crawford. The revocation is effective 01 January 2012, which is the date from which the replacement order is to have effect.
