What it does
This instrument revokes an earlier Tariff Concession Order (TCO) and replaces it with a new TCO that applies to the same described goods, changes the customs tariff classification number applied to those goods, and sets the Schedule 4 item to be applied to them for tariff purposes. The instrument is made under s 269SD(2) of the Customs Act 1901; it records that Robert Crawford, a delegate of the Chief Executive Officer, "revoke[s] Tariff Concession Order Number 0708942 made on 12.10.07, in respect of the goods described in TABLE A below" and that the revocation "has effect from 01.01.12" (instrument header). The instrument then "make[s] in its place the Tariff Concession Orders described in TABLE B" and states that "The goods specified in Column 1 of TABLE B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies" (instrument header).
Mechanically, the instrument performs three discrete actions:
- It revokes TCO No. 0708942, originally opened on 13 June 2007 (noted as "Op. 13.06.07 - TC 0708942") and recorded in TABLE A (TABLE A, Column 1 and column headings).
- It inserts or substitutes a new TCO recorded in TABLE B, identified as "Op. 01.01.12 - TC 1132500" (TABLE B, Column 1).
- It changes the customs tariff classification number used to designate the goods from 7615.19.00 (Table A) to 7615.10.00 (Table B), and it changes the Schedule 4 Part III item entry from "5031.12.11" (shown in Table A Column 2, labelled "Schedule 4 Item Number Last date of effect") to "50" in Table B Column 2 (TABLE A and TABLE B, Column 2).
The instrument is dated 30 November 2011 and records the delegate's signature (closing lines on pages). The stated operative date for both revocation and replacement is 01 January 2012: the revocation "has effect from 01.01.12" and the new TCO is recorded with "Op. 01.01.12 - TC 1132500" (instrument header and TABLE B).
