What it does
This instrument revokes an existing Tariff Concession Order (TCO) and replaces it with a new TCO for a narrowly described set of imported aluminium household utensils. The instrument is issued under section 269SD(2) of the Customs Act 1901, as stated in the instrument text. Paragraph (a) of the instrument expressly revokes Tariff Concession Order Number 0708935, made 12 October 2007, “in respect of the goods described in TABLE A below,” and gives that revocation effect from 01.01.12. Paragraph (b) makes in its place the Tariff Concession Orders described in TABLE B. The instrument records that the goods listed in Column 1 of TABLE B “are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies.” The instrument is dated 29 November 2011 and signed by Robert Crawford, a delegate of the Chief Executive Officer.
Mechanically, the change documented in the Tables is two-fold on the face of the instrument. Table A lists the prior tariff classification for the described goods as 7615.19.00 and associates that entry with Schedule 4 item number 5031.12.11 and the prior TCO reference (Op. 13.06.07 - TC 0708935). Table B lists the replacement tariff classification as 7615.10.00 for the same descriptive list of goods and sets the Schedule 4 item number for the new order as 50 (Op. 01.01.12 - TC 1130502). The instrument therefore records a reclassification and respecification of the Schedule 4 item applicable to the enumerated goods, effective on 1 January 2012.
The instrument does not itself set tariff rates or state the content of Part III of Schedule 4; rather it identifies which Schedule 4 item applies to the listed goods. It does not contain additional operative provisions such as transitional relief, exceptions, or penalty clauses within the text supplied. The legal authority cited for the revocation is s 269SD(2) of the Customs Act 1901, and the linkage to the Customs Tariff Act 1995 is through the identification of the relevant item in Part III of Schedule 4.
