What it does
This instrument, styled “Tariff Concession Revocation Order 09/2007 - Tariff Concession Order 0614805/0614802”, revokes an earlier Tariff Concession Order (TCO No. 0614738) and replaces it with two new TCO entries. The revocation is exercised under s 269SD(2) of the Customs Act 1901 (the instrument itself records that power: “Under Section 269SD(2) of the Customs Act 1901, I Robert Crawford a delegate of the Chief Executive Officer (a) revoke Tariff Concession Order Number 0614738 made on 23.11.06 ... This Revocation has effect from 02.01.07; and (b) make in its place the Tariff Concession Orders described in TABLE B.”). The replacement TCOs appear in TABLE B of the instrument and take effect from the same date recorded for the revocation.
Mechanically, the Order does two things in the text supplied:
- It revokes TCO 0614738 (the Order specifies the original TCO number and its date, “made on 23.11.06” and records an operative date of effect “01.01.07 - TC 0614738” in the schedule).
- It creates two replacement entries (TC 0614805 and TC 0614802) listed in TABLE B, each identifying a tariff classification code (8708.94.52 for one entry; 8708.94.59 for the other), a long textual description of the goods, an “Op.” date (“Op. 01.01.07” for both entries) and, in the Column 2 field, the Schedule 4 item number shown as “50”.
The instrument expressly links the TABLE B entries to Part III of Schedule 4 to the Customs Tariff Act 1995: “The goods specified in Column 1 of TABLE B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies.” The Order is signed and dated by Robert Crawford as a delegate of the Chief Executive Officer, dated 02 January 2007.
The textual descriptions in the Tables delimit the affected goods by (1) tariff classification (heading 8708.94.x), (2) an objective manufacturing cut-off (“manufactured prior to 1962”), (3) an import-based test (“if imported, would fall within Chapter 87 of the Customs Tariff Act 1987”), and (4) a list of included parts (TABLE A items (a)-(i)), together with an express exclusion of certain sub-items which are placed instead in TABLE B (TABLE B lists tie rod ends, suspension ball joints, oil seals and gaskets). The revocation and replacement therefore rearrange which specific parts are subject to which TCO/tariff classification and which Schedule 4 item applies.
