What it does
This instrument is a Tariff Concession Revocation Order dated by a delegate of the Chief Executive Officer and signed by Robert Crawford on 18 May 2005. The Order does two mechanically distinct things. First, it revokes Tariff Concession Order (TCO) Number 9607509, which the document records as having been made on 4 July 1996, in respect of the goods described in Table A. The revocation is declared to have effect from 17 May 2005 (see opening paragraph and paragraph (a)). Second, it makes in place of that revoked TCO a new Tariff Concession Order described in Table B; the instrument expressly states that the goods specified in Column 1 of Table B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of Table B applies, and that the new Order "shall have effect from the date notified in paragraph (a) above as the date of effect for the Revocation" (see opening paragraph and paragraph (b)). The instrument is made under the authority of Section 269SD(2) of the Customs Act 1901, which it cites as its enabling provision.
Practically, the revocation-plus-replacement is confined to a single species of product described in detail in both Table A and Table B. Table A records the previous classification as 5603.14.00 and references TCO TC 9607509. Table B records the replacement classification as 6307.90.40 and references TC 0505625. The descriptive product specification in both tables is essentially identical: a non-woven or not-knitted spun-bonded polyester fabric of 50 cellular honeycomb construction with an enumerated list of eight physical and performance characteristics (items (a)-(h)). The operative chronology in the instrument is: the revocation takes effect from 17 May 2005; the instrument is dated 18 May 2005 and signed by the delegate; the replacement order is recorded as Op. 01.07.96 , TC 0505625 (see Table A and Table B entries). The administrative effect is therefore a change of tariff classification code applied to a narrowly specified product as of 17 May 2005, effected by a delegate under s 269SD(2).
