What it does
This instrument, titled Tariff Concession Revocation Order 06/2007 , Tariff Concession Order 0614799/0614806, revokes a previously made Tariff Concession Order (TCO 0614756) and substitutes two new TCO entries for the goods described in its tables. The Order is made under the explicit legal authority of section 269SD(2) of the Customs Act 1901 (the instrument cites that section at the outset). The named decision-maker is Robert Crawford, a delegate of the Chief Executive Officer, who signed and dated the instrument 02 January 2007.
Mechanically the instrument does two things, as expressed in its own terms: (a) it revokes TCO number 0614756, which was made on 23 November 2006, with the revocation taking effect from 02 January 2007; and (b) it makes in its place the Tariff Concession Orders identified in TABLE B of the instrument (the text: "in its place the Tariff Concession Orders described in TABLE B"). The instrument also states that the goods set out in Column 1 of TABLE B are goods "to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies." In TABLE B the relevant Schedule 4 item is shown as "50" for both tariff classifications listed.
The goods affected are described in the tables. The instrument lists two tariff lines in TABLE B: 8708.99.99 and 8708.99.91. Both entries use the same descriptive text: parts for vehicles, being original equipment or reproductions fitted as original equipment to vehicles that would fall within Chapter 87 of the Customs Tariff Act 1987 if imported and that were manufactured prior to 1962, with a detailed list of component types in TABLE A and a further list in TABLE B (the instrument’s layout is internally inconsistent; see "Gotchas" below). Each of the new entries in TABLE B is annotated "Op. 01.01.07" and bears a TC number (TC 0614799 for the 8708.99.99 line and TC 0614806 for the 8708.99.91 line).
