What it does
This instrument is a Tariff Concession Order (TCO) issued under section 269P of the Customs Act 1901. The operative legal action taken by the document is a declaration: it declares that the goods described in Column 1 of the Table are "goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of THE TABLE applies" (see the heading statement). The Order records an operative commencement date of 22.09.11 and states that it will "continue in force until revoked under sections 269SC or 269SD of the Act, or the date, if any, specified in Column 2." The document is signed by a delegate of the Chief Executive Officer, Wendy Knowles, and is dated 19 December 2011.
Mechanically, the instrument performs three discrete functions, as expressed in its text. First, it identifies a tariff classification and a product description in Column 1 of the Table: "3917.40.00" and "FITTINGS, CONDUIT, polyamide, moulded" (Table, Column 1). Second, it links that description and classification to an item entry in Part III of Schedule 4 to the Customs Tariff Act 1995, by reference to the item number shown in Column 2 (the Table). Third, it records the date from which the Order is to have effect, and the conditions under which it may cease to have effect (revocation under ss 269SC or 269SD or any date recorded in Column 2).
The Order itself does not set out the text of the Schedule 4 item, the tariff rate, or any monetary rates. Instead, it effects the legal linkage between the specific goods listed and the relevant item in Schedule 4 of the Customs Tariff Act 1995. The document therefore operates as a declaratory instrument: it declares that the listed polyamide moulded conduit fittings, classifiable to tariff heading 3917.40.00, are to be treated as goods to which the referenced Schedule 4 item applies, from 22 September 2011 until revocation or any specified expiry date. The TCO is identified by its unique number, TC 1132493, which appears in the Table entry alongside the operative date.
