What it does
This Tariff Concession Order (TCO) declares that a defined set of propellers is subject to an item in Part III of Schedule 4 to the Customs Tariff Act 1995. The instrument opens with an express statutory source: it is made "Under Section 269P of the Customs Act 1901" and states that the delegate "declare[s] that the goods specified in Column 1 of THE TABLE are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of THE TABLE applies." The operative effect is therefore a legal linkage: the goods described in Column 1 of the Table are to have the tariff treatment (whatever that item prescribes) contained at the Schedule 4 Part III item specified in Column 2.
Mechanically the document does four things, as shown on its face:
- Identifies the legal head of power for the instrument: Section 269P of the Customs Act 1901 (first paragraph). That is the express enabling provision cited by the delegate.
- Defines the covered goods by tariff classification and by detailed physical/functional description, including hub type and enumerated diameter and pitch combinations (Table entry under 8487.10.00).
- Specifies the Schedule 4 item number that "applies" to those goods, shown in Column 2 as "50" (the Table header confirms Column 2 is the "Schedule 4 Item Number/Last date of effect").
- States the date from which the Order has effect: "This Order shall have effect from 31.12.09" (first paragraph), and describes how it terminates , by revocation under sections 269SC or 269SD of the Customs Act 1901, or by any date specified in Column 2 (no date is specified in Column 2 on this instrument).
The face of the instrument records operational identifiers and administrative metadata: "Op. 31.12.09" and "TC 1000126" are present in the Table, and the instrument is signed by the delegate ("David Mulcair ... Dated 26 March 2010"), which establishes who made the declaration and the administrative date of signature. The Table sets the customs tariff classification number 8487.10.00 and provides a precise technical description of the goods: "PROPELLERS, OUTBOARD OR STERNDRIVE ENGINE" limited to four hub types (rubber bushed, exhaust-through hub, pin driven, spline driven) and to the specific diameter and pitch combinations listed. The Table does not itself restate the content of Schedule 4 item 50; it only records that item 50 applies to these goods.
