What it does
The Tariff Concession Order 0904232 is a legislative instrument made under section 269P of the Customs Act 1901. It declares that the goods specified in Column 1 of the table are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of the table applies. The order was declared by Wendy Knowles, a delegate of the Chief Executive Officer, and is dated 01 May 2009. This Order shall have effect from 09.02.09 and continue in force until revoked under sections 269SC or 269SD of the Customs Act 1901, or the date, if any, specified in Column 2.
The table sets out the description of goods including the Customs Tariff Classification in Column 1 and the Schedule 4 Item Number in Column 2. Column 1 identifies the goods as FIN FAN COOLER ASSEMBLIES, water to air, including ALL of the following: (a) heat exchanger batteries with fin tube bundles; (b) motor fan units; (c) cooling water pump skid; (d) expansion tank; (e) steel support structure; (f) interconnecting piping. These goods fall under Customs Tariff Classification 8419.50.90. Column 2 specifies item number 50 with no last date of effect recorded.
The instrument operates by linking the precise description of these assemblies to the concessional treatment available under item 50. It is presented as page 1 of 1 of the table and signed by the delegate. The order does not amend the Customs Act 1901 or the Customs Tariff Act 1995. It simply declares the application of the existing concessional item to goods that satisfy the listed criteria. The text makes clear that the concession applies only when the imported items match the full description, including every component from (a) to (f).
