What it does
This instrument is a Tariff Concession Order (TCO) numbered 0844193 made under section 269P of the Customs Act 1901. Its operative effect is to declare that the goods described in Column 1 of the accompanying Table are "goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of THE TABLE applies." The Table identifies the tariff classification 8425.19.00 and gives a single-line Schedule 4 item number shown as "50" in Column 2. The Order states it "shall have effect from 17.12.08 and continue in force until revoked under sections 269SC or 269SD of the Act, or the date, if any, specified in Column 2."
Mechanically, the Order performs three discrete actions as drafted in the document:
- It fixes the precise description of the goods covered by the concession: "RIGGING KITS, HOOK AND LINE, consisting of ALL of the following:" followed by an enumerated list of components (a)-(ah). The list is integral to the grant because the phrase "consisting of ALL of the following" makes the listed components part of the statutory description.
- It links that described product to a specific item in Part III of Schedule 4 to the Customs Tariff Act 1995, recorded in the Table as Item 50. The instrument therefore identifies which Schedule 4 concession item applies to the described goods.
- It sets the operative commencement date (17 December 2008) and records that the TCO continues until revoked under sections 269SC or 269SD of the Customs Act or until any last date in Column 2, which is blank for a termination date and thus implies continuation until revocation.
The document is signed by a delegate of the Chief Executive Officer (Wendy Knowles) and dated 13 March 2009, and carries the administrative reference "Op. 17.12.08 - TC 0844193." The Order does not itself set rates, duty-free status, or procedural requirements beyond the declaration; it instead creates the legal fact that the listed goods are those to which Schedule 4 item 50 applies. The only statutory provisions cited in the instrument are s 269P as the head of power for making the Order and ss 269SC and 269SD as the mechanisms for revocation.
