What it does
This instrument is a Tariff Concession Order (TCO) made under Section 269P of the Customs Act 1901. The delegate of the Chief Executive Officer, Paul Mercer, declares that the goods described in Column 1 of the Table are "goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of THE TABLE applies." The Order states an operative date of 07.02.08 and continues in force until revoked under sections 269SC or 269SD of the Customs Act 1901, or until any date specified in Column 2 of the Table.
Mechanically, the Order does three things as recorded in the instrument itself:
- It identifies a tariff classification code (shown in the Table as 8410.90.00) and a detailed description of goods in Column 1: a long, enumerated list of parts for a "turbine drill, hydraulic" (for example, setting plates, spacers, rotors, stators, shafts, various sleeves, balance drums, etc.). The enumeration runs across two pages of the Table and is explicit about the parts covered.
- It records a Schedule 4 item number in Column 2, shown on the face of the Table as "50", so that the specified Part III Schedule 4 item is to be applied to those goods.
- It fixes an operative commencement date (07.02.08) and records that the Order is effective from that date, subject to continuing until revocation under the named provisions of the Customs Act or any date stated in Column 2.
The document bears the operative notation "Op. 07.02.08 - TC 0802156", is signed by the delegate and is dated 02 May 2008. The Table explicitly repeats that the Order was made under s 269P of the Customs Act 1901 and links its duration and revocation to s 269SC and s 269SD of that Act and to Part III of Schedule 4 to the Customs Tariff Act 1995. No other operational terms, conditions, monetary rates or additional administrative rules are included in the text of the Order itself.
