What it does
This Tariff Concession Order (TCO) 0800903, issued under s 269P of the Customs Act 1901, declares a class of goods to be “goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of THE TABLE applies” (first paragraph of the instrument). The instrument specifies the customs tariff classification 8516.90.00 and describes the goods as “OVEN AND/OR GRILLER PARTS, being ANY of the following” followed by an enumerated list of parts (items (a) to (aj)). The TCO is operative from 15.01.08, identified as “Op. 15.01.08” in the table, and carries the internal reference “TC 0800903”. The instrument is signed by Wendy Knowles as a delegate of the Chief Executive Officer and dated 28 March 2008.
Mechanically, the Order performs a declaration function: it associates the listed goods with an item in Part III of Schedule 4 to the Customs Tariff Act 1995 by recording in the table the goods (Column 1) and the Schedule 4 item number (Column 2). The table shows “50” in Column 2, which is the Schedule 4 item number recorded against the 8516.90.00 classification and the descriptive list. The opening paragraph sets the effective period: the Order “shall have effect from 15.01.08 and continue in force until revoked under sections 269SC or 269SD of the Act, or the date, if any, specified in Column 2.” Because the table contains no explicit calendar “last date of effect”, the Order therefore remains in force until revoked under the referenced provisions or until a date is inserted in Column 2.
The instrument thus changes the statutory tariff treatment of the described goods by linking them to a Schedule 4 Part III item number. The TCO does not itself reproduce Schedule 4 or state the economic effect (for example, any specific rate of duty or concession). It is a formal declaration that the listed articles are to be treated as goods to which the identified Schedule 4 Part III item applies, effective as recorded and subject to revocation under the cited sections of the Customs Act 1901.
