What it does
This instrument is a Tariff Concession Order (TCO) issued under s 269P of the Customs Act 1901. It declares, for the purposes of the Customs Tariff Act 1995, that the goods described in Column 1 of the Table are goods to which the item in Part III of Schedule 4 specified in Column 2 applies. The Table identifies the tariff classification 7308.90.00 and lists a detailed catalogue of component parts for a formwork, panel wall system (items (a) to (ao)). The Table records the Schedule 4 item number as 50, and records that the Order has effect from 13 November 2007 (Op. 13.11.07 - TC 0719350). The instrument is signed and dated 29 January 2008 by Wendy Knowles, a delegate of the Chief Executive Officer.
Mechanically, the Order performs a single statutory function: it links a defined set of imported goods (identified by description and tariff classification) with an item in Part III of Schedule 4 to the Customs Tariff Act 1995. The Order specifies an operative start date, and its duration is governed by the revocation mechanisms in the Customs Act (ss 269SC and 269SD) or any specific end date recorded in Column 2 (none is recorded in this Table). The Order itself is thus a declaratory instrument that identifies eligible goods for the purposes of applying whatever legal effect flows from Part III Schedule 4 item 50; the Order’s text does not itself set out the substantive consequence of item 50 (for example the quantum or nature of any concession), it only makes the statutory link between the goods and that Schedule 4 item.
The instrument is narrow in scope: it applies only to goods that both (i) fall within the tariff classification in Column 1 (7308.90.00), and (ii) match the description given (the enumerated parts for a formwork panel wall system). Its legal life is explicitly tied to the administrative revocation provisions in the Customs Act (ss 269SC, 269SD) or to any specific expiry date that could have been entered in Column 2. The Order includes a Trade Committee or tracking identifier (TC 0719350) and records the operational commencement date separately from the signing date, which is relevant for practical effect and record-keeping.
