What it does
This instrument is Tariff Concession Order (TCO) 0710969 made under s 269P of the Customs Act 1901. It formally declares that a specified list of goods, classified to tariff heading 8422.90.00, are “goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of THE TABLE applies.” The Order records an operative date of effect from 10 July 2007 and is dated 02 October 2007 with the delegate signature of Michael Perry. The Order remains in force until it is revoked under ss 269SC or 269SD of the Customs Act, or until any date specified in Column 2 of the Table.
Mechanically, the TCO performs a single statutory act stated in the instrument: it links the IDENTIFIED goods (described in Column 1) to a particular Schedule 4 item in Part III of the Customs Tariff Act 1995 (identified in Column 2). The Table identifies the tariff classification (8422.90.00) and an extensive, enumerated list of parts for strapping machines, introduced with the wording “PARTS, STRAPPING MACHINE, being ANY of the following and whether or not in sets or kits:” and then a through au list of components. The Table shows the entry in Column 2 as “50”, which the Order presents as the Schedule 4 item number. The Order expressly states its effect dates and the routes for termination (revocation under s 269SC or s 269SD or a date in Column 2).
The instrument is administrative rather than legislative in form: a delegate of the Chief Executive Officer has exercised power under the Customs Act to declare the connection between goods and a Schedule 4 item. The text is factual and limited to that declaration, the goods description, the relevant tariff classification number, the operative date, and the revocation routes named in the Act.
