What it does
This instrument is a Tariff Concession Order (TCO) made under s 269P of the Customs Act 1901. It declares that the goods described in Column 1 of the TABLE are "goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of THE TABLE applies" (source text, opening declaration). The Order is expressed to take effect from 13 June 2007 and to continue in force until revoked under ss 269SC or 269SD of the Customs Act 1901, or until any date specified in Column 2 (source text). The TCO bears the administrative identifier "TC 0708941" (noted in the Table) and is signed by Wendy Knowles, a delegate of the Chief Executive Officer, dated 09 November 2007.
Mechanically, the Order attaches an item from Part III of Schedule 4 of the Customs Tariff Act 1995 to a specific set of goods described by tariff classification and detailed product description. Column 1 records the customs tariff classification (shown in the Table as 7323.99.00) and a detailed, enumerated list of goods described as "KITCHENWARE, iron or steel, being ANY of the following" followed by a long alphabetised list of items (items (a)-(av) across two pages). Column 2 records the Schedule 4 item number as "50" and contains no explicit "last date of effect" (the cell is blank), implying the concession remains until revoked or until any future date is specified.
The instrument therefore operates as a targeted administrative determination that certain iron or steel kitchenware falling under tariff heading 7323.99.00 is to be treated as subject to the particular concession or treatment set out in Part III, Schedule 4, item 50 of the Customs Tariff Act 1995 from 13 June 2007. The Order does not itself set tariff rates or the content of Schedule 4; it identifies which goods qualify for the Schedule 4 item. Revocation and termination are governed by the provisions of the Customs Act cited in the Order (ss 269SC and 269SD).
