What it does
This Tariff Concession Order (TCO), numbered TC 0708937, is a delegated administrative declaration under s 269P of the Customs Act 1901. The delegate, Wendy Knowles, declares that the goods described in Column 1 of the Table are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 applies. The Order states it "shall have effect from 13.06.07 and continue in force until revoked under sections 269SC or 269SD of the Act, or the date, if any, specified in Column 2." Those operative features are the core mechanical change: a legal recognition that specified stainless steel kitchenware (see the Columns) falls within the scope of Schedule 4, Part III, item 50 (Column 2), from 13 June 2007 onwards (s 269P reference and effect date as printed on the instrument).
Mechanically, the instrument does three things in the language used by the Order. First, it identifies the Customs Tariff classification heading 7323.93.00 and then lists a set of stainless steel kitchenware items described as "being ANY of the following" (items (a) through (av), continued across two pages). Second, it records the Schedule 4 item number to be applied to those goods, shown in Column 2 as "50". Third, it fixes the commencement date as 13 June 2007 and provides for continuation until administrative revocation under ss 269SC or 269SD or until any specified expiry date appears in Column 2 (the Table) for the item. The instrument bears the delegate's signature block and is dated 09 November 2007; it also carries the notation "Op. 13.06.07 - TC 0708937" indicating the operative commencement date referenced above.
The document does not itself set out the content of Part III, Schedule 4, item 50, nor does it state the detailed fiscal rate or concession mechanics that item 50 entails. Its legal operation is to link the described goods to that Schedule 4 item. Any regulatory, fiscal or administrative effect that follows therefore depends on the statutory treatment in Part III of Schedule 4 for item 50 and on any applicable customs administration procedures for claiming the benefit announced in this Order.
