What it does
This Tariff Concession Order (TCO) declares that a particular class of stainless steel tableware is to be treated as goods to which an item in Part III of Schedule 4 to the Customs Tariff Act 1995 applies. The legal source language is: under Section 269P of the Customs Act 1901, the delegate declares that the goods specified in Column 1 of the Table are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of the Table applies. The Order has effect from 13.06.07 and continues in force until revoked under sections 269SC or 269SD of the Act, or until any date, if specified, in Column 2.
Mechanically, the instrument does three things in the text it contains. First, it identifies the statutory power under which the instrument is made: Section 269P of the Customs Act 1901. Second, it specifies the goods to which the concession applies by reference to a customs tariff classification number, 7323.93.00, together with a precise descriptive schedule of goods described as "TABLEWARE, stainless steel, being ANY of the following" and then enumerates 45+ subcategories (a) through (as). Third, it records the Schedule 4 item number applicable to those goods in Column 2: the entry shown is "50". The operative dates recorded are an effective start date, 13.06.07, and the marginal notation "Op. 13.06.07 - TC 0708936". The Order also records an administrative delegate, Paul Mercer, and a delegate date of 12 October 2007.
The document therefore creates a binding administrative declaration linking a defined set of imports, described both by tariff classification (7323.93.00) and by a plain-English list of article types, to an item number in Schedule 4 Part III of the Customs Tariff Act 1995. The Order itself does not reproduce the operative text of Part III Schedule 4 or set out the tariff rate, expiry mechanism or any monetary amounts. It records that the declared goods are subject to the Schedule 4 item specified (item 50) and that the Order remains in force until revoked by reference to the revocation provisions of the Customs Act 1901 (ss 269SC or 269SD) or until a date, if any, is specified in Column 2. The Column 2 entry in the table shows the item number but does not include an explicit "last date of effect" in the table text provided.
