What it does
This instrument is a Tariff Concession Order (TCO) numbered 0704735 issued under s 269P of the Customs Act 1901. Its operative declaration is that the goods specified in Column 1 of the Table are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of the Table applies. The Order states it has effect from 30 March 2007 and will continue in force until revoked under sections 269SC or 269SD of the Customs Act 1901, or until any date specified in Column 2 of the Table.
Mechanically, the Order does three concrete things within its own text:
- Identifies the statutory headroom under which it is made: s 269P of the Customs Act 1901 is the enabling provision cited at the start of the instrument.
- Declares a connection between an identified set of imported goods (listed in Column 1) and an item in Part III of Schedule 4 to the Customs Tariff Act 1995 (listed in Column 2).
- Fixes an operative commencement date (30.03.07) that is earlier than the instrument’s signing date, and states the conditions in which the Order will cease to have effect (revocation under ss 269SC or 269SD, or a date shown in Column 2).
The Table in the body of the instrument lists a single row. Column 1 provides a customs tariff classification code and a short description: "8479.89.90 REGULATORS, WINDOW Op. 30.03.07 - TC 0704735". Column 2 contains the single entry "50", under the header “Schedule 4 Item Number Last date of effect”. The instrument is signed by Diane Morland, Delegate of the Chief Executive Officer, and dated 15 June 2007. The Order therefore purports to operate with retrospective effect from 30 March 2007 and to attach the Part III Schedule 4 item identified by the table to the goods identified.
The text does not, within the document itself, set out the text or effect of the Schedule 4 item, nor does it state monetary amounts, duty rates, or other tariff outcomes. It delegates those specifics to the referenced Schedule 4 item in the Customs Tariff Act 1995. The instrument also does not include detailed administrative procedures, compliance steps or penalty provisions within its own text; instead it cross-references the enabling and revocation provisions (ss 269P, 269SC, 269SD) of the Customs Act 1901.
