What it does
This instrument, Tariff Concession Order 0700808, declares that a narrowly described category of imported goods is to be treated as "goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of THE TABLE applies" (instrument text). The Order is made under Section 269P of the Customs Act 1901 and specifies both the tariff classification and a textual goods description in Column 1, and an item number from Schedule 4 in Column 2. The entry in the Table identifies the tariff subheading 8704.23.00 and a goods description: "CHASSIS, TRUCK, COMPRESSION IGNITION ENGINE, having BOTH of the following: (a) 6 x 2 wheel drive; (b) gross vehicle weight NOT less than 20 tonnes and NOT greater than 24 tonnes" (Table, Column 1). The item number shown in Column 2 is "50" (Table, Column 2).
The Order states an operative start date: it "shall have effect from 15.01.07" and will "continue in force until revoked under sections 269SC or 269SD of the Act, or the date, if any, specified in Column 2" (instrument text). The Table records "Op. 15.01.07 - TC 0700808" and the document bears the signature line "Wendy Knowles, Dated 10 April 2007, Delegate of the Chief Executive Officer". The instrument thus sets a legal connection between the listed goods (defined by tariff heading and by precise descriptive conditions) and whatever legal effect flows from Item 50 of Part III, Schedule 4 to the Customs Tariff Act 1995. The Order itself does not reproduce the text of Item 50, nor does it state any rates, concessions, or monetary figures; it operates by applying that external Schedule item to the goods described.
Mechanically, the Order does three things in the text it contains: it (1) identifies the legislative power used to make the declaration (s 269P of the Customs Act 1901); (2) lists specific goods, by tariff classification and by a two-part specification, and links those goods to a Schedule 4 item (Column 1 and Column 2 of the Table); and (3) fixes the effective date and the modes by which the Order can cease to have effect (operative date and revocation under sections 269SC or 269SD, or the optional date that could appear in Column 2). The instrument thus functions as a targeted administrative declaration tying a Schedule 4 item to goods of a particular technical specification and tariff classification.
