What it does
This instrument is a Tariff Concession Order (TCO) made under s 269P of the Customs Act 1901. It declares that the goods described in Column 1 of the Table are goods “to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of THE TABLE applies” (opening paragraph). The operative effect, stated in the Order, is that those described goods are to be treated as falling within the Schedule 4 item identified in Column 2 (the Table shows the number “50” in Column 2). The Order specifies an operative commencement date: “This Order shall have effect from 15.05.06” and, by its own terms, will “continue in force until revoked under sections 269SC or 269SD of the Act, or the date, if any, specified in Column 2” (opening paragraph).
Mechanically, the document:
- Identifies a customs tariff classification for the listed goods (9402.90.00 is shown immediately above the description in Column 1).
- Provides a descriptive list of the covered goods, in the form “PARTS, BEDS, DISABLED, PORTABLE, being ANY of the following” and enumerates items (a) through (h).
- Records the operation date “Op. 15.05.06 - TC 0608339” and is signed as a delegate of the Chief Executive Officer, dated 21 July 2006 (closing line).
The Table entry lists the covered parts precisely: mattress supports and/or extensions; bed ends; support handles; side rails; lifting poles; IV racks; transport units; and 24 V electric motors (Column 1, items (a)-(h)). The Table gives the Schedule 4 item number as “50” in Column 2 and does not show any separate “last date of effect” in the printed cell for that column. The Order therefore operates by applying the specified Schedule 4 Part III item (item number 50) to the described goods from 15 May 2006 until revocation or any date specified in Column 2, which in this instance is limited to the number “50” being recorded rather than an expiry date. The instrument is identified as “Tariff Concession Order 0608339”.
