What it does
The instrument is a Tariff Concession Order made under section 269P of the Customs Act 1901. Its operative legal action is narrow and mechanical: it "declare[s] that the goods specified in Column 1 of THE TABLE are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of THE TABLE applies" (first paragraph of the Order). The Table lists a single tariff classification and description, and a single Schedule 4 item number.
Key operative features stated in the Order:
- Authority: the Order is made under section 269P of the Customs Act 1901. The instrument records the delegate as Michael Perry, a delegate of the Chief Executive Officer, and is dated 07 July 2006.
- Subject goods: Column 1 identifies the goods as "8474.10.00 SCREENS, VIBRATORY Op. 11.04.06 - TC 0606864". The table therefore combines a tariff classification, a textual description, an operative date reference and an internal transaction code.
- Legal effect timing: the Order "shall have effect from 11.04.06" and "continue in force until revoked under sections 269SC or 269SD of the Act, or the date, if any, specified in Column 2" (first paragraph).
- Schedule linkage: Column 2 records the Schedule 4 item number as "50". The table header shows Column 2 is "Schedule 4 Item Number Last date of effect", and no last date is supplied for this item.
Mechanically, therefore the Order attaches (from 11 April 2006) the Part III Schedule 4 item numbered 50 to goods that match tariff classification 8474.10.00 and the description "SCREENS, VIBRATORY". The Order remains in force indefinitely unless either statute-authorised revocation occurs under sections 269SC or 269SD, or the Table had specified a finite last date in Column 2 (which it does not). The instrument is identified by TC 0606864 and marked as "Op. 11.04.06", with the delegate signing on 07 July 2006.
