What it does
This instrument is a Tariff Concession Order (TCO) numbered 0605442 made under section 269P of the Customs Act 1901. Its operative statement declares that the goods described in Column 1 of the Table in the Order are “goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of THE TABLE applies.” The text specifies that the Order “shall have effect from 15.03.06 and continue in force until revoked under sections 269SC or 269SD of the Act, or the date, if any, specified in Column 2.”
Mechanically, the document does three things within its own text:
- Identifies a customs classification code, 8515.90.00, and attaches a detailed descriptive list of parts for welders that qualify under the Order (Column 1).
- Identifies the Schedule 4 item applicable to those goods in Column 2 (displayed in the Table as “50”), and leaves the “Last date of effect” cell empty in the Table.
- Records administrative metadata: operative date (Op. 15.03.06), TCO number (TC 0605442), and the delegate who signed the Order (Paul Mercer, dated 26 May 2006).
The Order therefore designates a defined set of goods , enumerated parts for welders under tariff classification 8515.90.00 , as falling within the scope of a particular item listed in Part III of Schedule 4 to the Customs Tariff Act 1995. The Order does not itself reproduce the text of the Schedule 4 item, nor does it state tariff rates, fiscal outcomes, or penalty provisions. It does, however, fix an operative commencement date and an administrative mechanism for termination , namely revocation under sections 269SC or 269SD of the Customs Act 1901, or expiry if a date is specified in Column 2 (no date is shown on the face of this Table).
The instrument is an administrative act: it is signed by a named delegate of the Chief Executive Officer and carries the reference “Op. 15.03.06 - TC 0605442.” The Order is a tool that prescribes how customs authorities are to treat the specified goods for the purpose of the Schedule 4 item referenced.
