What it does
The Tariff Concession Order 0605441 is a delegated instrument made under section 269P of the Customs Act 1901, by a delegate of the Chief Executive Officer (Paul Mercer, dated 26 May 2006). The Order declares that the goods described in Column 1 of the Table are "goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of THE TABLE applies." The instrument records an operative date of 15.03.06 (Op. 15.03.06) and carries the administrative identifier TC 0605441.
Mechanically, the Order performs a single, targeted legal act: it identifies certain goods by tariff classification and descriptive list and attaches (or declares the applicability of) a particular item in Part III of Schedule 4 of the Customs Tariff Act 1995 to those goods. The Table in the Order provides the tariff classification 8468.90.00 and a detailed enumeration of parts described as "PARTS, WELDERS, being ANY of the following" followed by items (a) through (ag), for example nozzles, tips, contacts, guns, torches, electrodes, housings, printed circuit boards, rotors, stators, heads and others. In Column 2 the Table shows the Schedule 4 item number "50" and does not display a separate last date of effect. The Order states it "shall have effect from 15.03.06 and continue in force until revoked under sections 269SC or 269SD of the Act, or the date, if any, specified in Column 2."
The instrument therefore changes the legal status of the listed goods for the purposes of whatever consequences flow from the application of the specified Schedule 4 item. The Order itself does not recite the substantive economic or tariff consequences that follow from a Schedule 4 item being applicable; it records the declaration that the goods are to which that item applies, the operative date, the TCO number, and the delegate's signature and date.
