TAFE SA Regulations 2026

The regulations rest on a small set of core legal concepts that structure rights, obligations and administrative discretion. Each concept is implemented by specific rules that determine practical outcomes for employees and TAFE SA.

Prescribed employee. The term is central. Regulation 3 lists eligible classifications (Lecturer, Lecturer's Assistant, Educational Manager) and limits "prescribed employee" to ongoing or term basis employees, not casuals paid by the hour. This classification scope determines who benefits from these regulations and who remains within other industrial frameworks.

Chief Executive discretion and board determination. The Chief Executive has wide powers: appointment to classification levels (reg 5(1)), granting or withholding permission for outside employment (reg 35), requiring medical examinations (reg 41(1)), determining remuneration for temporary duties not covered by an award (reg 22), and recovery of overpayments (reg 26). The board can make determinations about qualifications for appointment (reg 5(2)) and leave entitlements (regs 10(1)(b), 12(1)(b)), but those determinations are limited by floors: they cannot be less favourable than the entitlements under any applicable industrial award or agreement (regs 10(2)(b), 12(3)(b)). The interaction means operational policy is split between executive HR discretion and board‑level determinations, with statutory floors tied to industrial instruments.

Award and agreement overlay. The regulations explicitly reference "industrial award or agreement" as a baseline for entitlements to recreation leave and non‑attendance days (regs 10(1)(a), 12(1)(a)). Where the board issues a determination, it cannot cut below the award entitlements (regs 10(2)(b), 12(3)(b)). This creates a two‑tier constraint where external industrial instruments shape minimum entitlements while internal determinations can extend benefits, specify conditions and differentiate by class of prescribed employees (regs 10(2)(a), 12(3)(a)).

Leave accounting and conversion rules. The rules set precise accrual rates and conversion mechanics. Sick leave credits are specified in duty hours, with different accrual for Lecturers and Lecturer's Assistants (reg 13(2)-(3)), and procedural requirements for medical certification (reg 13(7)-(9)). Recreation leave accrues annually and must generally be taken within 1 year of accrual unless authorised otherwise (reg 10(6)). Non‑attendance days also accrue and must be taken within 1 year (reg 12(5), 12(7)). Special leave categories carry distinct rules and caps, for example infectious disease special leave not exceeding 52 weeks for any one disease and not debited against sick leave (reg 15(2)-(3)).

Pay mechanics and adjustments. Acting appointments trigger temporary salary and increment entitlements after one week, and non‑attendance day entitlements after three months (reg 8(2)). The Chief Executive may set commencing incremental salary above normal starting points (reg 23). Increments can be withheld if resignation or retirement takes effect on 31 January in specified circumstances (reg 24). Absence without proper cause can lead to pro rata reduction in remuneration calculated to hourly fractions (reg 25).

Review and dispute paths. The regulations create a two‑stage dispute route. First, an aggrieved prescribed employee may apply to the Chief Executive for review within 28 days (reg 29(1)-(2)). Second, if unsatisfied by the Chief Executive's review decision, the employee may apply to SAET within 14 days (reg 29(4)), except for initial employment or promotion decisions which are excluded (reg 29(5)). Additional protections include suspension of further administrative action while SAET proceedings are underway (reg 31) and suspension of internal proceedings while criminal charges are determined (reg 32(1)). Selection of supplementary panel members for SAET is constrained to avoid appointing someone who took the action under review (reg 30).

Mobility and limitations on external activities. Prescribed employees can be required to serve anywhere in the State (reg 33). Outside remunerative employment requires Chief Executive permission and may be withdrawn; the Chief Executive must consider hours, effect on performance and conflicts of interest (reg 35(1)-(3)).

Procedural and administrative details. The regulations standardise forms and notice procedures. Applications for leave must be in an approved written form (reg 9(2)). Notices may be delivered in specified ways including personal delivery to place of employment or post to last known residential address (reg 42). The Chief Executive must consult the Union President before requiring a compulsory medical examination (reg 41(2)). The Union has a role in selecting panel members for Educational Manager appointments (reg 6(3)(b)) and in election processes for supplementary panel vacancies (reg 43).

These concepts create a regulatory architecture where statutory minima align with industrial instruments, administrative discretion is concentrated in the Chief Executive subject to some board determinations, and prescribed employee entitlements and duties are tightly specified in hours, days, and monetary formulas.

The regulations affect three categories of persons and several organisational actors, with distinct roles and exposures for each.

Prescribed employees. The primary class affected is the "prescribed employee" as defined in regulation 3. That term covers employees of the Chief Executive of TAFE SA employed on an ongoing or term basis in the classifications of Lecturer, Lecturer's Assistant, and Educational Manager. Casual employees paid by the hour are explicitly excluded by the definition. The body of the regulations prescribes the terms of their appointment, classification, leave, remuneration, duties and disciplinary processes. Practical consequences for prescribed employees include: eligibility for specific leave accruals (reg 10, 12, 13), obligations to obtain Chief Executive approval for outside remunerative employment (reg 35), and procedural routes for review of administrative decisions (reg 29).

TAFE SA Chief Executive. The Chief Executive is the central decision maker under the regulations. The Chief Executive may require pre‑employment evidence (reg 4), appoint and classify (reg 5), make acting appointments and determine their pay entitlements (reg 8), approve or require leaves (regs 9-18), determine remuneration for duties not covered by an award (reg 22), decide on commencing increment levels (reg 23), reduce remuneration for unauthorised absence or industrial action (reg 25), recover overpayments (reg 26), approve travel and removal expenses subject to public service rates (regs 27-28), order compulsory medical examinations (reg 41), and make determinations for retrenchment (reg 40). The regulations give the Chief Executive broad managerial discretion, with some checks such as board determinations and limits that leave entitlements cannot be reduced below award levels (regs 10(2)(b), 12(3)(b)). The Chief Executive also carries the administrative burden of implementing the forms, notice processes and decision logs called for in the regulations.

The board of TAFE SA. The board is tasked with setting qualifications for appointment (reg 5(2)) and may make determinations in relation to recreation leave and non‑attendance days (regs 10(1)(b), 12(1)(b)). The board can specify conditions applicable to these entitlements (reg 12(2)). Board determinations may relate to specific classes of prescribed employees (regs 10(2)(a), 12(3)(a)), and the board may determine that certain employees are subject to Public Service hours and entitlements (reg 19). The board therefore influences policy settings on conditions, though subject to statutory minimums and executive administration.

The Union. The regulations name the South Australian Branch of the Australian Education Union as "the Union" (reg 3) and give it institutional roles. The Chief Executive must invite Union representation to the committee that recommends on Educational Manager appointments; the Union supplies a panel from which the Chief Executive selects the Union representative, and that panel must be reviewed at least every three years (reg 6). The Chief Executive must consult the President of the Union before requiring compulsory medical examinations (reg 41(2)). The Union is also the agent for holding and supervising elections for supplementary panel members where vacancies occur, and the Branch Returning Officer administers nominations and elections per reg 43. The regulations therefore create formal participation and limited veto points for the Union in employment governance.

SAET and external bodies. The South Australian Employment Tribunal (SAET) is the external tribunal to which prescribed employees can apply for review following an administrative review by the Chief Executive (reg 29(4)). The President of SAET must not select a panel member who took the action under review for proceedings sitting with supplementary panel members, per reg 30, which constrains SAET panel composition. The regulations also reference the Fair Work Act 1994 by defining "industrial award or agreement" as an award or agreement under that Act, which means entitlements under federal awards and agreements supply baseline conditions. The Family Relationships Act 1975 is used to define domestic partner in regulation 3.

Students and the public. Indirectly affected groups include students and the public to the extent that the regulations’ mobility and duty requirements (reg 33), restrictions on outside employment (reg 35) and impartiality of instruction (reg 36) shape the availability and conduct of staff. For example, reg 36 requires impartiality in discussing social, religious or political issues with students, which directly constrains classroom conduct.

Employers outside TAFE SA and external pay regimes. The regulations refer to Public Service rates for travel reimbursement (reg 27(2)) and permit the Chief Executive to declare certain employees subject to Public Service hours and conditions (reg 19). Where board determinations are made, they must not provide leave entitlements less than those under an applicable industrial award or agreement, so private or federal industrial settings influence internal entitlements.

Who pays and who decides. TAFE SA, via the Chief Executive and ultimately funded by Government appropriation, bears the direct payroll, leave, travel and removal cost obligations specified in the regulations, including medical expenses for applicants (reg 4(2)), reimbursement of travel at Public Service rates (reg 27), and payment when acting appointments trigger higher salaries (reg 8(2)). The Chief Executive decides most operational matters, the board sets some qualification and policy determinations, and SAET or industrial instruments act as external adjudicators or benchmarks.

In short, the regulations centrally affect prescribed employees and assign concentrated decision-making power to the Chief Executive, with the board and Union given defined participatory roles and external industrial instruments and SAET providing constraints and review pathways.

This section collates the principal enforceable duties imposed on prescribed employees and the reciprocal rights that the regulations guarantee, with precise references to the supporting provisions.

Duties of prescribed employees

• Obligation to serve where required. A prescribed employee "must, at any time during their service, serve in such part of the State as the Chief Executive may require" (reg 33). This gives TAFE SA the power to direct geographical mobility within the State.
• Compliance with the regulations and board determinations. Employees "must comply with these regulations, and any determination of the board under these regulations, as in force from time to time" (reg 34). This is a catch‑all duty aligning employee conduct to both statutory and board policy.
• Outside employment restrictions. A prescribed employee must not engage in remunerative employment or in an occupation or business outside TAFE SA unless they are part‑time or have obtained the Chief Executive's permission; that permission may be withdrawn at any time (reg 35(1)-(2)). When deciding permission, the Chief Executive must have regard to hours, effect on performance, and conflict of interest potential (reg 35(3)).
• Impartial instruction. When discussing social, religious or political issues with students, employees must present those issues impartially (reg 36). This is a duty that constrains pedagogical conduct.
• Do not seek political intervention. Employees must not seek political intervention to obtain an unfair advantage in appointment, reclassification, transfer or other employment aspects (reg 37).
• Restrictions on incurring liability. Employees must not incur liability or make or alter contracts on behalf of TAFE SA without prior written authority of the Chief Executive (reg 38).
• Requirement to accept medical examination. If required by the Chief Executive, an employee must submit to examination by a legally qualified medical practitioner selected by the Chief Executive, subject to consultation with the Union (reg 41(1)-(2)).

Rights of prescribed employees

• Appointment protections. Where an employee resigns to contest parliamentary election under specified timing conditions and is unsuccessful and reapplies within 2 months, the Chief Executive must re‑employ the person without probation at their prior classification and salary level (reg 7(1)). For continuity purposes the period of resignation is treated as leave without pay and the person is taken not to have resigned (reg 7(2)).
• Leave entitlements. Detailed leave rights include recreation leave as specified in applicable industrial awards or agreements or in a board determination that cannot be less than award entitlements (reg 10(1)-(3)); recreation leave loading at 17.5% for the first 4 weeks in a TAFE year subject to caps and conditions (reg 11); non‑attendance days per award or board determination (reg 12); substantive sick leave credits with formulae in duty hours and procedural conditions for medical certification (reg 13); special leave up to 15 duty days with pay for reasonable cause in a TAFE year (reg 14); special leave for infectious diseases where the Chief Executive is satisfied it was probably contracted at work, not debited against sick leave and capped at 52 weeks for a disease (reg 15); special leave for war service disabilities with accrual rules and caps (reg 16); and maternity leave rules and return rights, including right to resume prior position unless otherwise agreed (reg 17).
• Acting appointment entitlements. If appointed in acting capacity to a higher classification, entitlement to the higher salary and increments applies after acting for more than 1 week, and entitlement to non‑attendance days applies after more than 3 months (reg 8(2)). Periods of acting service count as service at the higher level if the employee is later appointed to that level (reg 8(3)).
• Remuneration protections. When temporary duties are not covered by an award, the Chief Executive may determine remuneration (reg 22). The Chief Executive may set commencing salary at a higher increment despite lack of formal qualification or experience (reg 23).
• Procedural review rights. Employees aggrieved by an administrative act may seek internal review by the Chief Executive within 28 days (reg 29(1)-(2)), receive written notification of the outcome (reg 29(3)), and then, where applicable, apply to SAET within 14 days (reg 29(4)). The regulation prohibits SAET review of initial employment or promotion decisions (reg 29(5)). Further, if SAET proceedings are underway, the Chief Executive must take no further action in respect of the matter until SAET determines it (reg 31).
• Protections in criminal contexts. Where a prescribed employee is criminally charged, proceedings by the Chief Executive or SAET arising out of the incident must be suspended pending the criminal proceedings, although suspension of the employee is still permissible (reg 32).

Enforceable pay and administrative remedies

• Salary reduction for unauthorised absence or industrial action. The Chief Executive may reduce remuneration by one seventieth (or one seventy‑fifth for Lecturer's Assistant) of fortnightly salary per hour or part hour absent or not discharging duties (reg 25).
• Recovery of overpayments and failure to give notice. TAFE SA may require repayment of remuneration wrongly paid and recover it as a debt in default (reg 26). If an employee resigns without giving required notice, the Chief Executive may require payment up to six weeks or two weeks salary depending on context; failure to pay may be recovered as a debt (reg 39(4)-(5)).
• Retrenchment entitlements. Employees retrenched for reasons of diminished volume of work and economy are entitled to at least 12 weeks written notice or payment in lieu for shortfalls (reg 40(2)).

Procedural duties on the employer and institutional actors

• Payment of applicant medical expenses. TAFE SA must pay the medical expenses incurred by an applicant who is required to provide a medical certificate under reg 4(2).
• Consultation before compulsory medical exam. The Chief Executive must consult the President of the Union before requiring a compulsory medical exam (reg 41(2)).
• Notification modes. Notices and other written notifications must be delivered by permitted methods, such as personal service, delivery to place of employment or post to last known address, with specifics for notices to the Minister, Chief Executive or TAFE SA (reg 42).

These duties and rights create a comprehensive scheme balancing managerial discretion to run operations and personnel policy, with a set of specified entitlements and review rights for prescribed employees. The rules are expressed with precise quantitative metrics for leave and pay adjustments, and embed industrial award baselines and SAET review as external constraints.

The regulations establish several mechanisms to enforce obligations, impose financial consequences for non‑compliance by employees, and provide procedural constraints protecting employees during dispute resolution. The enforcement architecture rests on administrative remedies, payroll deductions, debt recovery, and suspension powers.

Administrative reductions in remuneration. Regulation 25 authorises the Chief Executive to reduce a prescribed employee’s remuneration for unauthorised absences from duty or failure to discharge duties because of industrial action. The reduction is precisely quantified as one seventieth of fortnightly salary for each hour or part‑hour of absence, or one seventy‑fifth for Lecturer’s Assistants. This provides an objectively calculable penalty that can be applied without separate disciplinary proceeding, so long as the Chief Executive determines absence lacked proper cause or was related to industrial action.

Recovery of overpayments and debt recovery. Regulation 26 gives the Chief Executive the right to require repayment of remuneration that the employee "has in any circumstances received" but was not entitled to, and, on default, to recover the amount as a debt due and owing by the employee to TAFE SA. Similarly, regulation 39(4) allows the Chief Executive to require an employee who resigns without providing the required notice to pay up to six weeks' salary (or two weeks where applicable). In both cases the enforcement route is civil recovery of a debt coupled with payroll deductions or legal action if necessary.

Suspension and procedural timing. Regulation 31 prevents the Chief Executive from taking further action against an employee in respect of a matter while SAET is hearing review proceedings, which functions as a de facto stay on administrative penalty action pending tribunal determination. Regulation 32(1) requires suspension of internal or SAET proceedings arising from a charged incident while criminal charges are pending, although section 32(2) allows suspension of the employee where necessary pending the outcome of all proceedings. These provisions limit immediate employment‑based penalties while external adjudication is underway, but allow for pre‑emptive suspension in appropriate circumstances.

Retrenchment process and remedy. Regulation 40 provides an administrative path to retrenchment where volume of work has diminished and reduction in staff is necessary in the interest of economy. The Chief Executive issues a written determination specifying date of retrenchment (reg 40(1)). The employee is entitled to at least 12 weeks' notice or pay in lieu equal to the shortfall (reg 40(2)). The obligation to pay notice or provide equivalent pay is a statutory remedy for retrenched employees.

Medical examination and labour governance. Regulation 41 permits the Chief Executive to require a compulsory medical exam by a practitioner selected by the Chief Executive, subject to prior consultation with the Union (reg 41(1)-(2)). The cost is borne by TAFE SA (reg 41(3)(a)). The medical practitioner must, if requested, consult another practitioner nominated by the employee or family (reg 41(3)(b)). Enforcement here is administrative: the employee "must" submit if required, and failure to do so could be treated as non‑compliance with duties.

Disciplinary process limitation and review rights. The regulations provide a two‑stage review process (reg 29). Internal review by the Chief Executive must be sought within 28 days (reg 29(2)). Subsequent application to SAET must be made within 14 days of the Chief Executive’s notified decision (reg 29(4)). Notably, the right to apply to SAET does not extend to decisions concerning initial employment or promotion (reg 29(5)). These time limits operate as procedural preconditions to court or tribunal intervention; failure to adhere will likely preclude later review.

Operational remedies for leave and absence. Regulation 20 provides that failure to resume duty after leave or non‑attendance days means the employee is taken to be absent without proper cause, which can trigger the remedies in regulation 25 (salary reductions), recovery of overpayments (reg 26), or disciplinary measures. Regulation 13(9) also converts absent periods without required medical evidence into leave without pay.

Constraints and checks. Several statutory limits constrain executive enforcement discretion. Board determinations on leave cannot provide entitlements less than those under an applicable industrial award or agreement (regs 10(2)(b), 12(3)(b)). SAET panel composition for proceedings with supplementary members cannot include the person who took the action under review (reg 30). The Chief Executive must consult the Union before ordering medical examinations (reg 41(2)). These constraints create procedural guardrails around enforcement.

Practical enforcement exposures. The enforcement framework places the burden of calculating and effecting pay reductions and recoveries on the Chief Executive and payroll administration. It also requires timely handling of review applications under strict deadlines. Failure to observe review timelines, or to follow notice and consultation obligations (for example reg 41(2)), could expose TAFE SA to procedural challenge through SAET or other avenues permitted by the South Australian Employment Tribunal Act 2014.

In sum, the regulatory package combines financial penalties (pay reductions, debt recovery, notice‑in‑lieu), administrative powers (suspension, compulsory medical examination, retrenchment determinations), and procedural limits on further action while external proceedings run. Enforcement is concentrated in the Chief Executive with statutory checks via board minima, Union consultation and SAET review pathways.

The regulations explicitly reference and interact with several other legislative instruments, creating normative linkages and external constraints that shape entitlements and dispute resolution.

Industrial instruments under the Fair Work Act 1994. The regulations define "industrial award or agreement" as an award or agreement under the Fair Work Act 1994 (reg 3). This definition imports federal industrial instruments into the baseline of rights for recreation leave and non‑attendance days by specifying that entitlements are "such as are specified in an applicable industrial award or agreement" unless a board determination provides otherwise (regs 10(1)(a), 12(1)(a)). The board's determinations cannot provide for leave entitlements that are less than those which would apply under an applicable industrial award or agreement (regs 10(2)(b), 12(3)(b)). Consequently, federal award/agreement entitlements operate as statutory floors for those categories of leave, and TAFE SA policies and board determinations must be designed to at least match them.

South Australian Employment Tribunal Act 2014 and SAET. Regulation 29(4) provides an explicit route for a prescribed employee aggrieved by an administrative act or decision of the Chief Executive to apply to SAET under Part 3 Division 1 of the South Australian Employment Tribunal Act 2014 for review. Regulation 30 supplements the SAET interaction by instructing the President of SAET not to select a person who took the action under review as a supplementary panel member where SAET sits with supplementary panel members for particular proceedings, referencing section 18(2) of the Technical and Further Education Act 1975. Regulation 31 requires the Chief Executive to take no further action against an employee in respect of the matter while SAET hears review proceedings, creating an operational stay effect complementary to SAET jurisdiction. These provisions situate the regulations within the SAET dispute resolution architecture and impose procedural timelines for internal and external review (reg 29(2), 29(4)).

Technical and Further Education Act 1975. Regulation 30 cites section 18(2) of the Technical and Further Education Act 1975 in relation to SAET sitting with supplementary panel members, and regulation 43 addresses election of officers as supplementary panel members under section 18(1)(b) of that Act. Regulation 18 refers to "prescribed employment (within the meaning of section 23(2) of the Technical and Further Education Act 1975)" for purposes of sick leave continuity rules (reg 13(5)(f)). These cross‑references embed the regulations in the statutory ecosystem governing TAFE institutions and the composition and role of supplementary panels.

Family Relationships Act 1975. The definition of "domestic partner" at regulation 3 is expressly tied to the Family Relationships Act 1975, whether declared under that Act or not. That definition determines who can be considered a domestic partner for removal expense and survivor provisions under regulation 28(4).

Public Service conditions and rates. Regulation 19 allows the Chief Executive to declare certain prescribed employees subject to Public Service hours, recreation leave, non‑attendance days and overtime conditions if the duties do not justify the usual TAFE hours and leave, which can cause an employee’s conditions to shift to those applicable to Public Service employees. Regulation 27(2) requires travel reimbursement "at the same rate as would be applicable to a Public Service employee", unless special circumstances justify a different rate. These links mean that the Public Service award or instrument and the administrative framework for Public Service employees act as a comparative or operational benchmark.

Criminal law and procedural suspension. Regulation 32(1) mandates suspension of proceedings by the Chief Executive or before SAET arising out of an incident that is the subject of a criminal charge, pending the determination of the criminal proceedings. Regulation 32(2) allows suspension of the employee in the meantime. This creates a formal interaction between criminal process and employment disciplinary or administrative proceedings.

Previous TAFE regulations repealed. Schedule 1 repeals the TAFE SA Regulations 2012. The new regulations therefore supersede and replace the prior subordinate law for these matters; continuity clauses and references to "previous regulations" (reg 3) preserve certain existing concepts (for example leave debits under previous regulations as a factor for sick leave credits, reg 13(2)-(3)).

Implications of the interactions

• Regulatory floors and bargaining. The imported role of awards and agreements as minimum entitlements for certain leave types creates a hybrid governance model: industrial bargaining and federal award settings retain a constraining influence over TAFE SA's internal determinations for those entitlements.
• Tribunal review and procedure. The SAET pathway is the designated external review mechanism for administrative decisions once internal review is exhausted, with prescribed time limits (reg 29(2), 29(4)). The regulations therefore channel disputes into SAET procedures rather than courts or other tribunals, subject to statutory exclusions.
• Administrative complexity. Cross‑referencing Public Service rates and award minima creates administrative dependencies, requiring TAFE SA to track external instrument changes. The definition of industrial award or agreement "as in force from time to time" (reg 3) means TAFE SA must monitor and implement changes to federal awards or agreements.
• Union role. The Chief Executive’s obligation to consult the Union before compulsory medical exams (reg 41(2)) and the Union’s role in supplying panels and running supplementary panel elections (regs 6 and 43) embed industrial relations participation into administrative processes.

Overall, the regulations are designed to operate within a layered legal environment where federal industrial instruments, SAET jurisdiction, Public Service comparators and existing TAFE statutory structures constrain and interact with the executive powers vested in the Chief Executive and the board.

The text supplied includes a limited legislative history element and a clear repeal of previous subordinate instruments. The key amendment and commencement facts set out in the text are:

• Principal regulations: TAFE SA Regulations 2026, Gazette citation 2026 No 10, Gazette 12 February 2026 p 246, with commencement on 1 March 2026 under regulation 2 (the regulations "come into operation on the day on which section 1 of the TAFE SA Act 2025 comes into operation" and the Gazette note states the commencement 1.3.2026: r 2). The legislative history entry at the end confirms the principal regulations and commencement.
• Repeal of prior instrument. Schedule 1 expressly repeals the TAFE SA Regulations 2012 (Schedule 1,Repeal of TAFE SA Regulations 2012; item 1). The regulations also define "the previous regulations" in reg 3 to mean a list of prior TAFE regulations going back to 1976, 1997, 1998, 1999 and 2012, signalling continuity in terms and concepts traceable to earlier instruments.
• No amending instruments contained. The provided document does not include subsequent amending regulations, ministerial determinations, or board determinations that would modify the 2026 regulations. There are no schedules of amendments beyond the express repeal in Schedule 1.
• No explanatory or second reading material included. The supplied text does not include an explanatory memorandum, second reading speech, or statement of compatibility, so the public legislative materials in this source are limited to the text of the regulations and the Gazette commencement note.

What the limited history tells practitioners and administrators

• One‑time consolidation. The repeal of the 2012 regulations in Schedule 1 indicates the 2026 regulations are meant to be the active, consolidated subordinate law governing prescribed employees. Entities must therefore treat the 2012 regulations as no longer in force from commencement.
• "As in force from time to time" references. Because the regulations refer to external instruments "as in force from time to time" (reg 3 for the Fair Work Act awards and agreements, and regs 10(1)(a), 12(1)(a) for award‑based entitlements), TAFE SA will need an operational practice to track updates to those instruments and to reflect the latest applicable entitlements in its determinations and payroll systems.
• Need to monitor board determinations. The regulations allow the board to issue determinations on recreation leave and non‑attendance days (regs 10(1)(b), 12(1)(b)). Because those determinations are not printed in the regulations provided, practitioners should verify whether any board determinations were made contemporaneously with or subsequent to the regulations to understand the complete set of entitlements that apply.
• Transitional considerations. Several provisions refer to leave taken "under these regulations or the previous regulations" when calculating credits such as sick leave (reg 13(2)-(3)). Administrators should ensure historical records of leave under prior regulations are retained and appropriately reconciled for continuity of service and leave credit purposes.

Absent from the supplied legislative history are any amendments after commencement, and no subordinate determinations or policy instruments issued by the board or Chief Executive are included. Users should therefore treat the 2026 regulations as the base text but must check official government legislative portals or TAFE SA administrative instruments for any subsequent board determinations, Chief Executive determinations, or amending regulations that modify leave entitlements, remuneration settings, or other operational details.

The supplied regulations text does not list or cite any cases, tribunal decisions, or judicial interpretations. There is no litigation history included in the document. The only dispute‑related references are procedural: the role of the South Australian Employment Tribunal (SAET) as the external review forum for administrative acts or decisions (reg 29(4)) and constraints on panel selection (reg 30).

What the absence of litigation references means for practitioners

• No statutoryly cited judicial gloss. The regulations are presented as a standalone statutory instrument without embedded case citations or identified judicial interpretations. Consequently, implementation and dispute handling must rely on the plain text and on procedures set out in the South Australian Employment Tribunal Act 2014 for SAET review.

• Areas with likely litigation risk or disputes, grounded in the text. While we must not invent cases, the regulations do create several points that typically generate contestation in employment disputes, and practitioners should be prepared for disputes in the following areas:

  • Chief Executive discretion over appointments and qualifications. Regulation 5 allows the Chief Executive to appoint a person lacking required board‑determined qualifications (reg 5(3)). Parties may dispute whether the exercise of such discretion was reasonable or consistent with board determinations, and such disputes would be routed through the internal review in reg 29 and then SAET per reg 29(4) where permitted.
  • Leave and conversion determinations. The detailed accrual and conversion rules for sick leave, special leave for infectious disease, and recreation leave create administratively precise formulas. Disputes about calculation, evidence (for medical certificates), and the application of conversion rules (for example converting recreation leave to sick leave under reg 13(10)) could give rise to SAET review.
  • Pay reductions and overpayments. Regulations 25 and 26 respectively permit pay reductions for unauthorised absence and recovery of wrongly paid remuneration. Disputes over whether absences were with proper cause or whether repayments are due and lawful could be litigated at SAET or otherwise contested as debt recovery claims.
  • Retrenchment and economy grounds. Regulation 40 provides for retrenchment determinations on grounds of diminished work volume and economy. Employees may dispute procedural fairness, adequacy of notice, or whether retrenchment criteria were met.
  • Compulsory medical examination. Regulation 41 permits compulsory medical examinations after consultation with the Union. Disputes may arise about the appropriateness of the requirement, selection of the medical practitioner, or procedural fairness of the consultation.

• Procedural prerequisites limit litigation scope. Regulation 29 requires internal review by the Chief Executive within 28 days before an application to SAET is available, and a subsequent SAET application must be lodged within 14 days of the Chief Executive's notified decision (reg 29(2), (4)). Failure to follow these steps will likely curtail tribunal review opportunities, which influences pre‑litigation strategy.

• Criminal proceedings suspension. Regulation 32(1) mandates suspension of internal and SAET proceedings arising out of an incident that is the subject of criminal charges until the criminal matter is determined. This procedural interaction typically delays employment adjudication and may influence settlement incentives.

Practical approach

Given the absence of historic tribunal or case law in the provided materials, practitioners should treat the regulations as the governing text and be ready to pursue SAET recourse where allowed. For issues likely to generate dispute, keeping contemporaneous decision records, rationales for exercise of discretion by the Chief Executive or board, and robust procedural compliance will be important evidence should the matter proceed to SAET or to civil recovery actions arising from debt claims under regs 26 and 39(5). Additionally, because the regulations incorporate external instruments and SAET procedures, practitioners should assess applicable award terms and the South Australian Employment Tribunal Act 2014 when preparing or defending a dispute.

The regulations are detailed and appear straightforward, but several drafting choices and operational rules are easy to overlook. This section highlights specific traps, timing constraints, and interpretive tension points that practitioners and HR officers should note, with direct textual references.

Time windows for review and SAET application. Regulation 29 creates two tight deadlines: internal review to the Chief Executive must be made within 28 days of the administrative act or decision (reg 29(2)), and an application to SAET must be lodged within 14 days after receiving written notification of the Chief Executive's review decision (reg 29(4)). Practitioners often miss the 28 day internal deadline, which in turn precludes later SAET review. Make calendar prompts and capture written notification dates.

Exclusions to tribunal review. Regulation 29(5) expressly bars SAET review for acts or decisions concerning initial employment or promotion. If a candidate challenges a recruitment or promotion outcome, the SAET route is closed by this provision; alternative dispute paths (such as industrial boards or grievance procedures under applicable awards) may be the appropriate channel. Practitioners must not assume SAET jurisdiction in these contexts.

Sick leave accounting in hours and quarters. Sick leave credits are specified in duty hours and debited in hours and quarters to the nearest quarter hour (reg 13(2)-(3)). For Lecturer's Assistants the accrual and crediting dates differ and include 45 and 90 duty hour credits depending on employment date (reg 13(3)). Payroll systems must account for these precise units and differing accrual regimes; failure to do so will cause miscalculation of entitlements and potential disputes.

Medical evidence thresholds and discretionary proof. The regulations allow the Chief Executive to require a medical certificate for absences exceeding 3 duty days (reg 13(7)), and to require evidence for absences of 3 duty days or less at their discretion (reg 13(8)). If the employee fails to provide required evidence, leave will be taken as leave without pay (reg 13(9)). This creates a discretionary evidence threshold that can lead to abrupt pay consequences. Practitioners should ensure employees are clearly notified of evidence requirements before deductions are applied.

Recreation leave and non‑attendance days must be taken within specified windows. Recreation leave must be taken within 1 year of accrual unless the Chief Executive approves otherwise, and in any case within 2 years from accrual (reg 10(6)). Non‑attendance days must be taken within 1 year of accrual (reg 12(7)). Employers who fail to manage leave calendars risk stacking liabilities or denying entitlements improperly.

Acting appointment entitlements conditional on time. Salary and increments for acting in a higher classification apply only after more than 1 week in the acting role (reg 8(2)(a)), and non‑attendance days only if the acting period exceeds 3 months (reg 8(2)(b)). Short acting stints thus do not trigger full entitlements. Ensure HR captures acting appointment start and end dates precisely to avoid under or overpayment.

Recreation leave loading limited and capped. The recreation leave loading is only 17.5% for the first 4 weeks' recreation leave commenced in a TAFE year (reg 11(2)(a)), applies only to employees employed for the whole TAFE year unless the Chief Executive authorises a proportionate payment (reg 11(2)(c), 11(4)), and cannot exceed the Public Service maximum that would be payable to a Public Service employee (reg 11(3)). Employers must apply these multiple caps and eligibility tests when calculating leave loading.

Special leave for infectious disease limited and conditional. Special leave with pay for infectious disease must be granted only if the Chief Executive is satisfied the disease was "probably contracted by the employee while on duty or as a result of the employee's contact with the students or staff of TAFE SA" (reg 15(1)). This is a causation threshold that may be difficult to establish and open to dispute; the leave is not debited against sick leave and is capped at an aggregate 52 weeks per disease (reg 15(2)-(3)). Practitioners should document causal assessments and medical evidence carefully.

Compulsory medical exam process requires Union consultation. The Chief Executive must consult with the President of the Union before requiring a compulsory medical examination (reg 41(2)). Failing to consult could be argued as procedural defect. The employer pays for the examination and must allow the examining practitioner to consult another practitioner nominated by the employee if requested (reg 41(3)(a)-(b)). These protections reduce the risk of unilateral medical determinations but create process obligations for the employer.

Travel and removal expenses reference Public Service rates. Regulation 27(2) and parts of regulation 28 tie reimbursements to the rates applicable to Public Service employees, unless the Chief Executive authorises otherwise (reg 27(2); reg 28(7)). TAFE SA must have clarity on the current Public Service rates and the basis for any deviations.

Outside employment permission is revocable and subject to broad considerations. Permission can be withdrawn "at any time" (reg 35(2)), and the Chief Executive must consider factors including hours, effect on performance and conflicts of interest (reg 35(3)). Employees engaged in ancillary work should secure explicit written permission and be prepared for revocation.

Resignation notice and potential debt. Employees must give six weeks' notice (reg 39(1)), subject to specified exceptions with two weeks' notice (reg 39(2)). Failure to give proper notice can generate a recoverable debt of up to six weeks' salary (reg 39(4)-(5)). Ensure resignation processes capture dates and notice waivers correctly to avoid contested recovery actions.

Retrenchment requirements for economy. The Chief Executive may retrench where the volume of work has diminished and reduction is necessary "in the interest of economy" (reg 40(1)(a)-(b)). The statutory language leaves operational judgment to management; however, retrenchment decisions must be documented and notice provisions observed (reg 40(2)). Employees may challenge the factual basis or procedural fairness within the review mechanisms available.

Notice and delivery formalities. Regulation 42 specifies permitted methods for giving notice, including personal delivery to the employee's place of employment or post to their last known residential address (reg 42(b)(i)-(ii)). Failure to use an authorised method may render a notice ineffective, so HR teams should follow the prescribed modalities.

Union panel and appointment committees. For Educational Manager applications, the committee must include at least one representative of TAFE SA and at least one representative of the Union appointed by the Chief Executive from a Union‑supplied panel, and the panel must be reviewed by the Union every three years (reg 6(3)-(4)). Failure to adhere to these composition rules may expose appointment processes to challenge.

Taken together, these "gotchas" are textual details that create timing traps, procedural preconditions, or discretionary thresholds that can convert routine HR actions into contested disputes if not administratively managed and documented.

This section provides a practical compliance checklist and operational recommendations grounded in the textual requirements of the TAFE SA Regulations 2026. Each item maps to the relevant regulation or set of regulations.

Governance and policy alignment

• Review applicable industrial awards and agreements. Because recreation leave and non‑attendance days are measured against "an applicable industrial award or agreement" (reg 10(1)(a), 12(1)(a)) and board determinations cannot undercut award minima (regs 10(2)(b), 12(3)(b)), TAFE SA must maintain an up to date register of relevant awards and enterprise agreements. Assign responsibility to a legal or HR officer to track changes to those instruments "as in force from time to time" (reg 3).
• Board determinations inventory. The board may issue determinations about recreation leave and non‑attendance days (regs 10(1)(b), 12(1)(b)). Maintain a publicised, dated register of any board determinations and ensure employees can access them. Confirm that board determinations do not provide entitlements less than award minima.

Recruitment and appointment processes

• Pre‑employment documentation. Incorporate the documents the Chief Executive may require into the application process: certified birth extract or satisfactory evidence of age, medical certificate of sound health or other medical evidence as required, and documentary evidence of qualifications and experience (reg 4(1)). Ensure TAFE SA pays any medical expenses for applicants under reg 4(2), and capture receipts.
• Committee composition for Educational Manager. For Educational Manager appointments, establish the selection committee per reg 6, ensuring at least one TAFE SA representative and at least one Union representative from a panel supplied by the Union managing committee. Maintain records of the panel and ensure it is reviewed by the Union at least every three years (reg 6(4)).

Employment classification and acting appointments

• Classification records. Maintain clear records of each employee’s classification level and any board‑determined qualification requirements (reg 5(1)-(2)). If the Chief Executive appoints without required qualifications (reg 5(3)), document the reasons for the exception.
• Acting appointment monitoring. When making acting appointments, record start and end dates precisely. Trigger payroll changes to pay higher salary/increments if acting exceeds one week (reg 8(2)(a)), and to apply higher classification non‑attendance days if acting exceeds three months (reg 8(2)(b)). If an acting employee is later appointed to the level, ensure service in acting capacity is counted for salary and promotion purposes (reg 8(3)).

Leave administration

• Standardised leave application forms. Require written applications in Chief Executive approved forms for leave or non‑attendance days (reg 9(1)-(2)). If applications cannot be made by the employee, accept properly authorised applications by a colleague at the workplace (reg 9(3)).
• Recreation leave tracking. Track annual accrual and use for recreation leave, ensure part‑time employees receive pro rata leave (reg 10(3)). Enforce take‑within windows: leave accrued must be taken within one year, or within two years if special approval is given by the Chief Executive (reg 10(6)). If the Chief Executive requires an employee to take recreation leave, pro rata leave applies if they have not completed a year of service (reg 10(5)).
• Recreation leave loading. For eligible employees, calculate a 17.5% loading on salary for the first 4 weeks’ recreation leave commenced in the TAFE year, subject to caps that align with the Public Service maximum (reg 11(2)(a), 11(3)). Establish policies for proportionate payment to employees not employed for the whole TAFE year if authorised by the Chief Executive (reg 11(4)). Include Whyalla cost of living loading and other relevant allowances in the salary base as specified (reg 11(5)).
• Non‑attendance days management. Accrue non‑attendance days annually per awards or board determinations, apply pro rata for part‑time employees, and require use within one year of accrual (reg 12(4)-(7)). Track board determinations that may specify conditions (reg 12(2)).
• Sick leave recordkeeping. Implement leave credits and debits in duty hours and to the nearest quarter hour (reg 13(2)-(3)). Record initial credits and annual credits on the dates specified, and reduce credits appropriately for leave without pay or part pay as determined by the Chief Executive (reg 13(5)(b)-(c)). Require medical certificates for absences exceeding 3 duty days and set internal procedures for discretionary evidence for shorter absences, with notice to employees that failure to provide evidence will result in the leave being treated as leave without pay (reg 13(7)-(9)). Keep medical evidence confidential and compliant with privacy requirements.
• Special leaves. Implement procedures for special leave with pay up to 15 duty days in a TAFE year when reasonable cause exists (reg 14(1)). For infectious disease special leave, establish a clear causal assessment process to determine whether the disease was "probably contracted" on duty, and apply the 52 week cap per disease (reg 15(1)-(3)). Document approvals and medical certificates.
• Maternity leave process. Accept applications specifying period and accompanied by a medical certificate, grant unpaid maternity leave in accordance with reg 17(1)-(4), and require the employee to provide at least 4 weeks' written notice before resuming duty (reg 17(5)). On return, reallocate the employee to the position held at the time of commencing leave unless an agreement provides otherwise (reg 17(6)).

Remuneration and payroll controls

• Temporary duties pay. For temporary duties not covered by an award, document the Chief Executive's determination of remuneration and the basis for the determination, per reg 22.
• Commencing increments. Record reasons for commencing salary at a higher increment when exercised under reg 23.
• Pay reduction administration. Create a clear policy for calculating pay reductions under reg 25, converting hourly absences to the one seventieth or one seventy‑fifth fraction of fortnightly salary as applicable. Include reviews and appeal steps in the payroll deduction process.
• Overpayment recovery. When recovering remuneration under reg 26, provide employees written notice and an opportunity to respond before initiating recovery as debt, and maintain documentation that supports the calculation of the overpayment.
• Travel and removal expenses. Reimburse travel at Public Service rates unless special circumstances justify a different rate and the Chief Executive authorises it (reg 27(2)). For removal expenses tied to transfers, apply the entitlement limits and exceptions, including the three year satisfactory service test for transfer solely at the employee’s request (reg 28(1)-(2)). Record approvals for depreciation allowances and travel allowance in lieu of expenses where authorised (reg 28(5)-(7)).

Dispute resolution and disciplinary steps

• Internal review clock. When an employee applies for internal review under reg 29, ensure the application is filed within 28 days of the act or decision and keep a strict timeline for the Chief Executive’s review and notification to the employee (reg 29(2)-(3)). Maintain a standard form and acknowledgement process.
• SAET readiness. If internal review results are adverse and the matter is reviewable, provide the employee with written notification and the pathway to SAET within the 14 day external application window (reg 29(4)). Preserve documents and contemporaneous decision rationale since SAET will request records.
• Suspension and criminal charges. When criminal charges arise, suspend disciplinary or SAET proceedings per reg 32(1) but consider suspension of the employee under reg 32(2) where necessary. Consult legal counsel where criminal matters intersect with employment actions.

Procedural and consultative obligations

• Consultation with Union for medical examinations. Before requiring a compulsory medical exam, consult the President of the Union as required by reg 41(2). Record consultation notes and decisions including the medical practitioner selected and any employee‑nominated practitioners consulted (reg 41(3)).
• Notices and delivery. Use only the permitted delivery methods for notices under reg 42. For employee notices, use personal delivery to the place of employment or post to the last known residential address; keep proof of delivery.
• Union panels and elections. For supplementary panel vacancies follow the election procedure in reg 43 with the Branch Returning Officer publishing notices and administering nominations and elections. Ensure timelines for nominations (not less than 21 days after initial notice) are observed.

Recordkeeping and audit

• Leave, pay and medical records. Maintain auditable records of accruals, debits, payments, medical certificates, acting appointment dates, board determinations, and internal review materials. These will be critical for responding to SAET review and for enforcing pay adjustments or recoveries.
• Policy documents and staff training. Publish a staff handbook summarising key rights and duties under the regulations, including leave accrual rules, medical evidence requirements, outside employment procedures, resignation notice obligations, and the internal review process. Train managers on the exact thresholds (for example the one week and three month acting appointment triggers in reg 8) to avoid misapplication.

Compliance checks and ongoing monitoring

• Audit schedule. Conduct regular audits to ensure leave and pay calculations comply with the precise formulas in regs 10-13, 22-26. Reconcile leave credits recorded under prior regulations where continuity is claimed in reg 13(5)(f).
• Legal monitoring. Assign a legal or industrial relations officer to monitor changes to the Fair Work Act awards and agreements, Public Service pay and travel rates, and any relevant SAET decisions that may clarify interpretation or procedural requirements.

By mapping each compliance task to the relevant regulation and building operational processes to implement the discrete timelines and numeric formulas mandated in the regulations, TAFE SA and prescribed employees can reduce the risk of disputes and ensure consistent application of the statutory scheme.
