What it does
This Order, titled in the instrument as the Sydney Water (Stormwater Drainage Areas) Order 2011 (s 1), performs three discrete legal functions. First, it declares a set of geographic areas to be "stormwater drainage areas" for the express legal purpose of section 65(1) of the Sydney Water Act 1994 (s 5). Second, it repeals any earlier orders that were in force, or taken to be in force, under section 65 of the Act at the Order's commencement (s 4). Third, it defines the immediate interpretive terms used in the Order: map (meaning a map held in the office of Sydney Water Corporation) and the Act (meaning the Sydney Water Act 1994) (s 3). The Order commenced on 1 July 2012 (s 2). Schedule 1 lists each declared stormwater drainage area by name in Column 1 and identifies the specific map held by Sydney Water that shows the area edged heavy red in Column 2 (sch 1 (cl 5)).
Mechanically, the Order operates by making the listed catchments and named areas subject to the legal classification "stormwater drainage area" for the purposes of one statutory provision, section 65(1), of the Act. The Order does not itself set operational standards, obligations, fees, or enforcement mechanisms; those will, if applicable, be contained in the Act or in subsidiary instruments, policies or actions taken under the Act. The Order centralises the spatial authority in Sydney Water by defining the controlling map for each named area as the physical map for the purposes of the declaration (s 3, sch 1).
The Schedule is the operative geographic inventory. It itemises named catchments and identifies a corresponding map code for each (for example, "A’Becketts Creek Catchment , SWMAP0001-SW_046"). The Schedule also carries an amendment notation: "sch 1: Am 2022 (92), sec 3", indicating that Schedule 1 was amended in 2022 by an amending instrument recorded as number 92, section 3. The Order therefore functions as a consolidation and re-declaration instrument: it both restates the list of declared areas and displaces earlier orders under the same statutory head (s 4).
