#### 53 Disposal of proceedings for offences 53 Disposal of proceedings for offences > > (1) Proceedings for an offence against this Act or the regulations are to be disposed of summarily before— > > > > > (a) the Local Court, or > > > > > (b) the Land and Environment Court in its summary jurisdiction. > > > (2) The maximum monetary penalty that may be imposed by the Local Court in proceedings for an offence against this Act is 100 penalty units or the maximum monetary penalty for the offence, whichever is the lesser. > > > (3) Proceedings in the Land and Environment Court in its summary jurisdiction or in the Local Court in relation to an offence against this Act may be commenced not later than 12 months after the commission of the offence. > > **s 53:** Am 1999 No 85, Sch 2.66; 2003 No 55, Sch 1 \[2\] \[3\]; 2007 No 94, Sch 2.
