#### 18 Variation of the tunnelling site 18 Variation of the tunnelling site > > (1) The Governor may, by regulation, amend Schedule 3— > > > > > (a) by omitting any matter from that Schedule, > > > > > (b) by inserting in that Schedule any matter which describes any land that is, in the opinion of the Minister, necessary for inclusion within that Schedule for the purpose of enabling the Sydney Harbour Tunnel to be constructed in accordance with this Act, or > > > > > (c) by altering any matter contained in that Schedule. > > > (2) The Governor may, by regulation, omit Schedule 3 and insert instead a Schedule which describes any land that is, in the opinion of the Minister, necessary for inclusion within that Schedule for the purpose of enabling the Sydney Harbour Tunnel to be constructed in accordance with this Act. > > > (3) Such a regulation may not be made in contravention of the terms of any lease or licence entered into under an agreement referred to in section 6 (2).
