42Acting appointments

#### 42 Acting appointments (1) The Trust may appoint a person to act as the Executive Director for a period not exceeding 3 months: (a) during a vacancy in the office of Executive Director (whether or not an appointment has previously been made to the office); or (b) during any period when the Executive Director is absent from duty or from Australia, or is, for any reason, unable to perform the duties of the office. > Note: For rules that apply to acting appointments, see section 33A of the Acts Interpretation Act 1901. (2) If at the end of the 3 month period: (a) there continues to be a vacancy in the office of Executive Director; or (b) the Executive Director continues to be absent or unable to perform the duties of the office; then the Minister, on the recommendation of the Trust, may appoint a person to act as the Executive Director. > Note: For rules that apply to acting appointments, see section 33A of the Acts Interpretation Act 1901.
