Sydney Airport Curfew Regulations 2023

The Regulations rely on and interact with several core concepts taken from the Act and from the Civil Aviation Safety Regulations 1998 (CASR) as incorporated by reference. The main concepts in the instrument are:

• Prescribed numbers for quota operation: The Regulations supply the numerical parameters that the Act’s quota paragraphs use. Regulations 8 and 9 each say explicitly that they are prescribing a number "for the purposes of" particular paragraphs of the Act (regs 8(1)-(2); 9(1)-(2)). The instrument therefore functions as a set of parameter settings for the quota mechanism in the Act rather than as stand‑alone prohibitions or permissions.
• Time windows: The Regulations address two distinct time windows at Sydney Airport: the hour between 11 pm and midnight, and the hour between 5 am and 6 am (regs 8-9). For the former the prescribed numbers are zero; for the latter two distinct prescribed numbers are set (24 and 5). The way those numbers are allocated into the Act is by reference to the Act’s paragraph numbering; the Regulations do not restate the definitions of those paragraphs.
• Specified persons and per‑operator caps for BAe‑146: Subsection 13(1) and subparagraph 13(3)(a)(ii) of the Act are the hooks used. The Regulations specify five legal persons for s 13(1) (reg 10). They then subdivide the BAe‑146 upper limit among those operators with specific numeric caps (reg 11). One operator, Virgin Australia Airlines Pty Ltd, is allocated 0 BAe‑146 movements under the per‑operator split.
• Administrative lodgement: Regulation 7 prescribes a postal address to satisfy the Act’s requirements that returns be given to an authorised person under subsections 8(3) and 9(3) of the Act. The instrument also notes that, under the Act, a return must be given to an authorised person and cross‑references the Act for definition of authorised person (reg 7, note).
• Definitional linkage to CASR: Regulation 6 supplies a definition for the Act’s definition of "air traffic controller" by referencing authorisation under Subpart 65.B of CASR 1998. The Regulations therefore extend the parent statute’s terminology into the civil aviation regulatory framework rather than redefining it afresh.

These are the conceptual building blocks the Regulations provide: numerical quotas keyed to the Act’s sections; named operators who are treated specially for BAe‑146 movements; an administrative address for returns; and a definitional reference to CASR for air traffic controllers. The instrument is not a policy statement; it is a calendared, numeric and administrative adjustment to the enforcement/operational mechanics of the parent Act.

The Regulations create concrete effects for a limited set of actors. The text identifies, by reference and by name, who is directly implicated; other impacts flow indirectly through the Act’s enforcement machinery. Based on the instrument, the affected parties are:

• Aircraft operators generally who use Sydney Airport during the curfew hours that the Act regulates. Because the Regulations prescribe numbers for paragraph 12(8) and paragraph 12(9) of the Act, any party whose operations depend on slots or entries under those paragraphs will be subject to the numerical limits set out (regs 8-9). The instrument does not itself name all affected operators, but the quota settings will be applied under the Act to operators who would otherwise seek to take off or land in the specified hours.
• The five specified legal persons listed in regulation 10 in relation to aircraft of the type known as BAe‑146: National Jet Express Pty Ltd; Pionair Australia Pty Ltd; Qantas Airways Ltd; IPEC Pty Ltd; and Virgin Australia Airlines Pty Ltd (reg 10). Those entities are directly affected because the Regulations allocate separate BAe‑146 movement limits to each of them under regulation 11.
• Operators of BAe‑146 aircraft more generally. Regulation 11 subdivides the BAe‑146 upper limit under the Act among specified operators; that will determine how many BAe‑146 take‑offs and landings can be made by the listed registrants or operators (reg 11).
• Persons required to lodge returns under the Act. Regulation 7 prescribes the postal address that satisfies the Act’s requirement that returns be given to an authorised person for the purposes of subsections 8(3) and 9(3) of the Act. That imposes an administrative step and a recipient location for whoever must prepare and deliver the return (reg 7).
• Air traffic controllers, in the definitional sense, to the extent that the Regulations adopt the CASR authorisation standard for the meaning of "air traffic controller" used in the Act; the Regulations do not expand who is an air traffic controller but tie the Act’s definition to authorisation under Subpart 65.B of CASR 1998 (reg 6).
• The Department of Infrastructure, Transport, Regional Development, Communications and the Arts insofar as it receives post at the prescribed GPO Box and will handle lodged returns (reg 7).

The Regulations repeal the 1995 Regulations (Schedule 1). That repeal, together with the transition provision in regulation 12(2), affects any party whose entitlements, allocations or compliance obligations are still governed by the 1995 instrument in the transitional window (reg 12(2); Schedule 1). The transition clause means parties operating in the period between commencement and 1 July 2023 must pay attention to which instrument governs their rights and obligations.

There are no new categories of person created with enforcement powers or penalties within these Regulations themselves; questions of enforcement, authorised persons and offences remain routed to the Act (as the Regulations repeatedly reference the Act’s paragraphs and subsections to give effect to their numbers and administrative rules).

The Regulations create duties and rights only indirectly by setting numeric and administrative parameters that the Act uses. The instrument’s text gives rise to a small set of discrete duties and entitlements:

• Duty to use the prescribed address for postal lodgement of returns where a return is to be given by post for the purposes of subsections 8(3) and 9(3) of the Act (reg 7). The Regulations thereby specify the location to which a return may be posted and implicitly require the sender to use that address if lodging by post. The note in reg 7 makes explicit that the Act requires a return to be given to an authorised person, and that the authorised person definition is in s 3 of the Act.
• Numeric entitlement limits under the Act. By prescribing numerical values for particular paragraphs of the Act, the Regulations create or fix the numeric limits used to determine lawful take‑offs and landings in the cited windows. For example, reg 8 prescribes 0 for take‑offs and landings between 11 pm and midnight for the purposes of paragraphs 12(8)(a) and 12(8)(b) of the Act. The effect of prescribing 0 is that, for the Act’s quota calculations that reference those paragraphs, the relevant number is 0; how that translates into rights to operate is a matter to be resolved under the Act’s operation using those prescribed parameters.
• Split of BAe‑146 upper limit into per‑operator caps. Regulation 11 divides the upper limit applicable under subparagraph 13(3)(a)(ii) of the Act into separate numeric limits by operator and registration/operation status. The listed numbers (28, 10, 27, 9, and 0) function as caps applicable to aircraft registered in the name of, or operated by or on behalf of, the named persons (reg 11(a)-(e)). The cross‑reference in each item to "registered in the name of, or operated by or on behalf of" the named person indicates that the cap applies by reference to legal registration or operational control, and not solely by common carrier branding.
• Temporal application of those duties and rights. Sections 10 and 11 are stated to apply in relation to take‑offs and landings on and after 2 July 2023 (reg 12(1)). That timing creates a window where, despite the Regulations commencing generally on 27 May 2023, the per‑operator BAe‑146 limitations do not take effect until 2 July 2023.
• Transitional continuity of 1995 regulations 8 and 9. Regulation 12(2) saves the operation of regs 8 and 9 of the 1995 instrument for the period from commencement to 1 July 2023. Practically, that preserves duties and rights created by those specific 1995 provisions for the short transitional window.

The Regulations do not themselves create new offences or specify penalties. Any duties to produce returns, conformity with quotas, or liabilities for non‑compliance are to be enforced under the parent Act and its definitions of authorised person and penalty provisions. The Regulations limit and allocate quantities and set logistical points of compliance that the Act then operationalises.

The Regulations are silent on the creation of new offences and on specific penalties. Enforcement and penalty mechanisms remain within the scope of the Sydney Airport Curfew Act 1995, to which these Regulations are subordinate. From the instrument’s text the following enforcement‑relevant features can be identified:

• No penalties in the Regulations themselves. The Regulations do not list monetary penalties, criminal sanctions, infringement notices or any enforcement procedure. They function as parameter‑setting and administrative direction rather than as a vehicle for penal prescription.
• Enforcement reference points retained in the Act. Multiple provisions of the Regulations operate "for the purposes of" particular paragraphs and subsections of the Act (for example regs 8-11 refer to paragraphs 12(8) and (9) and subsection 13(1) and subparagraph 13(3)(a)(ii) of the Act). This means any enforcement action for breach of the curfew, quota mechanism or return obligations remains rooted in the Act’s enforcement scheme and in the Act’s definition of authorised person (reg 7, note).
• Returns must be given to an authorised person under the Act. Regulation 7 prescribes a postal address for lodgement "for the purposes of paragraphs 8(3)(d) and 9(3)(e) of the Act" and notes that, under those subsections of the Act, the return must be given to an authorised person. The practical consequence is that an authorised person (as defined in s 3 of the Act) will be the entity under the Act to which a return must be delivered; the Regulations provide a postal address that will satisfy the "given" requirement when lodging by post (reg 7).
• Administrative recipient specified. The Department of Infrastructure, Transport, Regional Development, Communications and the Arts is named as the postal recipient, which identifies the likely administrative respondent if returns are submitted by post (reg 7). That gives a clear locus for administrative receipt and chain of custody for compliance documents.
• Practical enforceability of quotas. By prescribing numeric limits that feed into the Act’s quota mechanism, the Regulations enable the Act’s enforcement to measure an operator’s compliance or contravention against a fixed number. The Regulations themselves, however, do not set out monitoring, reporting or audit procedures; those procedural mechanisms, if any, would be expected to be found in the Act or in administrative practice.

Because the Regulations do not specify sanctions, any practitioner or operator considering enforcement risk must consult the substantive and enforcement provisions of the Sydney Airport Curfew Act 1995 itself for the exact consequences of non‑compliance with quota, curfew or return obligations. The Regulations make clear where to lodge returns and what numeric limits are to be used by the Act, but they leave the legal consequences of breach to the parent statute.

The Regulations are an instrument made under and intended to operate in support of the Sydney Airport Curfew Act 1995, and they make explicit linkages to the Civil Aviation Safety Regulations 1998 for definitional purposes. The interaction points observable in the text are:

• Subordination to the Act. The instrument states in regulation 3 that it is made under the Sydney Airport Curfew Act 1995. Each substantive provision that affects curfew operation does so by reference to particular paragraphs or subsections of the Act (for example regs 8 and 9 refer to paragraph 12(8) and paragraph 12(9) of the Act; regs 10 and 11 refer to subsection 13(1) and subparagraph 13(3)(a)(ii) of the Act). Therefore the Regulations do not operate independently; they supply parameters that the Act uses to produce legal effects.
• Definitional incorporation from CASR 1998. Regulation 6 defines "air traffic controller" for the purposes of the Act’s definition by reference to authorisation under Subpart 65.B of the Civil Aviation Safety Regulations 1998. This is direct cross‑referencing between the curfew regime and the civil aviation safety regulatory framework. The consequence is that an individual’s status as an air traffic controller for curfew purposes depends on authorisation under CASR rather than an independent or bespoke definition in the Act or the Regulations.
• Administrative alignment to a Commonwealth Department. Regulation 7 prescribes the Department of Infrastructure, Transport, Regional Development, Communications and the Arts as the postal recipient for returns. That creates an administrative pathway that connects the curfew regime to departmental processes and record‑keeping.
• Repeal and transitional retention of prior Regulations. The Regulations repeal the Sydney Airport Curfew Regulations 1995 in full (Schedule 1), but regulation 12(2) expressly preserves regulations 8 and 9 of the 1995 instrument for the period from the start of the day the new instrument commences until the end of 1 July 2023. That creates a temporal overlap with the prior instrument and requires practitioners to consult both instruments to determine which provision applies during the transitional window.
• No express interaction with local or state laws in the text. The instrument does not mention state or local planning, environmental or noise statutory regimes. The Regulations therefore leave any interaction with other regulatory regimes (for example, state planning or environmental controls) to be managed through existing channels; the instrument itself does not create or resolve such cross‑jurisdictional interactions.

In short, the Regulations are tightly integrated with the parent Act and with CASR for definitional purposes. They do not purport to displace other legal regimes but rather to supply numeric and administrative settings that the Act uses. Any broader interaction with other Commonwealth, state or local laws is not addressed in the instrument and will need to be assessed by reference to those separate regimes and the Act.

The Regulations as supplied are an original instrument made in 2023 and contain explicit transitional and repeal provisions for the prior regulatory instrument. The amendment history that can be read from the text is:

• New instrument and commencement. The Regulations state they are the Sydney Airport Curfew Regulations 2023 and that the whole of the instrument commences the day after registration, specified in the commencement table as 27 May 2023 (reg 1-2; commencement table). The note appended to the commencement table clarifies that the table relates only to the provisions as originally made and will not be amended to deal with later amendments.
• Repeal of the 1995 Regulations. Schedule 1 repeals the whole of the Sydney Airport Curfew Regulations 1995 (Schedule 1). This is an express and full repeal action in the instrument.
• Transitional savings for limited provisions of the 1995 Regulations. Despite the full repeal, regulation 12(2) provides a saving that preserves the continued operation of regulations 8 and 9 of the Sydney Airport Curfew Regulations 1995 "as if the repeal had not happened" for the period starting at the start of the day this instrument commences and ending at the end of 1 July 2023. In practical terms, that means that for a short window, from commencement (27 May 2023) through to 1 July 2023,regs 8 and 9 of the 1995 Regulations remain in force for matters to which they apply.
• Phased application of new BAe‑146 provisions. Regulation 12(1) provides that sections 10 and 11 of the new Regulations, which contain the list of specified persons and the per‑operator BAe‑146 caps, apply in relation to take‑offs and landings of aircraft on and after 2 July 2023. This creates a delayed operative date for those particular amendments, distinct from the instrument’s general commencement date.
• No amendments recorded within the instrument. The instrument contains a commencement table and a note that the table relates only to the provisions as originally made; there are no amending items or further changes recorded within the supplied text. Any subsequent amendments after registration and initial commencement would need to appear in later legislative instruments or amendments not present here.

Practitioners should note the dual temporal features: the instrument commences generally on 27 May 2023, but regs 10-11 are operative from 2 July 2023 and the old regs 8 and 9 of 1995 are preserved until 1 July 2023. Those overlapping dates create a short period in which both the old and new instruments may need to be consulted to determine which quota settings and rules apply to particular take‑offs and landings.

The Regulations themselves do not record any litigation history. The instrument contains no references to court decisions, appeals, judicial review proceedings or precedent. From the text alone the following observations relevant to litigation and dispute risk can be made:

• No cases or judicial outcomes are cited. The instrument does not name any cases and does not disclose any prior adjudicative outcomes relevant to the interpretation of the numerical allocations or the administrative provisions within these Regulations.
• Potential for interpretive disputes remains with the Act. Because the Regulations operate by prescribing numbers "for the purposes of" specific paragraphs and subsections of the Sydney Airport Curfew Act 1995 (for example regs 8-11 reference paragraphs 12(8), 12(9), subsection 13(1), and subparagraph 13(3)(a)(ii)), disagreements about the legal effect or scope of those prescribed numbers will require interpretation of the Act itself. Any litigation over whether a particular flight is permitted, or whether a particular operator’s movements fall within an allocated cap, would therefore hinge on the Act’s wording and possibly on administrative practice.
• Transitional timing could be a focus for dispute. The Regulations create a short transitional period in which the 1995 Regulations’ regs 8 and 9 are preserved until 1 July 2023, while regs 10 and 11 take effect on and after 2 July 2023 (reg 12). Disputes over which instrument governs particular operations during the overlap or about retrospective application of allocations could arise and would be matters for judicial or administrative resolution if contested.
• Definitional cross‑references may invite argument. Regulation 6 adopts the CASR authorisation standard for the meaning of "air traffic controller" used in the Act. Questions about whether a particular person is authorised under Subpart 65.B of CASR 1998 could become part of enforcement or compliance disputes, which would implicate administrative law review or statutory interpretation principles.
• No reported litigation in the text to cite. Because the Regulations do not include any litigation history or references to adjudicative outcomes, any lawyer or compliance officer seeking litigation precedent will need to consult external sources, including case law on the Act or on the operation of similar quota instruments, none of which are provided in the instrument itself.

In short, the instrument leaves litigation history blank. The principal sources of potential litigation would be disputes about the interface between the numerical prescriptions in these Regulations and the rights and duties created by the Sydney Airport Curfew Act 1995, the temporal application of the Regulations versus the 1995 Regulations, and definitional questions arising from the CASR linkage in reg 6.

The Regulations are short but contain several technical details and timing traps that deserve explicit attention. The following points are derived directly from the instrument and identify areas where practitioners commonly encounter misunderstandings:

• Prescribed numbers apply "for the purposes of" specific Act paragraphs and subsections. The Regulations do not in themselves state substantive permissions or prohibitions; they provide numerical inputs for the Act’s paragraphs (regs 8-11). You must consult the Act to understand how these prescribed numbers convert into lawful operations. Do not assume the Regulations alone create or extinguish rights.
• Two distinct 11 pm-midnight quota references both set to 0. Regulation 8(1) prescribes the number of take‑offs and landings for the purposes of paragraph 12(8)(a) of the Act as 0; regulation 8(2) does the same for paragraph 12(8)(b). These are separate references and may correspond to distinct classes or categories in the Act. Confirm whether paragraph 12(8)(a) and 12(8)(b) are materially different categories before assuming a single universal effect (reg 8).
• Two distinct 5 am-6 am quota numbers. Regulation 9 prescribes two separate numbers for landings between 5 am and 6 am: 24 for the purposes of paragraph 12(9)(a) and 5 for paragraph 12(9)(b). Again, these correspond to different statutory hooks; do not conflate them without checking the Act (reg 9).
• Per‑operator BAe‑146 split includes a zero allocation. Regulation 11 allocates BAe‑146 movement caps among five named entities and assigns Virgin Australia Airlines Pty Ltd an allocation of 0. That is a concrete numeric allocation; operators and brokers should note that an explicit zero is different from an absence of any allocation (reg 11(e)).
• Specified persons listed by legal name. Regulation 10 specifies five persons for the purposes of subsection 13(1). The per‑operator caps in regulation 11 apply to aircraft "registered in the name of, or operated by or on behalf of" the named person. This phrasing can capture owned aircraft, contracted operations and operated‑on‑behalf scenarios; legal structures that separate registration from operation may therefore matter for how caps apply (regs 10-11).
• Timing and transitional complexity. The instrument generally commences on 27 May 2023, but regulations 10 and 11 apply on and after 2 July 2023. In addition, regulations 8 and 9 of the 1995 Regulations continue to apply until the end of 1 July 2023 (reg 2; reg 12(1)-(2); Schedule 1). For activity in late May and June 2023, determine which instrument governs (the 1995 provisions or the new ones) and be alert to the short transition.
• The prescribed postal lodgement address may not be the only permitted method of delivery. Regulation 7 prescribes a postal address "for the purposes of paragraphs 8(3)(d) and 9(3)(e) of the Act" but the note states that the return must be given to an authorised person under the Act. If time‑critical returns are required or if hand delivery to an authorised person is permitted, check the Act and administrative guidance as the Regulations only fix one acceptable postal address (reg 7).
• Definition of air traffic controller tied to CASR authorisation. Regulation 6 links the Act’s definition of "air traffic controller" to authorisations under Subpart 65.B of CASR 1998. Where disputes hinge on whether a person is an air traffic controller for curfew reporting or authorised‑person purposes, the CASR authorisation status will be decisive; check CASR records and authorisation documents rather than relying on job titles alone (reg 6).
• Repeal is broad but not instantaneous for all matters. Schedule 1 repeals the 1995 Regulations in full but the saving in reg 12(2) means parts of the old instrument remain in force for a limited period. Do not assume the 1995 instrument no longer has any operative legal effect until you have applied reg 12(2) to your factual time window (Schedule 1; reg 12(2)).

These are precise textual catches. Because the instrument’s legal force works through references to the Act, the crucial "gotcha" is to avoid reading the Regulations in isolation: always read the referenced paragraphs and subsections in the Act together with the numeric prescriptions here.

Compliance with the Regulations is compliance with the administrative and numerical inputs the parent Act requires. The Regulations themselves prescribe numbers and a lodgement address and do not list procedures for enforcement; compliance steps flow from the combined effect of these Regulations and the Sydney Airport Curfew Act 1995. Practical compliance actions grounded in the instrument are:

• Identify whether your operations are affected by the specified time windows and categories. The Regulations assign numbers for:
  • take‑offs and landings between 11 pm and midnight for the purposes of paragraph 12(8)(a) and (b) of the Act (both prescribed as 0) (reg 8);
  • landings between 5 am and 6 am for the purposes of paragraph 12(9)(a) (24) and paragraph 12(9)(b) (5) (reg 9). Confirm whether your requested movement would be captured by the Act’s paragraph references and therefore constrained by these prescribed numbers.
• If you operate BAe‑146 aircraft, map your aircraft to the specified persons and per‑operator caps. Regulation 10 names five specified persons; regulation 11 allocates the BAe‑146 upper limit among them (National Jet Express 28; Pionair 10; Qantas 27; IPEC 9; Virgin Australia 0). Determine whether your aircraft are registered in or operated by or on behalf of one of those named entities, because the per‑operator caps apply in those cases (regs 10-11).
• For operations occurring in the transitional window, check which instrument applies. Regulations 10 and 11 apply on and after 2 July 2023 (reg 12(1)). Regulations 8 and 9 of the 1995 Regulations continue to apply until the end of 1 July 2023 (reg 12(2)). For flights scheduled in late May or June 2023, ascertain whether the previous instrument’s rules or the new ones govern your slot.
• Lodge returns correctly. Where a return is required under subsections 8(3) and 9(3) of the Act, regulation 7 prescribes a postal address that will satisfy a lodgement by post: Department of Infrastructure, Transport, Regional Development, Communications and the Arts, GPO Box 594, CANBERRA ACT 2601 (reg 7). In practice you should:
  • Verify whether the Act permits alternative methods (hand delivery to an authorised person, electronic lodgement) and follow the Act’s authorised person requirements; the Regulations provide the postal address as a safe postal recipient (reg 7; reg 7 note).
  • Keep proof of lodgement (postal tracking, date/time stamped copies and a copy retained in your files) because the Act requires that returns be given to an authorised person and administrative or enforcement disputes may turn on whether or when a return was given.
• Confirm air traffic controller authorisation status where relevant. For any compliance obligation tied to the role of an air traffic controller under the Act, regulation 6 ties that status to authorisation under Subpart 65.B of the CASR 1998. Ensure any person relied upon to provide authorised‑person functions or sign lodgements is authorised under the relevant CASR subpart (reg 6).
• Document allocation and scheduling decisions for BAe‑146 movements. Because regulation 11 ties caps to registration or operation status and carves the BAe‑146 limit into per‑operator numbers, maintain contemporaneous records showing:
  • which flights are counted against which operator’s cap;
  • the registration and operational control basis for that counting (registered in the name of, or operated by or on behalf of the named person);
  • internal allocation or allocation agreements if movements are reallocated between business units or third parties.
• Monitor future amendments and administrative guidance. The commencement table includes a note that it relates only to the provisions as originally made and will not be amended to record later changes. Therefore, monitor the Federal Register of Legislation and departmental communications for any subsequent amendments or administrative guidance interpreting how the numerical prescriptions will be applied in practice (reg 2 note).
• Where doubt exists, seek a statutory interpretation answer from counsel or a formal administrative ruling. Because the Regulations operate by numerical cross‑references to the Act, and because enforcement and penalty structure reside in the Act, any uncertainty about whether a particular movement is lawful under the combined enactments is a question of statutory interpretation and administrative application. Formal requests for guidance to the authorised person or to the responsible department may reduce enforcement risk.

Follow these steps with the explicit cross‑checks to the Act: the Regulations are not self‑contained. They prescribe numbers and an address; the Act provides the legal effect and any penalties. Maintain audit trails and contemporaneous documentation showing how movements are allocated against caps and how returns are lodged, with record‑keeping sufficient to demonstrate compliance if queried by an authorised person under the Act.
