SWIMMING POOL SAFETY REGULATIONS 2004

The Regulations turn several statutory concepts into concrete administrative and technical standards. Those concepts include: the modified Australian Standard, the Community Safety Standard and its Guidelines, dividing barriers and dividing barrier notices, the certificate regime, and exemptions.

Modified Australian Standard. Regulation 5 identifies the Australian Standards as the “safety standards” in section 10(1)(a)(iii) of the Act, but expressly modifies AS 1926.1-1993 by replacing Clause 2.3.2 with new chainmesh rules. The chainmesh rule draws two aperture bands: apertures not greater than 13 mm require top and bottom strainer wire or rail and a minimum effective fence height of 1.2 m; apertures greater than 13 mm but less than 100 mm require the same wire or rails and an effective fence height of not less than 1.7 m (regulation 5(2)). The Regulations further modify any provision that refers to an outside measurement so that, when applied to a dividing barrier, the measurement is taken on the inside (regulation 5(3) and (6)). They also state explicitly that no action is required on adjoining premises to make a dividing barrier comply (regulation 5(4)).

Community Safety Standard and Guidelines. Regulation 6 adopts the Schedule 2 Community Safety Standard Guidelines as the material the Authority and owners must use when assessing existing pools against the Community Safety Standard. Schedule 2 contains operational guidance, with recommended heights, aperture sizes, latching locations and behavioural recommendations such as clearing vegetation and not placing climbable objects against the barrier (Schedule 2 clauses 2 and 7).

Dividing barrier and dividing barrier notice. A dividing barrier is a boundary structure that separates premises. The Regulations prescribe the content of a dividing barrier notice when an owner intends to rely on a dividing barrier as the pool barrier, including naming the owner and premises, warning that objects on the adjoining premises could assist a child to climb the barrier, and advising that the owner should notify the occupier if the owner is not the occupier (regulation 7(2)). The dividing barrier notice must be given to the owner of the adjoining premises in accordance with section 52(2) of the Act (regulation 7(3)).

Certificate regime. The Regulations set out the paperwork and contents for interim compliance certificates for new small premises (regulation 8 and 13(1)), compliance certificates after construction (regulation 9 and 13(2)), general compliance certificates (regulation 10), provisional compliance certificates for purchasers (regulation 11 and 13(3)), and acknowledgments for existing pools (regulations 16-19). Certificates may be varied or revoked by the Authority, subject to notice and an opportunity to make submissions (regulation 14 and 15).

Exemptions and scope. Regulation 4 implements section 6(2)(d) of the Act by listing classes of premises where a structure otherwise within section 6(1) is exempt, namely primarily commercial accommodation and non-residential complexes. The Guidelines also state limits on using perimeter boundaries and affirm that part of a perimeter that is a dividing barrier may be used as a pool barrier (Schedule 2 clause 3).

The Regulations therefore convert abstract statutory duties into documentary requirements, technical thresholds and process safeguards. They allocate evidentiary burdens to owners and purchasers, require specific notices to adjoining owners when dividing barriers are used, and make technical distinctions between chainmesh apertures and corresponding required fence heights.

The Regulations create obligations and choices that fall mostly on owners and prospective purchasers of premises with swimming pools, and on the Authority that administers certificates. They also directly involve owners of adjoining premises when dividing barriers are used. Third parties such as building contractors, pool safety advisers and real estate practitioners are affected indirectly because the Regulations require documentary proof, notices and compliance steps often prepared or implemented by such professionals.

Owners of small premises with new pools are required to apply for interim compliance certificates prior to construction and to include particulars such as their name and address, the premises’ address, whether the pool will comply with the modified Australian Standard or a non-standard safety provision, particulars of any non-standard enclosure, confirmation of service of dividing barrier notices where relevant, and whether the owner has obtained advice of a pool safety adviser (regulation 8). After construction, owners must apply for a compliance certificate and supply the interim certificate number and completion date (regulation 9).

Owners of existing pools use the Community Safety Standard framework. A declaration of compliance for an existing pool must state that the pool complies with the Community Safety Standard, that the owner applied the Guidelines, a description of the barrier, confirmation of service of any dividing barrier notice, and whether the owner sought a pool safety adviser’s advice (regulation 16). Acknowledgment notices issued by the Authority must include similar particulars (regulation 19).

Purchasers are a distinct affected group. A purchaser of small premises can apply for a provisional compliance certificate when buying a property with an uncertified, existing pool and must declare the proposed date of sale completion, intent to upgrade to the modified Australian Standard or non-standard safety provision, and the time estimate for completing the upgrade not exceeding three months after purchase (regulation 11). A provisional acknowledgment notice serves the same purpose for existing pools being brought up to the Community Safety Standard (regulation 17 and 19(2)).

Owners of adjoining premises are affected by the dividing barrier notice mechanism. When an owner intends to use a dividing barrier as the pool barrier, the owner must give a dividing barrier notice to the owner of the adjoining premises in accordance with section 52(2) of the Act, and the notice must include specific warnings about the risk a child faces if objects are placed against or near the barrier (regulation 7(2)-(3)). The owner of the adjoining premises therefore receives a statutory notification but the Regulations also make clear that no action is required on adjoining premises to make the dividing barrier comply (regulation 5(4) and Schedule 2 clause 1(3)).

The Authority is a decision maker and enforcer. It adjudicates applications, issues and revokes certificates, may vary certificates on notice and must request return of varied or revoked certificates, and may extend the time for purchasers to complete upgrades (regulations 12, 14, 15 and 20). The Authority also receives declarations and applications and is empowered to impose conditions on certificates and extensions.

Pool safety advisers and contractors are implicated by the repeated references to whether applicants have received a pool safety adviser’s advice. While the Regulations do not mandate that applicants obtain such advice, they require applicants to state whether they have done so (for example, regulations 8(e)(f), 10(g), 11(h), 16(g), 17(h)). That creates an evidentiary incentive to obtain advice, particularly when the Authority is assessing declarations or provisional certificates.

Finally, occupants who are not owners are indirectly affected because regulation 7(2)(g) specifically recommends that an owner notify an occupier of adjoining premises about the dividing barrier notice if the owner is not the occupier.

The Regulations allocate duties to owners and purchasers primarily as documentary obligations, notification duties and compliance timetables, and they set rights for the Authority including notice and review processes.

Duties of owners and purchasers

• Give a dividing barrier notice when a dividing barrier will be used as the pool barrier, in the prescribed form and handed to the owner of the adjoining premises in accordance with section 52(2) of the Act (regulation 7(2)-(3)). The notice must identify owner and premises, state that the barrier will be used as the pool barrier, and warn of the risk if objects are placed against the barrier (regulation 7(2)(a)-(g)).

• File particularised applications for certificates and acknowledgments. Applications must include identity of the owner or purchaser, premises address, whether the pool is new or existing, whether the pool will comply with the modified Australian Standard or a non-standard safety provision, particulars of enclosure where non-standard provisions are used, confirmation of dividing barrier notice where relevant, and whether advice of a pool safety adviser has been received (regulations 8-11, 16-18).

• For purchasers holding provisional compliance certificates or provisional acknowledgment notices, begin upgrading “as soon as practicable” after transfer and complete the upgrade within three months unless the Authority extends the time in writing (regulation 20(1)-(2)). The extension may carry conditions (regulation 20(3)).

• Where a certificate is varied or revoked, return the certificate to the Authority within 30 days of request or declare it lost or destroyed in writing (regulation 14(3), regulation 15(5)).

Rights of applicants and certificate holders

• Procedural protection before variation or revocation. The Authority may vary or revoke a certificate on its own initiative only if it first gives notice specifying the proposed variation or revocation and the reasons for it, allows at least 14 days for submissions, and takes any submissions into account (regulation 14(1)(a)-(c), regulation 15(3)(a)-(c)).

• Opportunity to apply for extensions. Holders of provisional certificates may apply in writing for an extension of the three-month upgrade period; the Authority has discretion to grant extensions and to impose conditions (regulation 20(2)-(3)).

• Specific content in issued certificates. The Regulations require that interim compliance certificates, compliance certificates and provisional compliance certificates specify key particulars, including the name of the person to whom the certificate is issued, whether the premises are small or large, whether the pool is new or existing, which safety standard applies, conditions imposed by the Authority, and brief statements of relevant statutory obligations (regulation 13(1)-(3), regulation 19(1)-(3)).

Authority powers and duties

• Authority may consider and issue compliance, provisional and interim certificates and may require additional information (regulations 9(1)(c), 12(3)(d), 15(2)(b)).

• Authority must request returned certificates and may impose penalties for failure to comply with the certificate return requirement; maximum penalty specified is five penalty units (regulation 14(3) and the maximum penalty in regulation 14(3) and 15(5)).

• Authority may revoke certificates if the pool is no longer at the premises or if the owner is failing to comply with certain statutory obligations referred to in the Act (regulation 15(2)(a)-(b)).

Other features bearing on duties and rights

• The Regulations make explicit that no person on adjoining premises is required to take action to ensure a dividing barrier complies with the modified Australian Standard (regulation 5(4)) and that the Guidelines do not require such action (Schedule 2 clause 1(3)). That shapes the boundary between an owner’s duty to notify and an adjoining owner’s obligation, which the Regulations do not create.

• The modified Australian Standard introduced in regulation 5 prevails where there is inconsistency between the Australian Standards and the Act or these Regulations, because the Australian Standards are modified to the extent necessary to achieve consistency (regulation 5(5)).

All duties in the Regulations reference or supplement duties in the Act. The Regulations convert statutory duties into particularised application requirements, notice content and timing obligations. The primary compliance levers are documentary (applications, declarations and notices), time-limited upgrade obligations for purchasers, and the Authority’s certificate, variation and revocation powers.

The Regulations specify limited civil and administrative enforcement mechanics and set a few quantifiable penalties. The primary enforcement levers are certificate control, notice-and-submission procedures and small fixed penalties for failure to return certificates when requested.

Certificate revocation and variation. The Authority is empowered to revoke certificates where it is satisfied that the swimming pool is no longer at the premises specified in the certificate, or where the owner is failing to comply with section 31 of the Act or an order issued under section 37 of the Act (regulation 15(2)(a)-(b)). The Authority may also vary a certificate on its own initiative, but only after serving notice of proposed variation, allowing at least 14 days for submissions and taking those submissions into account (regulation 14(1)-(1)(c)). These procedural protections limit abrupt or ex parte modifications, but they vest significant discretion in the Authority to make the substantive decision once process is observed.

Return of certificate. Where the Authority varies or revokes a certificate, it must request the holder to return it; the holder must return it within 30 days or declare it lost or destroyed in writing (regulation 14(2)(a)-(c), regulation 15(4)-(5)). Failure to comply with the return requirement carries a maximum penalty of five penalty units (regulation 14(3) and regulation 15(5)). The Regulations do not specify the value of a penalty unit; that figure will be determined by the relevant uprating provisions external to these Regulations.

Other enforcement mechanisms implicit in the Act. The Regulations refer to statutory enforcement in the Act, including non-compliance with section 31 and orders under section 37 as grounds for revocation (regulation 15(2)(b)). The Regulations themselves do not create separate offences for failing to obtain certificates, failing to provide dividing barrier notices, or failing to comply with particular technical thresholds. Instead, enforcement of substantive safety obligations is primarily routed through the Authority’s certificate regime and the Act’s enforcement provisions.

Authority discretion on extension of time. Regulation 20 gives the Authority discretion to extend the three-month upgrade period for purchasers on written application, and the Authority’s extension may impose conditions (regulation 20(2)-(3)). This is an administrative instrument for managing compliance schedules and may be used as an enforcement and compliance channel, tying conditional relief to performance obligations.

Administrative burdens as enforcement risks. Several documentary requirements operate as compliance triggers. An application that omits required particulars may be refused or may attract requests for further information (regulations 8-12 specify required particulars and regulation 9(1)(c) authorises the Authority to require any further information it considers necessary). The Regulations therefore create procedural default risks: failure to lodge required particulars, failure to give specified notices to adjoining owners or failure to return certificates when requested can produce administrative penalties or revocation.

Limits of penalties. The Regulations are relatively light on explicit monetary penalties beyond the fixed penalty for non-return of certificates. They rely on the Act for the substantive enforcement toolkit. The practical enforcement climate will therefore depend on the Authority’s use of its powers to refuse, vary or revoke certificates, to issue orders under the Act, and to require remedial works either by condition of an extension or through statutory orders referenced in regulation 15(2)(b).

The Regulations operate as subordinate legislation under the Swimming Pool Safety Act 2004 and repeatedly reference and implement that Act’s sections. Several cross-connections and hierarchical relationships are apparent within the text.

Statutory foundation and scope. The Regulations are made under the Act and implement its certificate and safety standard provisions. For example, regulation 5 identifies the Australian Standards as the standards referenced in section 10(1)(a)(iii) of the Act and modifies them to fit the Act’s scheme. Regulation 6 adopts the Schedule 2 Guidelines as those referred to in section 11(3) of the Act. The dividing barrier notice is the notice referred to in section 10(1)(b), 11(1)(b) or 12(1)(b)(iii) of the Act and must be given in accordance with section 52(2) of the Act (regulation 7(2)-(3)). These references show that the Regulations are operationalising specific Act provisions rather than creating an independent parallel regime.

Priority between the Standards and the Act. Regulation 5(5) expressly states that if there is an inconsistency between the Australian Standards and the Act or these Regulations, the Australian Standards are modified to the extent necessary to achieve consistency. That modification clause indicates a deliberate legal ordering: the Australian Standards operate as subordinate technical material, but the Regulations alter the Standards so they do not conflict with primary legislation prescribing duties and processes. This creates a single harmonised standard for compliance rather than leaving contradictory obligations in the Standards.

Interaction with property rights and adjoining owners. The Regulations require owners to notify adjoining owners when a dividing barrier is used, but they also say that no action is required to be taken on adjoining premises to ensure a dividing barrier complies (regulation 5(4) and Schedule 2 clause 1(3)). That creates a partitioned legal effect: notification duties are imposed on the owner relying on the dividing barrier, yet the adjoining owner is not converted into an agent of compliance. The dividing barrier notice must be given to the owner of the adjoining premises in accordance with section 52(2) of the Act (regulation 7(3)), so the Regulations interact with the Act’s service rules.

Interplay with planning, building and property transfer regimes. The Regulations specify time frames and documentary requirements for purchasers who inherit non-compliant existing pools. Regulation 20 sets the upgrade deadline at three months following transfer of the fee simple interest, subject to written application for extension. That provision operates alongside transfer and conveyancing laws: the purchaser’s obligation to upgrade is triggered by the property transfer. The Regulations thereby insert a compliance obligation into the transactional lifecycle of property transfers and must be managed during conveyancing processes.

Administrative law checks. The Authority’s power to vary or revoke certificates is constrained by notice and an opportunity to make submissions, a form of procedural fairness embedded in the Regulations (regulations 14(1) and 15(3)). Those requirements sit within the broader administrative law framework governing the exercise of statutory powers and will interact with general judicial review principles and any Act-specific appeal mechanisms.

Amendment and repeal history. The endnotes identify later amending Acts, including the Penalties Amendment (Miscellaneous) Act 2013 and the Lands, Planning and Environment Legislation Amendment Act 2025, which have changed various regulations. The Interpretation Legislation Amendment Act 2018 made general formal amendments to r 1 and Schedule 1. Those subsequent amending Acts form part of the statute book and must be read with the Regulations to determine current obligations and penalties.

No express interaction with separate criminal codes is included in the Regulations. The Regulations rely on the Act for substantive enforcement measures (for example, references to compliance with section 31 and orders under section 37). For readers advising on multi-jurisdictional or cross-regulatory issues, the key interactions will therefore be with the Act itself, property transfer law (conveyancing), local planning and building approval regimes, and any general administrative law remedies.

The instrument’s endnotes provide a traceable amendment record from enactment to the most recent reprint. Key dates and instruments are:

• Original instrument: Swimming Pool Safety Regulations (SL No. 5, 2004). The Regulations were notified 16 March 2004 and commenced 15 March 2004 by reference to the commencement of the Swimming Pool Safety Act 2004 (Endnotes 2 and 4).

• Penalties Amendment (Miscellaneous) Act 2013 (Act No. 23, 2013). Assent was 12 July 2013 and the amending provisions commenced 28 August 2013 (Gazette G35, 28 August 2013). The Endnotes list that rr 14-15 were amended by Act No. 23, 2013 (Endnote 4).

• Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018). This Act made general formal amendments of a non-substantive nature to regulation 1 and Schedule 1 (Endnote 3). Those amendments are described as formal and of a general nature.

• Lands, Planning and Environment Legislation Amendment Act 2025 (Act No. 25, 2025). Assent date 12 September 2025. The Endnotes indicate that various regulations were amended by this Act: regulation 3 was amended by s 57 of Act No. 25, 2025; regulations 7-8, 10-11, 16-17 were amended by s 57; regulation 21 was repealed by s 55; and Schedule 1 matters were repealed by s 56. The Endnotes also record that rr 7-8 and rr 10-11 were amended by Act No. 25, 2025 s 57, and that rr 16-17 were so amended (Endnote 4 lists multiple specific amendment references). The reprint is “As in force at 13 September 2025”, implying that the Lands, Planning and Environment Legislation Amendment Act 2025 effected changes by or before that date (Endnote 2 notes commencement timing for part 6 as nc; remainder 13 September 2025).

• The Endnotes summarise the list of amendments and note that general amendments of a formal nature not itemised in the table were made by the Interpretation Legislation Amendment Act 2018. The Endnotes also include an administrative key to abbreviations and a list of the amending instruments.

Practical consequences of the amendment record. The 2013 penalties amendments affected regulations governing variation and revocation of certificates (rr 14-15). The 2025 amendments appear to have updated multiple procedural regulations including definitions (r 3) and application or notice requirements (rr 7-8, 10-11, 16-17). The precise content of the amendments is not reproduced in the reprint beyond the reprinted text; practitioners must consult the amending Acts and Gazettes cited in the Endnotes to trace the policy intent, transitional arrangements and any changes to obligations or penalties.

For compliance and advisory practice, the reprint date and Endnote entries identify the current text as at 13 September 2025, and the Endnotes provide the statutory breadcrumbs needed to reconstruct earlier versions. Where historic compliance status or transactions pre-dating amendments are relevant, advisors should examine the version history and any transitional provisions in the amending Acts.

The Regulations and their endnotes contain no case citations, judicial decisions or summaries of litigation. The text provided is a reprint of the subordinate legislation and the Endnotes list only amending Acts, commencement dates and formal amendment instruments. No judicial review proceedings, appeals or reported determinations are recorded in the instrument itself.

Implications for research and advice. The absence of litigation history in the Regulations does not mean there has been no litigation about the Swimming Pool Safety Act 2004 or its Regulations. It simply records that the instrument as published does not include case law references. Practitioners seeking authoritative interpretations, contested applications or precedential decisions must search judicial databases, Administrative Appeals Tribunal records and tribunal or court dockets for decisions invoking the Act and these Regulations.

Points of likely judicial interest. If litigation exists or is brought, predictable themes would include:

• Whether the Authority’s exercise of discretion to vary or revoke certificates complied with procedural fairness, given the 14-day submissions window and the request-return mechanics set out in regulations 14 and 15.

• The legal effect of the Regulations’ statement that “no action is required to be taken on adjoining premises” to make a dividing barrier comply (regulation 5(4)) and the tension between notification duties on the owner and the absence of duties on adjoining owners.

• Interpretation of the modified Australian Standard, in particular the interaction between the Regulations’ precise chainmesh thresholds and the more approximate language of the Schedule 2 Guidelines.

• Enforceability of the purchaser upgrade timetable and the Authority’s discretion to grant extensions under regulation 20.

• Any appeals or review of orders made under the Act that intersect with the Regulation-specified particulars for certificates and declarations.

Because the Regulations set procedural preconditions and documentary requirements, disputes are likely to revolve around administrative decision-making rather than pure substantive technical standards, save for cases challenging whether a barrier meets the modified Australian Standard or Community Safety Standard.

Advisory practicality. For litigation-sensitive matters, advisers should combine a records search for cases involving the Swimming Pool Safety Act 2004 with contemporaneous searches of the Territory registries, as well as inquiries to the Authority for unpublished internal policies that may shape decision-making. The statutory text here provides the framework and the procedural ladders that would be scrutinised in judicial review or appeal.

Several technical and procedural traps for advisers and clients emerge from close reading of the Regulations. They are matters that commonly lead to non-compliance or confusion if not attended to carefully.

Dividing barrier measurement and obligations. Regulation 5(3) modifies provisions that refer to a measurement on the outside of a swimming pool barrier so that, when applied to a dividing barrier, the reference is to a measurement on the inside. Schedule 2 clause 1(2) restates that a measurement on the outside of a barrier is, in relation to a dividing barrier, a reference to a measurement on the inside. The practical effect is that dividing barriers will be measured from the pool side, not the neighbouring side. Practitioners advising on compliance must be explicit about which face to measure from; measuring from the adjoining property side when the dividing barrier standard requires inside measurement is a common error.

Notice without remedy. Regulation 7 requires the owner who will use a dividing barrier to give a dividing barrier notice to the owner of the adjoining premises, warning that objects placed against the barrier might assist a child to climb over it. However, regulation 5(4) and Schedule 2 clause 1(3) make clear that no action is required to be taken on adjoining premises to make a dividing barrier comply. The practical gotcha is that an owner who gives the notice cannot compel works or removal of climbable objects on the adjoining property under these Regulations; the notice creates information duties, not remedial rights against the adjoining owner. Conveyancers and risk managers must flag that notification does not equal enforceable obligation on the neighbour.

Approximate language in Guidelines versus precise modifications. The Schedule 2 Guidelines use many “approximately” qualifications (for example, approximately 1.2 m height, apertures not greater than approximately 100 mm, gate latching release approximately 1.5 m above ground). Regulation 5, however, replaces AS 1926.1 Clause 2.3.2 with precise thresholds for chainmesh apertures and corresponding required heights, down to millimetres (13 mm and 100 mm, heights 1.2 m and 1.7 m). Advisers should not rely on the Schedule 2 approximations when assessing compliance with the modified Australian Standard for new pools; the Legislative text in regulation 5 on chainmesh is precise and controlling for standards-based compliance.

Interplay of interim and final certificates. An interim compliance certificate is revoked immediately after the Authority issues a compliance certificate for the same pool (regulation 15(1)). Failure to obtain a compliance certificate after relying on an interim certificate during construction could leave the owner exposed until the compliance certificate is issued. The administrative gotcha is that interim certificates are time-limited process tools; reliance on them should be coupled with active follow-through to obtain the final compliance certificate.

Purchaser upgrade timeline rigidity. Regulation 20 sets a default completion period of three months after transfer for purchasers to upgrade an existing, uncertified pool, with an application-in-writing for extension available. Practitioners must not assume generous implied timelines; the three-month default is the baseline and extensions are discretionary and may be conditional. Conveyancers should build this timetable into contracts and settlement negotiations.

Return of certificates and small penalty. When the Authority varies or revokes a certificate it requests the return of the original and the holder must return it within 30 days or declare it lost; failure carries a maximum penalty of five penalty units (regulation 14(3), regulation 15(5)). The consequence is small in monetary terms but procedurally enforceable. A common oversight is misplacing the certificate or failing to respond to the Authority’s request, which could result in penalty exposure.

What applicants must declare. Many application forms must include confirmation whether the owner or purchaser has received advice from a pool safety adviser (regulations 8(f), 10(g), 11(h), 16(g), 17(h)). This is not a substantive mandatory advice obligation, but omissions or inaccurate declarations risk administrative follow-up. Given the evidentiary advantage of professional advice, the requirement incentivises applicants to obtain and retain such advice.

Certificates may carry conditions. Regulations 13 and 19 require that issued certificates and acknowledgment notices include “any conditions imposed by the Authority”, and extensions under regulation 20 may impose conditions. Practitioners should expect that compliance relief, such as extended upgrade timelines, may come with enforceable conditions.

Exemptions are not absolute. Regulation 4 lists exemptions, but precise facts matter. For instance, the exemption for premises with a house not normally occupied by the owner applies only where accommodation is provided for a fee or under short-term lease for holiday accommodation (regulation 4(c)). Mistakenly assuming that any rental property is exempt is a frequent pitfall.

Administrative specifics matter. The Regulations frequently require that items be given or confirmed in particular forms or under particular Act sections (for example, dividing barrier notice in accordance with section 52(2) of the Act). Practitioners must cross-check the Act’s service rules to ensure proper compliance.

This section sets out a practical compliance pathway for owners, purchasers, conveyancers and advisers, grounded in the Regulations’ specific rules and timelines.

1. Determine whether the structure is exempt under regulation 4. If the premises are a hotel, motel, most holiday accommodation or a principally non-residential complex, the structure described in section 6(1) of the Act may be exempt (regulation 4). Confirm factual basis for exemption and retain documentation showing the premises’ use classification at the relevant time.

2. Identify whether the pool is new or existing and whether the premises are small or large. The certificate type and applicable standard differ. New pools typically fall under the modified Australian Standard identified in regulation 5; existing pools are assessed under the Community Safety Standard with the Schedule 2 Guidelines (regulation 6 and Schedule 2).

3. For new pools on small premises, lodge an application for an interim compliance certificate before construction, containing the particulars in regulation 8: owner name and address, premises address, whether the pool will meet the modified Australian Standard or a non-standard provision, particulars of non-standard enclosures if applicable, confirmation that a dividing barrier notice has been given to the owner of the adjoining premises where relevant, and whether the owner has obtained pool safety adviser advice.

4. If relying on a dividing barrier, serve a dividing barrier notice to the owner of the adjoining premises in accordance with the Act’s service rules (regulation 7(3)). The notice must include the specified content items: owner and premises details, a statement the dividing barrier will be used as the pool barrier, a warning about risk if objects are placed against the barrier, and advice to notify occupiers if the owner is not the occupier (regulation 7(2)). Retain proof of service and any correspondence.

5. Build construction and documentation to the modified Australian Standard. For chainmesh fencing, ensure compliance with the substituted Clause 2.3.2 in regulation 5(2): apertures not greater than 13 mm with top and bottom strainer wire and effective height not less than 1.2 m, or apertures greater than 13 mm but less than 100 mm with strainer wire and effective height not less than 1.7 m. When using a dividing barrier, measure the specified clearances on the inside face of the barrier (regulation 5(3) and (6)).

6. After construction, apply for a compliance certificate under regulation 9 including the interim certificate identification number and the date of completion. For general compliance certificates, ensure the application contains the particulars listed in regulation 10 including whether the pool complies with the modified Australian Standard or a non-standard safety provision, and any particulars of a non-standard enclosure.

7. For purchasers buying premises with an existing, uncertified pool, apply for a provisional compliance certificate or provisional acknowledgment notice with the particulars in regulation 11 or regulation 18 as relevant. Include the proposed completion date for the contract of sale, an estimate for completion of upgrading not exceeding three months after transfer, and the measures proposed to achieve compliance. Start upgrading as soon as practicable following transfer and complete within three months, unless an extension is granted in writing by the Authority (regulation 20(1)-(2)).

8. If needing more time to upgrade after purchase, apply in writing to the Authority for an extension under regulation 20(2). Anticipate conditions may be imposed and build those into project planning and cashflow. Retain written evidence of the extension and any conditions.

9. Use the Schedule 2 Guidelines as the assessment instrument for Community Safety Standard compliance for existing pools. Address recommended measures such as permanent barriers, isolating the pool from main entrances, not using driveway gates as pool barrier components, gate and door self-closing and self-latching mechanisms, latching release heights (Schedule 2 clauses 2, 4 and 5), and vegetation and objects clearance (Schedule 2 clause 7). Where possible, document compliance with photographs and technical measurements.

10. When the Authority issues a certificate, note any conditions imposed. If the Authority proposes to vary or revoke a certificate, prepare and lodge submissions within 14 days as permitted by regulation 14(1)(b) or regulation 15(3)(b). If requested to return a certificate following variation or revocation, return it within 30 days or declare it lost in writing to avoid exposure to the maximum five penalty unit sanction (regulations 14(3) and 15(5)).

11. Keep documentary evidence of all adviser reports, service of notices, measurements, installation certificates, and correspondence with the Authority. The Regulations repeatedly require applicants to state whether a pool safety adviser’s advice has been received (for example regulations 8(f), 10(g), 11(h), 16(g), 17(h)), and the presence of professional advice can be decisive in administrative assessments.

12. In conveyancing, ensure contract disclosure addresses existing pool certification status, the purchaser’s obligation to upgrade within three months, and any provisional certificates or temporary acknowledgment notices. Consider escrow, vendor undertakings, or price adjustments to manage the cost of remedial works.

13. For installing chainmesh fencing or using dividing boundaries, check whether measurements should be taken on the inside of the barrier (regulation 5(3)). Avoid relying on Schedule 2’s approximate language when the modified Australian Standard specifies precise thresholds.

14. Remain alert to amendments. The Endnotes list several amending Acts, including the 2013 Penalties Amendment and the 2025 Lands, Planning and Environment Legislation Amendment Act. Consult the reprint date and legislative history when advising on compliance obligations for transactions straddling amendment dates.

Following these steps will align factual practice with the Regulations’ documentary, measurement and timing requirements. Where doubt exists on interpretations that raise material risks, obtain written clarification from the Authority and retain it in the file.
